7 RESOLUTION ADOPTING PIJD DEVELOPMENT STANDARDS
8 FOR THE PARENT-SORENSEN MORTUARY
9 AT 850 KEOKUK STREET, APN 006-031-048

l2 WHEREAS, the Planning Commission held a public hearing on the proposed Rezoning, PUD
l3 Development Standards, and Tentative Parcel Map on December 8, 1998, after giving notice of
14 said hearing, in the manner, for the period, and in the form required by Ordinance No. 1072
IS N.C.S., as amended; and

17 WHEREAS, at the end of the public hearing the Planning Commission voted 6-0 to recommend
l 8 that the City Council adopt a Negative Declaration and approve the project; and

20 WHEREAS, the City Council held a public hearing on the proposed project on January 19, 1999,
21 after giving notice of said hearing, in the manner, for the period, and in the form required by
22 Ordinance No. 1072 N.C.S., as amended; and
23
24 WHEREAS, the City Council finds that the requirements of the California Environinenfal
25 Quality Act (CEQA) have been satisfied through the preparation of an Initial Study, and, by
26 Resolution No. 99-18 N.C.S., has adopted a Negative Declaration for the project, finding that
27 there is no substantial evidence that significant impacts to the environment would occur.

29 WHEREAS, the City Council has reviewed the proposed PUD Development Standards, as set
30 forth in the attached Exhibit A, and as revised or modified, and in accordance with the
31 recommendation of the Planning Commission, finds that:
32
33 1. That the PUD Development Standards allow for the continued operation of the existing
34 uses, and will result in more appropriate and compatible uses in the district.
35
36 The proposed PUD Development Standards delete uses currently allowed in the C-H
37 District which may no longer be considered appropriate to the site due to the proximity of
38 residential uses and school facilities.

i 2. That the plan for the proposed development presents a unified and organized arrangement
2 of buildings and service facilities which are appropriate in relation to adjacent or nearby
3 properties, and that adequate landscaping and/or screening is included to ensure
4 compatibility.

6 The site is developed with existing buildings, parking, landscaping, and other site
7 improvements, which are appropriate to the current use and to adjacent uses. A future
8 change in use would be required to comply with the adopted development standards,
9 and/or applicable provisions of the Zoning Ordinance and Municipal Code.

ll 3. That the proposed project has complied with the requirements of CEQA through the
12 preparation and adoption of a Negative Declaration prepared for this project, which
U addresses the potential environmental impacts associated with its development, and no
]4 further environmental analysis is necessary.

16 In compliance with the requirements of the California Environmental Quality Act, an
17 Initial Study was prepared for the rezoning of the site from C-H, Highway Commercial,
18 to PUD (the tentative parcel map is exempt from CEQA review). Based upon the Initial
l9 Study, a determination was made that no significant environmental effects would result.
20 Consequently, a Notice of Intent to Adopt a Negative Declaration was prepared. A copy
21 of this Notice was published in the Argus Courier and provided to residents and
22 occupants within 300 ft. of the site, in compliance with CEQA requirements.

24 WHEREAS, the City Council by Ordinance 2.081 NCS ,has adopted the Planned Unit District
25 for the Parent-Sorensen Mortuary parcel located at 850 Keokuk Street, APN 006-03 ] -048.

27 WHEREAS, the PUD Development Standards shall go into effect concurrent with the effective
28 date of the rezoning as specified by Ordinance 2081 NCS .

3o NOW, THEREFORE BE IT RESOLVED that the City Coluicil of the City of Petaluma does
3 ~ hereby adopt the PUD Development Standards for the Parent-Sorensen Mortuary parcel located
32 at 850 Keokuk Street, APN 006-031-048, subject to the following Conditions of Approval:

4 Department, dated October 5, 1998, project narrative, and proposed PUD Development
5 Standards, as conditioned and/or revised, including:

8 Commission staff report.

12 2. Unless otherwise addressed within the PUD development standards, all .applicable
13 provisions of the Zoning Ordinance, Site Plan and Architectural Review Committee Design
14 Guidelines, and the Municipal Code shall apply, including, but not limited to, signs,
15 parking, and performance standards.

11 1.0 Purpose of the PUD Zone.
12
13 The purpose of the PUD zone for the Parent-Sorensen property is to recognize the existing mix
14 of residential and community serving use on the site, to provide appropriate standards to enable
15 the existing single family residence to be subdivided from the existing community serving use,
16 and to designate and regulate potential future uses consistent with the historic use of this
17 property by providing for commercial and professional establishments designed to serve needs
18 beyond those of the immediate neighborhood, which are therefore located convenient to highway
19 or arterial street traffic.

22 2.0 Project Site.

24 Lands of Parent-Sorensen is a 59,292 s.f. single parcel (APN 06-031-48) within the city limits of
25 the City of Petaluma, and bounded on the north by Magnolia Avenue, on the west by Keokuk
26 Street, and on the east by Liberty Street. The site is frilly developed with a
27 mortuary/crematorium,* a detached related office building, and a .small single family dwelling.
28 The property is .situated in an area of mixed uses: single and multi-family residential, industrial,
29 and public/quasi public.

