HomeMy WebLinkAboutResolution 00-085 N.C.S. 05/01/2000 I~esolntion loo. 00-85 ~,~,5, 1 2 of the City of Petaluma, California 3 4 5 DIRECTING CITE' STAFF T® PR®CESS CHELSEA GCA APPLICATI®N 6 AND SIJSPENI) C®R®NA REACH SPECIFIC PLAN PR®CESS 7 8 9 10 WHEREAS, the City Council of the City of Petaluma adopted Resolution No. 11 91-136 N.C.S. which sets forth various approvals with respect to properties currently 12 owned by Chelsea GCA .Realty, Inc., more particularly described as Assessor's Parcel 13 Number 007-391-009 (Parcel B) and Assessor's Parcel Number 048-080-033 (Parcel C); 14 and 15 WHEREAS, Resolution No. 91-136 N.C.S. includes condition 53 which requires 16 a Preliminary Master Plan of the area be undertaken; and 17 WHEREAS, Chelsea GCA Realty, Inc., purchased the subject property in 1995; 18 and 19 WHEREAS, in 1995 the City Council determined that a Corona Reach Specific 20 Plan ("CRSP") was to be prepared for the Corona Reach area of the City of Petaluma; 21 and 22 WHEREAS, Chelsea agreed to participate in a CRSP process; and 23 WHEREAS, due to changed circumstances and events, including continued 24 flooding in the City, increased concerns regarding the effects on flooding by building in 25 the flood plain, transportation issues including consideration of alternative cross-town 26 connectors/interchanges, the City Council suspended the CRSP process; and 27 WHEREAS, Chelsea GCA Realty, Inc., submitted an application for 28 development of Parcels B and C; and 29 WHEREAS, the City Council accepted Chelsea's application for ,processing and 30 determined that a CRSP would be a vehicle to satisfy condition 53 of Resolution No. 91- 31 136 N.C.S.; and 32 WHEREAS, further studies and investigation revealed a need, among other 33 things, for a comprehensive study of drainage, flooding, and transportation issues which 34 could be accomplished in a revised or new General Plan; and 00-85 Page 1 of 2 Resolution No. N.C.S. 'r . ~ 1 WHEREAS, Chelsea and other property owners within the CRSP area have 2 demanded refunds of the balance of monies previously submitted to the City and have 3 indicated an unwillingness to provide any further funding for the Specific Plan process in 4 the Corona Reach area. 5 NOW, 'I'>E-IEREFORE, BE IT RESOLVE]) that because of changed 6 circumstances and new information, the Council deems that there has been substantial 7 change in the need for condition 53 and directs staff to process the Chelsea application 8 without the requirement for a completed CRSP. 9 BE IT FURTHER RESOLVED that the City Council hereby suspends the 10 current CRSP process at this time while reserving the right to reactivate the CRSP 11 process or establish a similar process ~in the future using, to the extent it is applicable and l2 appropriate, information and materials received and generated during the prior CRSP 13 process for a future similar process and/or in analyzing future development applications 14 within the Corona :Reach area. 15 16 17 18 19 20 21 22 23 sirsioo (rnilc) Under the power and authority conferred upon this Council by the Charter of said City.
