4 APPROVAL OF A NEGATIVE DECLARATION FOR
5 THE PETALUMA BICYCLE PLAN

8 WHEREAS, an Initial Study was prepared and the results of the study indicated that the
9 proposed Petaluma Bicycle Plan, will not cause any significant adverse environmental
to impacts; and,

12 WHEREAS, the Planning Commission of the City of Petaluma held a noticed public
13 hearing on November 9, 1999, on the subject application, heard testimony and concluded
t4 that the findings for the project were adequate and recommended to the City Council
15 approval of the proposed Bicycle Plan; and
16
17 WHEREAS, the City Council considered Petaluma Bicycle Plan on January 18, 2000,
18 and considered all written and verbal communications concerning potential
19 environmental impacts resulting from the project before rendering a decision;
20
21 NOW, THEREFORE, BE IT RESOLVED that the City Council approves the Negative
22 Declaration subject to the following Findings:

24 Findings for Approval of a 1Vliti~ated Negative Declaration:

26 1. That pursuant to Article 6, Negative Declaration Process, of the California
27 Environmental Quality Act (CEQA) Guidelines, the requirements of CEQA have
28 been satisfied through the preparation of an Initial Study, and a Negative
29 Declaration is appropriate to the project.

1 2. That no development projects are proposed with this project. Therefore, based
2 upon the Initial Study, there is no substantial evidence that the project would have
3 a significant effect on the environment.

5 3: That the project does not have the potential to affect wildlife resources as defined
6 in the Fish and Game Code, either individually or cumulatively, and is exempt
7 from Fish and Game filing fees because no projects are proposed at this time.

9 4. That the project is not located on a site listed on any Hazardous Waste Site List
l0 compiled by the State pursuant to Section 65962.5 of the. California Government
11 Code.

l3 5. That the Planning Commission reviewed the Initial Study/Negative Declaration
14 and considered public comments before making a recommendation on the project.

16 6. That the record of proceedings of the decision on the project is available for
l7 public review at the City of Petaluma Plarming Department, City Hall, 11 English
18 Street, Petaluma, California.
