RECOMMENDATION
It is recommended that the City Council hold a public hearing and adopt the attached Resolution
Approving Special Assessment Liens in the Amount of $90,315.78 Against the Properties
Located at 924 Alderwood Court, 13 Arlington Drive, 1020 Aspen Way, 1520 Baywood Drive,
1017 Carob Court, 897 Crinella Drive, 1601 Culpepper Drive, 1059 Daniel Drive, 1520 East
Madison Street, 1601 East Madison Street, 301 G Street, 2072 Harrison Street, 16 Locust Court,
1050 Maria Drive, 116 Payran Street, 1208 St. Joseph Way, 1432 Sunrise Parkway, 15 Wallace
Court, 1645 Weaverly Drive, 420 Western Avenue, Within the City of Petaluma for Costs and
Penalties for Violations of the Petaluma Municipal Code That Remain Unpaid by the
Responsible Parties and Authorizing the Recordation of a Lien and Placement of an Assessment
on the Property Tax Roll for Collection.
BACKGROUND
On December 6, 2010, the City Council amended Chapters 1.10 through 1.16 of the Petaluma
Municipal Code. The amendments provided more tools for enforcement of public nuisances and
property maintenance regulations within the City. Municipal Code Sections 1. 14.060 and
1. 14,140 allow the City to recover all past -due costs and penalties as a result of enforcement
action by imposition of a special assessment on real property.
DISCUSSION
The attached Notices of Intent to Impose Special Assessments, Notices of Hearing and Cost
Reports describe the unpaid debts as they relate to the properties listed above, and on the
attached Property Tax Levy Form Detailing Unpaid Debts. These debts are a result of
administrative actions taken by staff dating back to 2008. Staff has attempted to recover these
debts using in -house resources (accounts receivable through the Finance Department) and the
City's collections contractor, Collections Bureau of America. These efforts have largely been
unsuccessful.
With regard to notice to the property owners, they were issued an Administrative Citation or
Notice of Violation. As well, the Administrative Citation or Notice of Violation is sent to the
Finance Department where additional invoices are sent to the property owner by accounts
receivable. In some cases, the property owners have requested a hearing in front of appointed
hearing officers, where additional penalties and cost recovery fees were awarded to the City. All
administrative citations and administrative orders issued to the property owners following their
hearing have included information on their right to appeal within 15 days and the process for
doing the same. The listed property owners have not exercised their right to appeal and the time
for appeal has expired. The property owners recently received two additional notices from the
City of Petaluma regarding their unpaid debts. The first notice demanded payment within 10
days (Attachment 2a), advising the property owners that the City of Petaluma may seek to
impose a special assessment on their property for any unpaid debts. The second notice advised
the property owners of this hearing and possible action by the City Council. These notices were
prepared in accordance with Petaluma Municipal Code section 1. 14,130 and are attached for
Council review. Also attached is a report detailing the outstanding debts. In this report, you
will see that the City has already received full payment for six of the twenty -seven outstanding
debts since creating this staff report and related materials. Therefore, staff has removed the
materials relating to the properties where the debt has been paid in full.
The total amount being sought for special assessment totals $90,315.78. Using the current
Sonoma County Tax Assessor's Roll, staff has verified that the listed property owners still own
the property where the violations occurred.
Staff contacted other jurisdictions in the state regarding their use of special assessments. The
response was universally positive. Locally, the City of Santa Rosa has been very successful in
collecting on special assessments. Most recently, a property that owed $175,000 had their
assessment satisfied by the bank paying the balance due. Additionally, the City currently uses
this same special assessment debt recovery process for weed abatement.
FINANCIAL IMPACTS
As noted above, there is a potential for recovering up to $90,315.78 of unpaid debts owed to the
City of Petaluma. All debts are recovered through the collection of special assessments against the
specific parcels by the County Assessor in connection with property tax payments. Any money
collected will go into the General Fund. The fee charged by the County of Sonoma to enroll the
direct charge to the tax roll is 0.85% of the levy. There is also an administrative fee of less than
$100.

