S. of the City of Petaluma, California 3 4 5 RESOLUTION AlYIENDING WEST VIEW ESTATES' SUBDIVISION 6 AGREEIVIENT TO ALLOW THE SUBDIVISION TO CONTRIBUTE 7 $212,1.95 TO THE CITY'S UNDERGROUND UTILITY FUND FOR 8 THE FUTURE UNDERGROUNDING OF UTILITIES 9 ALONG BODEGA AVENUE, IN LIEU OF UNDERGROUNDING 10 THEIR UTILITIES ALONG BODEGA AVENUE WITH THE 11 CONSTRUCTION OF THE SUBDIVISION'S FRONTAGE 12 INIPROVEIVIENTS; REQUIRING SUBDIVISION TO MODIFY THEIR 13 FRONTAGE IMPROVEMENTS ALONG BODEGA AVENUE TO 14 MATCH THE CITY'S FUTURE ROADWAY IMPROVEMENTS; 15 AUTHORIZING THE CITY lYIANAGER TO E~CUTE A PAYBACK 1.6 AGREEMENT WITH THE DEVELOPER FOR IvIODIFICATIONS 17 FOR THE BODEGA AVENUE IMPROVEIVIENT PROJECT 18 PROJECT N0.9864 19 20 WHEREAS, the City Council requested that City personnel look into ?_ 1 combining West View Estates' undergrounding of utilities along Bodega Avenue 22 with a larger City underground utility district; and V 23 24 WHEREAS, the City and the County have agreed to do an underground 25 utility district along Bodega Avenue in the nest five years; and 26 27 WHEREAS, the utility companies recommend that one large underground 28 utility district be done instead of several small districts; and 29 30 WHEREAS, West View Estates Subdivision has agreed to deposit with the 31 City funds in the amount estimated by the utility companies to cover the cost of 32 the subdivision's undergrounding along Bodega Avenue; and 33 34~ WHEREAS, West View Estates Subdivision should be required to modify 35 their improvements along Bodega Avenue to match the City's future roadway 36 improvements; and 37 38 WHEREAS, the developer will be requesting reimbursement from the City 39 for actual costs in excess of the subdivision's portion of costs; and 40 41 tiVIIEREAS, the City will reimburse the developer from traffic mitigation 42 impact fees for the cost of the modifications along Bodega Avenue. 43 /// 44 /// 4~ /,~/ 46 /// Resolution No. Zppp_142 N.C.S. 1 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City_ 2 of Petaluma, California that: 3 4 1. West View Estates Subdivision is hereby directed: 5 6 To deposit with the City $212,195 for future undergrounding along 7 Bodega Avenue, in lieu of the subdivision undergrounding along ~ Bodega Avenue with the construction of their required frontage 9 improvements. 10 11 Modify their frontage improvements along Bodega Avenue to 12 match the City's future roadway improvements, with reasonable 13 cost for modifications to be paid by the City. 14 15 2. The City Manager is authorized to e;cecute a payback agreement with the L6 developer for modifications to his frontage improvements along Bodega 17 Avenue. 1~ 19 Under the power and authority conferred upon this Council by the Charter of said City.
