HomeMy WebLinkAboutResolution 2010-223 N.C.S. 12/20/2010Resolution No. 2010 -223 N.C.S. of the City of Petaluma, California RESOLUTION APPROVING THE PROJECT BUDGET AND AUTHORIZING THE AWARD OF CONTRACT FOR THE DEPARTMENT OF ENERGY'S ENERGY EFFICIENCY AND CONSERVATION BLOCK GRANT HVAC RETROFIT PROJECT WHEREAS, the City has been allocated $514,500 of Energy Efficiency and Conservation Block Grant ( EECBG) funding; and, WHEREAS, to optimize use of EECBG grant funds, staff worked with an energy efficiency consultant to prepare a selection of Energy Conservation Measures as a result the HVAC Retrofit Activity was recommended for implementation; and, WHEREAS, in order to utilize the EECBG funds, an Energy Efficiency and Conservation Strategy (Strategy), which provides specific Energy Efficiency Measures that will be implemented within the grant funds, was submitted to and approved by the Department of Energy; and, WHEREAS, City staff has prepared construction bid documents and advertised for construction of this Project; and, WHEREAS, in accordance with the City of Petaluma Charter and Municipal Code, California Public Contract Code Section 20162 and other applicable law, City staff solicited bids for the Project; and, WHEREAS, the project was bid on October 21, 2010, and six (6) bids were received and opened in accordance with applicable law; and, WHEREAS, the lowest responsible bidder for the Project was from RJ Mechanical for $200,330.24; and, WHEREAS, staff has determined that RJ Mechanical's bid satisfies the bidding requirements for the project; and, Resolution No. 2010 -223 N.C.S. Page 1 WHEREAS, staff has verified that RJ Mechanical possesses a valid California Contractor's License, Class C -20, number 856063 that qualifies RJ Mechanical to perform the Project; and, WHEREAS, the project is categorically exempt from the California Environmental Quality Act ( "CEQA "), pursuant to Title 14 California Code of Regulations, section 15301, as the minor modification of existing facilities with negligible or no expansion of use. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Petaluma hereby: Approves the Project Budget in the amount of $264,025. 2. In accordance with the City of Petaluma Charter and Municipal Code, California Public Contract Code Section 20162 and other applicable law, waives any and all non- conformance in the bid of RJ Mechanical for the HVAC Retrofit Project and finds RJ Mechanical the lowest responsible bidder of $200,330.24. Awards the contract for the HVAC Retrofit Project to RJ Mechanical, in the amount of $200,330.24, the amount of the lowest responsive bid, conditioned on RJ Mechanical's timely executing the project contract and submitting all required documents, including but not limited to, executed bonds, certificates of insurance, and endorsements, in accordance with the project bid documents. 4. Directs staff to issue a notice of award to RJ Mechanical. Authorizes and directs the City Manager to execute the project contract on behalf of the City of Petaluma upon timely submission by RJ Mechanical of the signed project contract and all other required documents, including but not limited to, executed bonds, certificates of insurance, and endorsements, in accordance with the project bid documents. Under the power and authority conferred upon this Council by the Charter of said City.
