APPROVING THE PROJECT BUDGET AND
AWARD OF CONTRACT FOR THE RECYCLED WATER
BOOSTER PUMP NO.2 IMPROVEMENTS PROJECT
CITY PROJECT NO. C00500908
WHEREAS, City staff, working with ArcSine Engineering, has prepared construction
bid documents and advertised for construction of this Project; and,
WHEREAS, in accordance with the City of Petaluma Charter and Municipal Code,
California Public Contract Code Section 20162 and other applicable law, City staff solicited bids
for the Project; and,
WHEREAS, the project was bid on September 15, 2010, and two (2) bids were received
and opened on September 29, 2010 in accordance with applicable law; and,
WHEREAS, the lowest bid for the Project was from Cats 4U, Inc. for $67,650 and,
WHEREAS, staff has determined that Cats 4U, Inc.'s bid satisfies the bidding
requirements for the Project; and,
WHEREAS, staff has verified that Cats 4U, Inc. possesses a valid California
Contractor's License, Class A, number 465781 that qualifies Cats 4U, Inc. to perform the
Project; and,
WHEREAS, the Project is categorically exempt pursuant to California Environmental
Quality Act ( "CEQA ") and Title 14, the California Code of Regulations ( "CEQA Guidelines "),
Section 15301, because the project consists of rehabilitation of existing structures, facilities, or
mechanical equipment involving negligible or no expansion of an existing use.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City hereby:

1. In accordance with the City of Petaluma Charter and Municipal Code, California
Public Contract Code Section 20162 and other applicable law, waives any and all
non - conformance in the bid of Cats 4U, Inc. for the Recycled Water Booster Pump
No. 2 Improvements Project, Project No. C00500908, finds the bid of $67,650 to be
the lowest, responsive bid and further finds that Cats 4U, Inc. is the lowest
responsible bidder.
2. Authorizes the inclusion of the necessary budget adjustment in the mid -year Budget
Adjustment as follows:

3. Awards the contract for the Recycled Water Booster Pump No. 2 Improvements
Project to Cats 4U, Inc. in the amount of $67,650, the amount of the lowest
responsive bid, conditioned on Cats 4U, Inc.'s timely executing the project contract
and submitting all required documents, including but not limited to, executed bonds,
certificates of insurance, and endorsements, in accordance with the project bid
documents.
4. The City Manager and /or his designee is hereby authorized to execute on behalf of
the City of Petaluma amendments to the contract, so long as such amendments in the
aggregate do not increase the original contract not -to- exceed amount by more than
$25,000.
5. Directs staff to issue a notice of award to Cats 4U, Inc.

6. Authorizes and directs the City Manager to execute the project contract on behalf of
the City of Petaluma upon timely submission by Cats 4U, Inc. of the signed project
contract and all other required document, including but not limited to, executed
bonds, certificates of insurance, and endorsements, in accordance with the project bid
documents.