WHEREAS, Petaluma Municipal Code section 1.14.060(B) states that if the amount of
any penalty imposed for a violation relating to an affected property has not been satisfied in full
within sixty days of the date due and has not been successfully challenged by appeal or in court,
the penalty amount may become a special assessment or lien against the affected property, as
provided in Section 1.14.140; and
WHEREAS, Petaluma Municipal Code section 1.14.060(B) states that if the City elects
to make any penalty a special assessment or lien against the affected property, a statement of the
amount due, and any additional costs or expenses that might be recoverable as part of the
enforcement action, shall be prepared and submitted to the City Council for confirmation in
accordance with the procedures described in Section 1.14.130; and
WHEREAS, Petaluma Municipal Code section 1.14,130(A) states in relevant part that if
any order authorizes the City to abate a nuisance condition or other code violations, the City
official responsible for such abatement shall keep an accounting of the cost of abatement along
with any other recoverable costs, and shall render a written report ( "the cost report ") to the city
council showing the cost of removing and /or abating the nuisance condition and describing the
work performed and the cost report shall be agendized as a public hearing item by the City clerk
at a subsequent City council meeting following the required notice periods; and
WHEREAS, Petaluma Municipal Code section 1.14.130(B) requires that at least ten days
prior to the submission of the cost report to the City Council, the City Clerk's office or their
designee shall cause a copy of the cost report to be mailed to the responsible party and /or to the
owner of the property where the nuisance condition existed and if the nuisance concerns real
property, a copy of the cost report shall be mailed to the owner(s) at the address shown for such
owner(s) on the last tax roll; and
WHEREAS, Petaluma Municipal Code section 1.14.130(13) requires the City Clerk's office
or their designee to also cause a notice of hearing to be mailed to the same person(s) or entity
receiving a copy of the cost report and the notice of hearing shall set forth the date, time and
location of the City Council meeting at which the cost report shall be submitted to the City
Council; and

WHEREAS, Petaluma Municipal Code Section 1.14.140(D) states in relevant part, that any
penalty imposed for violations of this code, including any other codes or statutes that have been
incorporated into this code, and any costs of enforcement or administration or expenses
associated with the abatement of any nuisance levied in accordance with Chapters 1.10 through
1. 16, whether imposed or levied judicially or administratively, may become a special assessment
against the real property where the nuisance condition(s) existed and the special assessment
imposed on real property pursuant to this section may be collected at the same time and in the
same manner as ordinary municipal taxes are collected, and shall be subject to the same penalties
and the same procedure and sale in case of delinquency as are provided for ordinary municipal
taxes; and
WHEREAS, in accordance with Petaluma Municipal Code section 1.14.130, on July 18,
2016, the Police Chief provided to the City Council of Petaluma an itemized report detailing the
unpaid debts from 27 properties located in Petaluma, as a result of administrative enforcement
dating back to 2008, all as shown and set forth on the attached Cost Report and Property Tax
Levy Form Detailing Unpaid Debts; and
WHEREAS, in accordance with Petaluma Municipal Code sections 1.14 and 1. 16, the
property owners have not exercised their rights to appeal the original fines and penalties
imposed; and
WHEREAS, in accordance with Petaluma Municipal Code section 1.14.130(B), a cost report
and notice of hearing for special assessment was mailed, via U.S. Mail and certified mail, return
receipt requested, to the identified property owners. at the addresses listed on the most recent Tax
Assessor's Role, advising the property owners of the City of Petaluma's intent to impose a
special assessment for all outstanding debts that remained after 10 days of said notice; and
WHEREAS, at the time and place referred to in said notice, the City Council heard the
Police Chief's Cost Report, together with any objections raised by the property owners, and the
City Council made its recommendations and any modifications it deemed necessary to be
included in the final report;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Petaluma as
follows:
1. The Police Chief's Cost Reports ( "the Report"), and each amount and part thereof, is
hereby confirmed, and as to the delinquent parcels listed therein, the amount shown for such
parcel constitutes a special assessment against the property.
2. In accordance with Petaluma Municipal Code section 1.14.130(D), a copy of this Council
order confirming costs against the responsible party shall be served on the responsible party
within ten days of such order in the manner described in Section 1.14.020(B), which states
that it shall be served upon the responsible party or owner personally or by United States
mail, first -class postage prepaid, and if by such mail, it shall be sent to the last known address
listed on the most recent tax assessor's records; when service is by first -class mail, a copy of
the Council order shall be conspicuously posted at the affected property when reasonably

practicable for a period of not less than three calendar days prior to the first date of
commencement of the action.
3. In accordance with Petaluma Municipal Code section 1.14.020(C), proof of service of the
Council order confirming costs shall be certified by a written declaration under penalty of
perjury executed by the person effecting service, declaring the date, time and manner of
service, and the date and place of posing, if applicable and the declaration shall be affixed to
a copy of the Council order and retained by the enforcement officer.
4. In accordance with Petaluma Municipal Code section 1.14.140(D), a notice of any special
assessment that is levied on real property shall be given to the owner by certified mail, and
shall contain the information set forth in Government Code Section 38773.5(c); and
5. A copy of this Order shall be received by the County Auditor - Controller Treasurer Tax
Collector's Office for placement of the special assessment on the real property prior to
August 10, 2016 for placement on the 2016 property tax roll, which shall be collected at the
same time and in the same manner as ordinary municipal taxes are collected.

