SUBJECT: Resolution Authorizing Grading Prior to Final Map Approval for the Riverfront
Subdivision Project.
RECOMMENDATION
It is recommended that the City Council adopt a resolution authorizing grading prior to final map
approval for the Riverfront Subdivision project.
BACKGROUND
Riverfront Subdivision is a mixed use development located at 500 Hopper Street. The
subdivision received tentative map approval by the City Council on July 7, 2014. The final map
and improvement plans have been submitted to the City of Petaluma and are currently in the
review process. The developer, Basin Street Properties, is requesting pei�niss. to commence
grading activity on the subdivision site prior to final map approval.
According to section 20.3 6.010 of the Petaluma Municipal Code, no permanent improvement
work shall be commenced until improvement plans and profiles have been approved by the City
Engineer, and a subdivision improvement contract has been executed in writing between the
subdivider and the City. These approvals follow the Council's approval of the final map, which
has not yet occurred. While grading is not considered a permanent improvement as defined in
this section, the City requires the developer to enter into a grading agreement and provide a
surety to secure the performance of any grading work that occurs prior to the final subdivision
improvement contract.
DISCUSSION
The purpose of this proposed resolution is to allow the site to be rough graded and the underlying
soils to be prepared for construction in advance of issuance of permits for site and building
improvements, which are currently scheduled to start summer of 2016. The grading plan has
been carefully reviewed, and a peer review analysis has been conducted by a third party
geotechnical engineering firm of the applicant's geotechnical engineering report. i-s 4The
geotechnical report is required for rough grading prior to final map approval. —The review
indicates that the project geotechnical report recommendations are appropriate for the grading
request and final development.
If the subdivider fails to secure final map approval, or the project is abandoned after the grading
is complete, the subdivider is required to restore the area graded to its prior condition as stated in
the grading agreement.
FINANCIAL IMPACTS
The final map and improvement plan applications for the Riverfront Subdivision are subject to
cost recovery. Costs for staff time spent reviewing the grading prior to final map approval, in
addition to the final map and improvement plan review, are 100% recovered through application
deposits submitted by the developer. This action does not impact the General Fund.

RESOLUTION AUTHORIZING GRADING FOR RIVERFRONT SUBDIVISION
PRIOR TO FINAL MAP APPROVAL
WHEREAS, the developer, Basin Street Properties has requested permission to grade the
Riverfront Subdivision site at 500 Hopper Street prior to final map approval; and,
WHEREAS, the developer agrees to comply with the City Grading and Erosion Control
Ordinance No. 1576 NCS and Storm Water Ordinance No. 2209 NCS; and,
WHEREAS, the developer agrees to comply with the Regional Water Quality Control
Board's policies, file a Notice of Intent and prepare a Storm Water Pollution Prevention. Plan;
and,
WHEREAS, the developer agrees to enter into a grading agreement and provide surety
to secure the performance of the grading work; and,
WHEREAS, the developer shall obtain a grading permit from the Building Department.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Petaluma as
follows:
1. Grading of the Riverfront Subdivision prior to final map approval is authorized,
conditioned on:
a. The developer's first entering into a grading agreement with the City

resolution as Exhibit ", and providing security satisfactory to the City to
secure performance of the grading work.
b. The developer's first obtaining a grading permit from the City's Building
Department.
c. The developer's first filing a Notice of Intent and preparing a Storm Water
Pollution Prevention Plan and developer's compliance with the requirements
of the Regional Water Quality Control Board.
d. The developer's compliance with the City's Grading and Erosion Control
Ordinance, No. 1576 NCS and its Storm Water Ordinance, No. 2209 NCS.
2. The City Manager is authorized to execute agreement documents as necessary and
appropriate to implement the authorization contained in this resolution.

This letter represents our formal request for City Council approval to allow grading on the site
prior to Final Map. Subdivision improvement plans for the entire project have been submitted
and are under review. Mass grading is apart of that submittal. A grading permit application has
also been submitted. It is understood that the mass grading portion shall require staff approval
prior to City Council.
