HomeMy WebLinkAboutStaff Report 5.B 02/22/2016DATE: TO: FROM: SUBJECT: Agenda Item #5.B February 22, 2016 Honorable Mayor and Members of the City Council through City Manager Dan St. John, F.ASCE — Director, Public Works & Utilities Larry Zimmer, P.E. — Deputy Director, Public Works & Utilities Resolution Authorizing Award of Contract for the Downtown Accessibility Improvements Project and Approving Project Budget RECOMMENDATION It is recommended that the City Council approve the Resolution Authorizing Award of Contract for the Downtown Accessibility Improvements Project and Approving Project Budget. BACKGROUND The City of Petaluma's aged infrastructure system includes the public walkways. Aging concrete, root intrusion, expansive soils and a variety of other causes have created accessibility issues and potential tripping hazards throughout the City. City of Petaluma downtown areas are very old and some portions do not meet current accessibility standards. The City of Petaluma had been sued on various occasions, and has agreed through settlement to correct non - compliant sidewalks, particularly in and around the downtown area within a ten year period. This project is part of the 10 -year downtown accessibility improvement plan and begins to address accessibility issues identified in a settlement agreement. DISCUSSION This project will repair sidewalks, curb and gutter and driveways at various locations within the Petaluma business district in locations that address the settlement agreement. This is the initial project to focus on the settlement and comprises locations where the improvements can be done without any significant design work or extraordinary costs. The locations that will require a significant design effort will be included in future construction projects. The Notice Inviting Bids was advertised on December 10, 2015; nine (9) bids were received as follows: Name of Bidder Coastside Concrete & Const. Inc Michael Paul Co. Inc. Inc. $ $406,500.00 Team Ghilotti Inc. $ $409,300.00 Engineer's Estimate $ $250,000.00 The lowest responsible and responsive bidder, Coastside Concrete & Construction Inc., has performed various street projects for the City of Petaluma. Staff verified that Coastside Concrete & Construction Inc. possesses valid Class A, B and C -8 California Contractor's License, license number 995338, which expires on August 31, 2016, which qualifies Coastside Concrete & Construction Inc. to perform the work. Construction is scheduled to begin in April and to be completed by July 2016. Construction management and inspection services will be conducted by City staff with assistance by an outside consultant for geotechnical and material testing as needed. City staff designed the project and prepared the contract documents. The attorney for Skaff and D'Lil has been notified and provided construction drawings in accordance with the settlement agreement. The proposed action meets Council Goals: "Plan for and implement priority capital projects as funding permits." FINANCIAL IMPACTS The following table is a breakdown of estimated total project cost for the Downtown ADA Improvements Project: Phase Downtown ADA Improvements Project Budget Planning/Environmental $ - Design $ - Legal Services $ - Construction Contract $ 234,500.00 Construction Management $ 15,500.00 Project Management $ - Contingency $ 25,000.00 TOTAL: $ 275,000.00 2 Source Downtown Accessibility Improvements Project Public Works CIP Fund $ 275,000.00 $ 275,000.00 Total $ 275,000.00 $ 275,000.00 The funding for the Downtown Accessibility Improvements Project totals $275,000 and is in the Public Works CIP Fund. During fiscal year 2014/15, funds were transferred into the General Fund from the TOT fund to be used for downtown streets and sidewalks maintenance. Those funds were not spent during the fiscal year, and, as a part of the First Quarter Budget Adjustments, were committed to be used specifically for that purpose. During the Mid -Year Budget Adjustments Council Item presented on February 8t", $200,000 was transferred in from General Fund Committed Reserves into the Downtown Accessibility Improvements project. During fiscal year 2015/16, $136,000 was transferred into the General Fund from the TOT fund to be used for downtown streets and sidewalks maintenance. Of this amount, $75,000 remains unspent and was subsequently transferred into the Downtown Accessibility Improvements Project as a part of the Mid -Year Budget Adjustments Council item. Location Map Attachment 1 RESOLUTION AUTHORIZING AWARD OF CONTRACT FOR THE DOWNTOWN ACCESSIBILITY IMPROVEMENTS PROJECT AND APPROVING THE PROJECT BUDGET WHEREAS, in accordance with the City of Petaluma Charter and Municipal Code, California Public Contract Code Section 20162 and other applicable law, City staff prepared construction bid documents and solicited bids for the Project; and WHEREAS, the project was bid on December 10, 2015, and nine (9) bids were received and opened on January 6, 2016 in accordance with applicable law; and WHEREAS, the lowest responsible bid for the Project was submitted by Coastside Concrete & Construction Inc., Rohnert Park, CA for $234,500; and WHEREAS, the lowest bid amount of the for the Project was within the budgeted amount of $250,000 for construction; and WHEREAS, it has been determined that the Contractor's bid satisfies the bidding requirements for the Project; and WHEREAS, it is verified that Coastside Concrete & Construction Inc. possesses a valid California Contractor's License, Class A, B and C8 California Contractor's License, license number 995338 , that qualifies Coastside Concrete & Construction Inc. to perform the Project; and WHEREAS, there is sufficient funds in the Public Works CIP to fund the project based on actual bid prices and cost of project management and design services; and WHEREAS, the Project is categorically exempt pursuant to California Environmental Quality Act ( "CEQA ") and Title 14, the California Code of Regulations ( "CEQA Guidelines "), Section 15301, because the project would result in negligible or no expansion of use beyond what currently exists. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Petaluma hereby: In accordance with the City of Petaluma Charter and Municipal Code, California Public Contract Code Section 20162 and other applicable law, waives any and all non- conformance in the bid of Coastside Concrete & Construction Inc., for the Downtown Accessibility Improvements Project, and finds the bid of $234,500 to be the lowest, responsive bid and further finds that Coastside Concrete & Construction Inc., is the lowest responsible bidder. Awards the contract for the, Downtown Accessibility Improvements Project to Coastside Concrete & Construction Inc., in the amount of $234,500, the amount of the lowest responsive bid, conditioned on Coastside Concrete & Construction Inc., timely executing the project contract and submitting all required documents, including but not limited to, executed bonds, certificates of insurance, and endorsements, in accordance with the project bid documents. 4. Approves an amount of $275,000 from Public Works CIP budget for this project. 5. Directs staff to issue a notice of award to Coastside Concrete & Construction Inc. 6. Authorizes and directs the City Manager to execute the project contract on behalf of the City of Petaluma upon timely submission by Coastside Concrete & Construction Inc., of the signed project contract and all other required documents, including but not limited to, executed bonds, certificates of insurance, and endorsements, in accordance with the project bid documents.