impose a.special assessment on your property, pursuant to Section 1. 14.140 of City of
Petaluma Municipal Code,
Pursuant to Gove'rmnent Code Section 38773.5(c )., the City of Petaluma is hereby
notifying you that the property may be sold after three years by the tax collector for
unpaid delinquent assessments. The tax collector's power of sale shall not be affected by
the failure of the property owner to receive notice. The assessment nay be collected at
the same time and in the same manner as ordinary municipal taxes are collected, and shall
be subject to the same penalties and the same procedure and sale in case of delinquency
as provided for ordinary municipal taxes. All laws applicable to the levy, collection and
enforcement of municipal taxes shall be applicable to the special assessment. However, if
any real property to which the cost of abatement relates has been transferred or conveyed
to a bona fide purchaser for value, or if a lien of a bona fide encumbrancer for value has
been created and attaches thereon, prior to the date on which the first installment of the
taxes would become delinquent, then the cost of abatement shall not result in a lien
against the real property but instead shall be transferred to the unsecured roll for
collection.

impose a special assessment on your property, pursuant to Section 1.14.140 of City of
Petaluma Municipal Code.
Pursuant to Government Code Section 38773.5(c), the City of Petaluma is hereby

DECISION AND ABATEMENT ORDER OF ADMINISTRATIVE HEARING OFFICER
REGARDING NOTICE OF VIOLATION ISSUED FOR THE ABATEMENT OF VIOLATION
OF PETALUMA MUNICIPAL CODE TITLE 21, IMPLEMENTING .ZONING ORDINANCE,
SECTION 13.060.A, ON REAL PROPERTY LOCATED AT 1020 ASPEN WAY,
PETALUMA, CALIFORNIA 94954; ASSESSOR'S PARCEL NO,: 005 - 152 -013
A public hearing was held on October 21, 2015, before Ian McLaughlin, an Administrative
Hearing Officer appointed by the City of Petaluma ( "the City') regarding a Notice of Violation
( "NOV ") issued on September 9, 2015, to the Estate of Tami L Ireland regarding real property
located at 1020 Aspen Way, Petaluma, California, 94954, Assessor's Parcel No. 005- 152 -013
( "the property. ")
Present at the hearing was City of Petaluma Neighborhood Preservation Coordinator Joe Garcia
( "Officer Garcia"). No other persons were present, and there was no appearance on behalf of the
owner or occupants of the property, Officer Garcia was sworn in by the City Clerk.
HAVING CONSIDERED all the evidence presented, both oral and documentary, the
Administrative hearing Officer makes the following Findings of Fact and Conclusions of
Law:
FINDINGS OF FACT
1. The Estate of Tam! L Ireland is the owner of record for the property based on the Sonoma County
Tax Assessor's records as of the date of the hearing, and also on the date the NOV was issued.
2. Officer Garcia submitted evidence in the form of a Hearing on Administrative Order -- Staff
Report, which document was received into evidence as Exhibit A. Exhibit A contains numerous
documents regarding the history of interactions between Officer Garcia and the property, including
two prior Corrections Notices and three Administrative Citations, all issued in 2014. Exhibit A also
contains the NOV, the Notice of Hearing on NOV, and several photographs of the property.
3. At the hearing, Officer Garcia submitted additional evidence: photographs of the property taken
on October 21, 2015 (received into evidence as Exhibit B); a worksheet containing a breakdown of
administrative costs and penalties sought (received into evidence as Exhibit C); and a list of permits
that had been issued by the City of Petaluma for the property, showing that a total of three permits
have been issued by the City for the property, and no fence permit has been issued (received into
evidence as Exhibit D.)
4. Officer Garcia sent an NOV to the property owner on September 9, 2015, via first -class mail and
certified mail addressed to the property. The copy sent via certified mail was returned as unclaimed

