Resolution Conditionally Approving the Final Map for the Phase I Riverfront
Subdivision Project Located at 500 Hopper Street, APN: 136-010-027.
RECOMMENDATION
It is recommended that the City Council adopt the attached Resolution Conditionally Approving
the Final Map for the Phase I Riverfront Subdivision Project Located at 500 Hopper Street, APN:
136-010-027.
BACKGROUND
The Phase I final map for Riverfront Subdivision is a nine -lot subdivision that also contains two
additional parcels, the central green and a Class I bike/pedestrian path to be dedicated to the City
of Petaluma. The project site is located at 500 Hopper Street. The subdivision received tentative
map approval by the City Council on July 21, 2014. The Phase I final map and improvement
plan applications were submitted in January 2016 and have been reviewed and determined by
City staff to meet all the requirements necessary for the City Council to approve the Phase I final
map except for submission of the required security guaranteeing construction of the public
improvements.
DISCUSSION
Basin Street Properties is requesting approval of the Phase I final map. Phase I includes
construction of public improvements for Hopper Street, Caulfield Lane Extension and the
Central Green loop area within the mixed use portion of the Riverfront project. Off-site
improvements on Caulfield Lane, Lakeville Street as well as the new two way Hopper Street
connection to D Street will also be constructed as part of Phase I. Additional final map phases
will be submitted to the City as early as summer of 2016, beginning with the single family homes
portion of the project. The Phase I final map and subdivision improvement plans have been
designed to comply with all conditions of approval set forth in the tentative map approval
resolution, other project related legislation, and all pertinent City standards. The developer has
met all but one of the requirements of the City to obtain City Council approval for the Phase I
final map. As of the date of delivery of the supplemental June 20 agenda packet, the Subdivision
Improvement Agreement covering the public improvements required for this subdivision has
been provided signed by the developer, but security guaranteeing completion of the
improvements has not. Staff understands the developer expects to provide the required
subdivision improvement security sometime the week of June 20, 2016, but likely not prior the
Council action on the final map. Sections 20.24.360 and 20.24.370 of the Subdivisions title of
the City's Municipal Code and section 66462 of the Subdivision Map Act require that the City
Council receive an executed subdivision improvement agreement and required security
guaranteeing the improvements prior to final map approval. Accordingly, staff has
recommended that the Council conditionally approve the final map at this time, subject to the
developer providing the required security. Once the required security is provided approval of the
final map will take effect.
The developer is responsible for constructing the public improvements required as part of the
subdivision and, once completed and found in compliance with City standards, the improvements
will be dedicated to and accepted by the City.
FINANCIAL IMPACTS
The final map and improvement plan applications for the Phase I Riverfront Subdivision are
subject to cost recovery. Costs for staff time spent reviewing the final map and improvement
plans are 100% recovered through application deposits submitted by the developer. Therefore,
this action does not have a fiscal impact to the City budget. City impact fees will be collected at
time of building permit and occupancy issuance which are estimated to be $8,876,337.50. Water
and wastewater capacity fees will be determined once tenants have been identified.

RESOLUTION CONDITIONALLY APPROVING THE FINAL MAP FOR THE PHASE
I RIVERFRONT SUBDIVISION PROJECT LOCATED AT 500 HOPPER STREET,
APN: 136-010-027
WHEREAS, the Planning Manager and the City Engineer have reviewed the Phase I
final map of the Riverfront Subdivision and have reported it to be in conformity with the
Subdivision Ordinance, and such reports have been forwarded to and reviewed by the Council;
and,
WHEREAS, the certifications required by law have been endorsed on said map; and,
WHEREAS, the Subdivision Improvement Agreement covering the public
improvements required for the Riverfront Subdivision has been provided signed by the
developer, but security guaranteeing completion of the improvements has not yet been provided;
and
WHEREAS, the subdivision developer expects to provide the required subdivision
improvement security sometime the week of June 20, 2016, but likely not prior the scheduled
Council action on the final map; and
WHEREAS, where a subdivider has not completed required public improvements prior
to submission of the final map application, Sections 20.24.360 and 20.24.370 of the Subdivisions
title of the Petaluma Municipal Code and section 66462 of the Subdivision Map Act require
execution of a subdivision improvement agreement and submission of required security
guaranteeing the improvements prior to final map approval; and
WHEREAS, the City Council finds that the final map for the Riverfront Subdivision
otherwise conforms to the requirements of this City's Subdivision Ordinance and is consistent
with, and conforms to the general plan for the area; and,
WHEREAS, the City Council finds the Phase I final map is in substantial compliance
with the tentative map previously approved for the subdivision by Resolution No. 2014-127
N.C.S., the findings of which are hereby incorporated by this reference as if fully set forth
herein.

NOW, THEREFORE, BE IT RESOLVED:
1. That said Phase I final map of the Riverfront Subdivision is hereby approved, provided
that the conditions, which have been previously set forth in said Resolution No. 2014-127
N.C.S., incorporated herein by reference, shall be carried out; and,
2. Approval of the Phase I final map of the Riverfront Subdivision is further conditioned
upon execution of the Subdivision Public Improvements Agreement in the form approved
by the City Attorney, and the furnishing of the required improvement security and
insurance, approved as to form by the City Attorney and as to sufficiency by the City
Manager; and
3. Provided further that upon the execution and approval of the Subdivision Public
Improvements Agreement and required improvement security and insurance, the City
Clerk is hereby authorized and directed to sign the certificate on said Phase I final map
certifying that the City Council has approved the same and accepted all streets and other
dedications thereon. The City Clerk shall thereupon cause said Phase I final map to be
recorded in the Office of the Sonoma County Recorder.
