RECOMMENDATION It is recommended that the City Council adopt the attached Resolution Authorizing Submittal of Application for Payment Programs and Related Authorizations for the Beverage Container Recycling City /County Payment Program from Cal Recycle, Delegating the Sonoma County Waste Management Agency the Authority to Submit Applications on the Behalf of Agency Members and Execute Agreements or Other Documents Necessary to Implement this Program. BACKGROUND Since 2000, the State of California, first with the Department of Conservation and. now with the Department of Recycling and Resource Conservation (CalRecycle), has allocated funding from uncollected deposits from beverage containers to California cities and counties. This program is called the City /County Payment Program (CCPP). For the entirety of this program, the Sonoma County Waste Management Agency has applied for these funds on behalf of all Sonoma County cities and the unincorporated county, pooled the funding, and implemented projects related to beverage container recycling. Past projects include creating agreements for beverage container collection service, purchasing new collection containers and enclosures, and, since 2012, administering an educational campaign around the State's Mandatory Commercial Recycling program. The memorandum contained in Attachment 2 is a current example of the benefits the City and the other agencies derive from this program. A requirement to expend all funds from each grant cycle within two years was introduced in the FY 14/15 cycle, and CalRecycle is in the process of introducing additional requirements for the FYI 5/16 grant cycle, including the need for the subject resolution. DISCUSSION CalRecycle sent a notice to all CCPP grant managers on December 23, 2015 with information about the FY 2015 /16 funding cycle. The notice stated all jurisdictions will be required to provide an authorizing resolution no later than the funding request due date yet to be determined by CalRecycle. To assist with the new requirement, CalRecycle provided a model authorizing resolution template. The resolution gives Sonoma County Waste Management Agency authority to submit applications on behalf of the Agency members and execute agreements and necessary documents to implement the program, through online funding request forms with the state on behalf of the City and other agency members. The proposed recycling program meets Council Goal: "Enhance Petaluma's Ability to Divert Solid Waste From the Waste Stream by Increasing Recycling and Composting." FINANCIAL IMPACTS Adopting this resolution would allow the Sonoma County Waste Management Agency to continue applying for and receiving grant funds to support regional recycling programs on the City's behalf. The grant is a pass - through so there is no net financial impact to the City. ATTACHMENTS 1. Resolution 2. WHEREAS, pursuant to Public Resources Code section 48000 et seq. the Department of Resources Recycling and Recovery (CalRecycle) has established various payment programs to make payments to qualifying jurisdictions; and WHEREAS, in furtherance of this authority CalRecycle is required to establish procedures governing the administration of the payment programs; and WHEREAS, CalRecycle's procedures for administering payment programs require, among other things, an applicant's governing body to declare by resolution certain authorizations related to the administration of the payment program. NOW, THEREFORE, BE IT RESOLVED that the City of Petaluma is authorized to submit an application to CalRecycle for any and all payment programs offered; and BE IT FURTHER RESOLVED that the City Manager, or his /her designee, is hereby authorized as Signature Authority to execute all documents necessary to implement and secure payment on behalf of the City of Petaluma; and BE IT FURTHER RESOLVED that the City of Petaluma delegates the Sonoma County Waste Management Agency the Authority to Submit Applications and Execute Agreements or other Documents Necessary to Implement this Program on behalf of the City of Petaluma; and BE IT FURTHER RESOLVED that this authorization is effective until rescinded by the Signature Authority or this Governing Body. Attachment 2 To: All Sonoma County City Managers From: Felicia Smith, Sonoma County Waste Management Agency Date: January 28, 2016 Subject: City /County Payment Program Funding Available for Recycling Receptacles Overview The City /County Payment Program is allocated funding from uncollected deposits from beverage containers, and can be used to promote beverage container recycling and litter reduction. There is funding available to your city for the purchase of recycling bins for both interior and exterior use. The Sonoma County Waste Management Agency (Agency), who administers the program, will fund the purchase of the containers and arrange for delivery; there is no cost to your city. Recycling receptacles can be purchased for both public and private sector needs. Receptacles can be used for city streets, bus stations, parking garages, parks, offices, schools or any other location that generates beverage containers. This is an opportunity to improve recycling efforts in your city to help drive landfill diversion rates. Background The City /County Payment Program is managed statewide by CalRecycle. Locally, Sonoma County Waste Management Agency has been administering the program on behalf of its agency members since 2000. During the 2014 /15 funding cycle, CalRecycle implemented a new policy, which requires funding to be expended within 24 months of payment. To ensure compliance, the Agency is requesting that we determine any need or gaps in recycling receptacles that they will fund. Allowable Expenses Allowable expenses include recycling receptacles that will be used to collect beverage containers (please note that stand -alone garbage receptacles cannot be purchased with these funds). Both exterior and interior bins are allowed. Receptacles can be purchased on behalf of businesses, government offices, downtown areas, parks, parking garages, bus shelters, schools, or multifamily complexes.