on October 20, 2015. Officer Garcia also posted a copy of the NOV on the property on September 9,
2015. (Exhibit A, P20 - P32.)
5. Officer Garcia sent a Notice of Hearing on Administrative Order to the property owner on October
1, 2015, addressed to the property. Officer Garcia also posted a copy of the Notice, of Hearing on
Administrative Order on the property on October 1, 2015. (Exhibit A, P33 - P41)
6. Officer Garcia testified that he does not know if the property is currently occupied and has not
attempted to make personal contact with anyone who may be currently residing on the property.
CONCLUSIONS OF LAW
1, The Petaluma Municipal Code ( "PMC ") provides for two types of hearings with regard to an
NOV, an Order to Show Cause hearing (PMC section 1. 14.030) and an Appeal Hearing (PMC
1.14.070). The NOV provides notice that the City may schedule a hearing, although it does not
refer to the hearing as an Order to Show Cause hearing. No appeal was taken here, so the
Administrative Hearing Officer considers this hearing to be an Order to Show Cause hearing,
which is governed by the procedures set forth in PMC sections 1. 14,090 and 1.14.100.
2. Petaluma Municipal Code subsection 1.14.090.B.2 provides in part: "Evidence presented by
the enforcement officer or other official of the city tending to show that a violation occurred and
that the person named on the NOV is the responsible party shall establish a prima facie case that a
violation, as charged, actually existed and that the person named in the NOV is the responsible
party for the violation. The burden of proof shall then be on the responsible party to refute such
evidence."
3. Based on the evidence presented, both testimonial and documentary, the City has met its
burden that there exists a fence on the property within the front setback that was installed without
a valid permit issued by the City, in violation of PMC Title 21, Implementing Zoning Ordinance,
subsection 13.060.A. This is the only violation listed in the NOV. The violation existed at least
from the compliance date established in the NOV (September 27, 2015) through the date of the
hearing.
4. A violation of PMC Title 21, Implementing Zoning Ordinance, subsection 13.060,A on the
property constitutes a "nuisance condition" as defined in PMC section 1.10.020.
5. The property owner listed on the most recent Sonoma County Tax Assessor's role is the
responsible party with regard to this violation. PMC chapter 1.14 does not define "responsible
party" but provides that the NOV shall be served on the "responsible party or owner" and "shall
be sent to the last known address listed on the most recent tax assessor's records." (PMC
subsection 1.14.020.13)

PMC section 1.10.020 defines "responsible party" in pertinent part as: "'Responsible party' shall
mean any person ... whose acts or omissions have caused or contributed to a violation of this
code, and shall include any owner(s) or occupant(s) of the affected property." Here the violation
listed in the NOV is failure to obtain a permit for installation of a fence on real property, which is
ultimately the responsibility of the owner of the property, and therefore the property owner as
identified on the tax assessor's role is properly identified as the responsible party larder the PMC.
6. Based on the evidence presented, both testimonial and documentary, both the NOV and the
Notice of Hearing comply substantially with the requirements of the Petaluma Municipal Code
with regard to providing notice to the property owner of the existence of the violation, and that a
hearing had been scheduled.
The NOV, including Attachment A, contains the information required by PMC subsection
1.14.020.A regarding the violation. Attachment A to the NOV, which contains the specification
of violations, required corrections, and required compliance dates, contains an incorrect address
by listing 1922 Matzen Circle Ranch rather than the address of the property. In all other respects
the information contained in the NOV is correct and accurate.
Given the totality of the circumstances, the NOV substantially complies with the requirements of
the PMC despite the clerical error in Exhibit A. The front page of the NOV correctly identifies
the property owner and property address, The Notice of Hearing does not contain any similar
errors and is accurate, Both documents were served by first -class mail and were also posted
conspicuously on the property, PMC subsection 1.14.020.B provides that service of notice may
be accomplished via first -class mail and shall be deemed complete at the time of deposit in the
mail, and further provides that "[t]he failure to receive an NOV sent via first -class mail shall not
affect the validity of any enforcement proceedings under Chapter 1.10 through 1.16."
Although the NOV was also served via a third method, certified mail, and the certified mail was
returned to Officer Garcia as unclaimed, this additional method of service is not required by the
PMC and does not affect the validity of the service of the NOV and Notice of Hearing by first -
class mail and posting.
While it is not clear whether the property owner (the estate of a deceased person) actually
received notice in this case, the Hearing Office finds that the requirements of the PMC regarding
service have been satisfied.
ABAT1E11'NT COSTS
1. PMC section 1.14.120 provides that "[t]he city may elect to recover its costs to abate
nuisance conditions or other code violations ", and provides a non- exhaustive list of what may be
considered an abatement cost. In this case both the NOV and the Notice of Hearing provide .
notice that the City may recover the costs of abatement. At the hearing Officer Garcia entered
into evidence a worksheet showing the costs of staff time to date with regard to the NOV and the
hearing (Exhibit C.)