34 3.0 Character of Proposes Uses/Uses on Specific Lots.

36 Any use permitted under Section 3.1 (Permitted Principal Uses) and 3.2 (Permitted Accessory
37 Uses) will be acceptable on Lot 1 as designated on the Final Map for the subdivision if it can be
38 demonstrated that none of the activities or equipment related to such use would create noise
39 levels at the adjacent residential property line in excess of Petaluma community standards
4o established in the General Plan.

1 3.1 Permitted Principal Uses -Lot 1. The following are the principal uses
2 permitted in the Parent-Sorensen PUD:

4 • Mortuaries, crematoriums, columbariums, and crypts.

6 • Ambulance services.
8 • Motels.

10 • Nurseries, greenhouses, fruit stands.

12 • Restaurants (excluding fast-food restaurants).

14 • Business and professional offices.

?6 • Churches, schools, and similar educational and cultural institutional uses.

18 • Single family detached dwellings.

20 3.2 Permitted Accessory Uses -Lot 1

22 • Accessory uses and buildings customarily appurtenant to a permitted use, except when
23 abutting a residential zoning district, in which case the provisions for primary uses and
24 structures in this district shall also apply to accessory uses and buildings.

26 • Signs.

28 • Mini-telecommunication facilities in accordance with all applicable provisions of
29 Chapter 14.44 of the Municipal Code, which have received site plan and architectural
3o review and approval by the Planning Director.
32 3.3 Conditional Uses -Lot 1. The following are the conditional uses allowed in the
33 Parent-Sorensen PUD, in accordance with the provisions of Article 21 and Section 26-
34 500 of the Zoning Ordinance.

36 • Public and quasi-public uses appropriate to the existing uses on site or to the principal
37 permitted uses of the PUD and to the adjacent residential neighborhood.

39 • Animal hospitals and veterinary clinics.

41 • Convenience markets.

43 • Commercial recreational facilities.

7 • Neighborhood serving retail businesses (retail businesses intended primarily to serve
8 residents of the neighborhood).

12 • RMG residential uses consistent with Article 8 of the Zoning Ordinance.

14 ® RC Compact single family residential dwellings consistent with Article 7 of the Zoning
15 Ordinance.

17 ® Mixed use structures having commercial use on the lower floor with residential uses on
18 floors above the ground floor.

20 3.4 Development Standards.. The following development standards shall apply to
21 Lot 1.

23 3.4.1 Maximum Height. No building or structure of any kind constructed on the site
24 shall exceed the height of forty (40) feet above the established building grade for
25 the site unless approved by SPARC.
26
27 3.4.2 Covera e. No building to site coverage shall be allowed greater than 60%
28 provided that the residential use coverage of Lot 2, existing as of the effective
29 date of this ordinance, shall be deemed in conformance with this section but shall
3o not be increased.

32 3.4.3 Lot Area and Yard Requirements. The lot area of Lot 1 shall be as described on
33 the PUD/Tentative Map. Yard requirements for Lot 1 shall be:

s • Roof overhangs for a distance not greater than 3 ft.

7 • Steps, walkways, patios, decks, and similar uncovered improvements outside of
8 the required landscape areas as designated in these standards.

10 • Driveways as may be reasonably required for service to the buildings for
11 parking/loading areas.

13 • Fences no higher than 3.5 ft. tall.

l s • Landscaping, including planters.

17 • Signs, as permitted by these standards.

19 • Parking areas consistent with the requirements of Article 20 of the Zoning
20 Ordinance.

22 3.4.4 Landscaping. Landscape areas shall be as depicted on the Parent-Sorensen
23 PUD/Tentative Map, or as approved by SPARC in the event of a change of use.

25 3.4.5 Accessory Structures. Accessory structures, including but not limited to, trash
26 enclosures and storage facilities, must completely screen the contents from view
27 of any window on adjacent buildings and must be located such that there is
28 minimum disruption to circulation within the property or on adjacent properties.

30 3.4.6 Storage and Refuse Areas. Any storage and refuse areas shall be screened by
3l visual barriers and shall be located on the rear or side portions of the site and not
32 within the front setback area. No junk, scrap, rubbish, trash, litter, or refuse shall
33 be deposited or permitted to remain or accumulate on any site or portion thereof
34 which will detract from its neat and orderly appearance. All such rubbish, trash,
35 liter, or refuse shall be kept in sanitary containers.

1 3.4.6 Signs. Signage consistent with existing approved signs. New signage shall
2 comply with the provisions of the Zoning Ordinance regarding signs.
4 3.4.7 Parking and Loading. Parking and loading facilities shall be provided as depicted
5 on the Parent-Sorensen PUD/Tentative Map, or as approved by SPARC consistent
6 with Article 20 of the Zoning Ordinance.

8 3.4.8 Design Guidelines. All new buildings, additions, and exterior improvements are
9 subject to the City of Petaluma SPARC approval.

u ® All electrical and mechanical apparatus, equipment (including satellite dishes),
12 fixtures (other than lighting fixtures), conduits, ducts, vents, flues, and pipes
13 mounted or placed. on the roof surface shall be concealed from view from the
14 streets in a manner approved by SPARC and the City of Petaluma.

