2 DENYING, IN PART, AND UPHOLDING, IN PART, THE APPEAL, 4 OF RICHARD
LIEB, LANA SUTTON AND LEO AND JIMMY PAPAGEORGE OF THE
4 CONDITIONS OF APPROVAL OF THE SITE PLAN AND ARCHITECTURAL
5 REVIEW COMMITTEE REGARDING "PAPA'S TAVERNA", 600 EAST
6 WASHINGTON STREET, APN 007-062-040

8 WHEREAS, on February 24, 2000, the Site Plan and Architectural Review Committee
9 (SPARC) held a public hearing, heard testimony and conditionally approved the site,
1o architectural and landscape plan for "Papa's Taverna", an addition/remodel of an existing
11 structure at 600 East Washington Street, APN 007-062-040; and

] 3 WHEREAS, on March 9, 2000, the Planning Division received a letter of appeal
14 regarding the conditions of approval pertaining to landscaping, color, signs and the use of
15 animal cutouts/murals is not warranted for the proposed project; and

i 7 WHEREAS, a noticed public hearing was held by the City Council on April 3, 2000.

19 NOW THEREFORE, BE IT RESOLVED that the City Council, based on the evidence
20 and testimony presented for the record at the public hearing on April 3, 2000, hereby
2i finds and determines as follows:

23 a) that the proposed landscaping plan for the parking lot on the site does not provide
24 adequate shading and hereby denies the appeal of Condition 1 and directs SPARC to
25 reconsider the landscaping plan for the project in order to provide additional parking
26 lot shading;

28 b) that the height of the existing sign frame exceeds the height limit for monument signs
29 on Washington Street and hereby denies the appeal of Condition 4;

i c) that the color palette for the building is appropriate and hereby upholds the appeal of
2 Condition 2;
3 d) that the painted animal figures proposed for the roof are consistent with the overall
4 design theme of the project, provided they are mounted at a 90 degree angle to the
5 existing roof line, and hereby upholds the appeal of Condition 3.