PMC subsection 1.14.100.D.3 provides that an abatement order may require the responsible party
to correct or eliminate any violation, and is silent on recovery of administrative costs. Subsection
1.14.100,D.7 provides that "[t]he abatement order shall specify that if the city undertakes to abate
or elmunate any nuisance condition as provided in Section 1.11.030, the city shall be entitled to
recover all costs of abatement incurred in performing such work and other costs necessary to
enforce the order." Subsection 1.14.100.D.9 authorizes an abatement order to include "[a]ny
other order or remedy that serves the interests of justice."
2. An award of administrative abatement costs related to the NOV and hearing is warranted
here, where the City has attempted to gain compliance for a lengthy period of tune and the
issuance of the NOV and the hearing were necessary because the responsible party did not
respond to any of the prior correction notices or administrative citations.
The responsible party shall pay the City's costs of abatement through the date of the hearing,
which shall include;
a. Costs to prepare for the hearing on the. NOV issued September 9, 2015, in the amount of
$625.44, as set forth in the workshect entered into evidence as Exhibit C the hearing,
which is attached hereto as Appendix A, Additional costs for appearance at the 30-
minute hearing by the Neighborhood Preservation Coordinator ($103,24 x.5 = $51,62)
and City Cleric ($109.31 x,5 = $54.66) for a cumulative total of city staff costs of
$731.72.
b. Costs for the Administrative Hearing Officer to prepare for and conduct the hearing, and
issue a decision, in the amount of $1,350.00.
The responsible party shall pay the City's costs of abatement in the amount of $2,081.72. This
amount shall be remitted to the City within ninety (90) days of the date of this DECISION AND
ABATEMENT ORDER unless an alternative payment schedule is established. If not timely
remitted to the City, the City may collect these abatement costs via any method authorized by the
Petaluma Municipal Code.
If the City takes additional action to abate the nuisance condition on the property, the City shall
be entitled to recover its additional costs of abatement through the procedures set forth in PMC
chapter 1.14.
CIVIL PENALTIES
1. PMC subsection 1.14.100.1).1 provides that an abatement order may impose or uphold a penalty.
PMC Section 1.14.050 provides that a monetary penalty may be imposed for any nuisance condition
or any violation of any provision of the PMC, and subsection 1.14.050.A provides a list of factors to
be considered in determining the amount of a penalty. Subsection 1.14.050.B provides that "[e]ach
and every day during which any portion of a nuisance condition exists or continues may be deemed a

separate and distinct violation for purposes of setting the amount of penalty to be imposed. Any
penalty imposed will accrue on a daily basis from the date the penalty becomes effective until the
violation is corrected."
2, In this case both the NOV and the Notice of Hearing indicate that failure to correct the violation
may subject the responsible party to a penalty of up to $ 1,000 per day, though the NOV does not
actually include a specific penalty amount. The City seeks a penalty of $100 per day for 24 days,
from the compliance date set in the NOV (September 27, 2015) through the date of the hearing
(October 21, 2015), for a total amount of $2,400 in penalties.
3. Based on the factors listed in PMC section 1.14.050.A, a penalty is warranted in this case,
primarily based on the duration of the violation (PMC 1.14.050.A.1) and the lack of any good faith
effort by the responsible party or any representative of the responsible party to come into compliance
(PMC 1.14.050.A.6.) In this case there has never been any response to the NOV or Notice of
Hearing (nor to any previous corrections notices or administrative citations).
Mitigating against the penalty amount requested by the City is the seriousness of the violation (PMC
1.14.050,A.3); the fact that the City voluntarily suspended enforcement operations for a substantial
period of time underscores that this violation does not pose an immediate or significant threat to the
public health, safety, or welfare.
4. The Estate of Tami L Ireland shall pay the City $100.00 per day in administrative penalties for
violation of PMC Title 21, Implementing Zoning Ordinance, section 13.060.A as specified in the
NOV, from the compliance date listed in the NOV (September 27, 2015) through the date of the
hearing (October 21, 2015), for a total penalty of $2,400.00, This amount shall be remitted to the
City within ninety (90) days of the date of this DECISION AND ABATEMENT ORDER unless an
alternative payment schedule is established. if not timely remitted to the City, the City may collect
the penalty via any method authorized by the Petaluma Municipal Code.
If the responsible party fails to correct the violation on or before November 30, 2015, then an
additional penalty of $100.00 per day shall be unposed and shall continue to accrue from the date
of the hearing until the violation is corrected by the responsible party or abated by the City;
provided that any additional penalty imposed shall cease to accrue on December 31, 2015, if the
City has not undertaken any action to abate the nuisance condition by that date.
ORDER
BASED UPON THE FOREGOING FINDINGS OF FACT AND CONCLUSIONS OF
LAW, IT IS HERESY ADJUDGED AND DECREEID THAT:
1. The NOV issued by the City to the property owner on September 9, 2015, is sustained.
2. The fence located in the front setback on the property was installed without a permit in
violation of PMC Title 21, Implementing Zoning Ordinance, subsection 13.060.A, and