16 ® Exterior walls shall be wood, brink, or architecturally treated masonry, concrete,
17 or similar material approved by SPARC.

19 ® Exterior walls shall be painted or suitably treated.

2l o Metal awnings or roof treatments are acceptable as accents only.

23 a All landscaping located within a lot shall be maintained by the owner to the
24 standards established by the original design.

26 ® All on-site electrical, telephone, and other utility lines shall be underground and
27 shall not. be exposed on the exterior of any structure.

29 ~ All building elevations shall be similarly treated; design elements should be
3o carried out on all sides of any building.

32 • Security and parking lot light fixtures shall be of tastefiil architectural design
33 and consistent throughout Lot 1. Locations, mounting, and direction of light
34 fixtures shall be cognizant of adjacent residential uses, yet acceptable to City
35 police for provision of security.

1 4.0 Permitted Uses -Lot 2.

3 Single family dwellings and accessory uses shall be allowed as a permitted use on Lot 2. Yard
4 requirements and other development standards shall be consistent with the existing uses as shown
5 on the PUD/Tentative Map.

7 5.0 Prohibited Uses -Lots 1 and 2. The following uses are prohibited in the Parent-Sorensen
8 PUD:

l o • Junk yards.

12 • Quarrying. `

14 • Commercial excavation except in the course of approved construction.

16 • Distillation of bones.

18 • Dumping/disposal/incineration/or reduction of garbage, sewage, offal, or refuse.

20 • Fat rendering, stock yards, or slaughter houses.

22 • Refining of petroleum and its products.
23
24 • Smelting of iron, tin, zinc, and other ores.
25
26 • Jails or honor farns.
27
28 • Truck or bus terminals.

30 • Petroleum storage yards.

32 • Auto wrecking, auto painting, or auto body repair.

34 • Billboards or off-site signs.

36 • Uses which create a nuisance.

~9 6.0 Nuisances.

41 No nuisance shall be permitted to exist or operate upon any lot (Lot 1 or Lot 2) so as to be
42 offensive or detrimental to any adjacent lot, or property, or its occupants. A "public nuisance"
43 shall include, but not be limited to, any of the following conditions:

~ ® Any use, excluding reasonable construction activity, of the lot which emits particulate
2 or gaseous matter, emits dust, sweepings, dirt, or cinders into the atmosphere, or
3 discharges liquid, solid wastes, or other matter into any stream, water course, river, or
4 other waterway which may adversely affect the health or safety of persons or
5 vegetation, or comfort of or intended reasonable use of their property by persons within
6 the area. No waste nor any substance or materials of any kind shall be discharged into
7 any public sewer serving the property or any part thereof in violation of any regulation
8 of any public body having jurisdiction over such sewer.

to • The escape or discharge of any fiimes, odor, gases, vapors, steam, acids, or other
11 substance into the atmosphere which discharge, in the opinion of the City, may be
12 detrimental to the health, safety, or welfare of any person, or may interfere with the
13 comfort of persons within the area, or which may be harmful to property or vegetation.
14
15 • The radiation or discharge of intense glare or heat, or atomic, electromagnetic,
16 microwave, ultrasonic, laser, or other radiation. Any operation producing intense glare
17 or heat or such other radiation shall be performed only within an enclosed or screened
18 area, and then only in such a manner that the glare, heat, or radiation emitted shall noY
19 be discernible from any point exterior to the site or lot upon which operation is
20 conducted.

22 • Any use which has the potential to create a public health, fire, or explosion hazard, in
23 the opinion of the City Fire Marshall.
24
25 • Excessive Noise. At no point outside of the vertical plane of any property line shall the
26 sound pressure level of any machine, device, or any combination of same, from any
27 individual plant or operation, exceed the decibel levels in the Zoning Ordinance, or any
28 the public body having jurisdiction.

30 • Excessive emissions of smoke, steam, or particulate matter. Any such emissions shall
31 be in full compliance with the current regulations of the Bay Area Air Quality
32 Management District.

1 7.0 Exceptions -Lots 1 and 2.

3 Whenever the. standards contained in these PUD Development Standards do not address an aspect
4 of physical development or use within the development, the Planning Director may regulate this
5 development by interpreting the most comparable sections of other City Zoning Districts. The
6 Director may also refer such duestions of development standards or uses to either SPARC or the
7 Planning Commission for a decision. Any decision by the Director, SPARC, or Planning
8 Commission may be appealed to the City Council through standard appeal procedures contained in
9 the Zoning Ordinance.

11 Exceptions to specific PUD Standards may be approved by SPARC, provided that the overall
12 design concept and desired quality is not compromised by the particular exception.

15 8.0 Unless Otherwise Addressed -Lots 1 and 2.

17 Unless otherwise addressed within these PUD Development Standards, all applicable provisions of
18 the Zoning Ordinance, Site Plan and Architectural Review Committee Design Guidelines, and the
19 Municipal Code shall apply.