constitutes a nuisance condition that has existed from at least the compliance date established in
the NOV through the hearing date of October 21, 2015.
3. The Estate of Tami L Ireland shall correct or eliminate the violation by either applying for a
permit or removing the nonconforming fence, no later than November 30, 2015,
4. If the Estate of Tami L Ireland fails to correct or eliminate the violation within the specified
time, the City is authorized to abate or cause the abatement of the violation pursuant to the
procedures for abatement set forth in the Petaluma Municipal Code, If the City abates or causes
the abatement of the violation, the City may recover its additional costs of abatement pursuant to
the procedures set forth in the Petaluma Municipal Code.
5. The Estate of Tami L Ireland is hereby ordered to pay the City the sum of $2,081.72 for its
administrative abatement costs, This amount shall be remitted to the City within ninety (90)
days of the date of this DECISION AND ABATEMENT ORDER unless an alternative payment
schedule is established. If not timely remitted to the City, the City may collect these abatement
costs via any method authorized by the Petaluma Municipal Code.
6, The Estate of Tami L Ireland is hereby ordered to pay the City $2,400.00 in civil penalties,
which is $100.00 per day fiom the compliance date listed in the NOV (September 27, 2015)
through the date of the hearing (October 21, 2015), This amount shall be remitted to the City
within ninety (90) days of the date of this DECISION AND ABATEMENT ORDER unless an
alternative payment schedule is established. If not timely remitted to the City, the City may
collect the penalty via any method authorized by the Petaluma Municipal Code,
7. If the Estate of Tami L Ireland fails to correct the violation on or before November 30, 2015,
then an additional penalty of $100.00 per day shall be imposed and shall continue to accrue
from the date of the hearing until the violation is corrected by the property owner or abated by
the City; provided that any additional penalty imposed shall cease to accrue on December 31,
2015, if the City has not undertaken any action to abate the nuisance condition by that date. If
any additional penalty applies the City may collect the penalty via any method authorized by the
Petaluma Municipal Code.
8. The City shall cause a copy of this DECISION AND ABATEMENT ORDER to be
conspicuously posted on the property as soon as reasonably practicable, and in no event less than
three days prior to the first date that commencement of any corrective action or abatement is to
be undertaken, The City shall execute a declaration of service under penalty of perjury pursuant
to PMC subsection 1.14.100.B,
9. This decision is a final decision, subject to judicial review of this decision, which may be
sought by following the procedure outlined in Code of Civil Procedure Section 1094.5. Judicial
review must be sought not later than the ninetieth day following the date on which this decision
becomes final, except that where a shorter time is provided by any state or federal law, such
shorter time limit shall apply,

On December 5, 2012 an administrative hearing was held at Petaluma City Hall regarding a
NOTICE OF VIOLATON PURSUANT TO P.M,C, CHAPTER 1. 14, dated October 3, 2012
ordering property owner to discontinue and correct the following violations:
1. The property is overgrown with weeds and dead vegetation, The vegetation is also
blocking the sidewalk; Remove all weeds and dead vegetation from the property. Clear
all vegetation away from the sidewalk so that t5here is an 8 -foot clearance above the
sidewalk, PMC 1.10,075(D), PMC 1.10,075(E), PMC 1.10,075(H), PMC 13.04,020,
2, There is a green conversion van in the driveway that has expired registration and is
considered inoperative. Remove the vehicle from off-site view or obtain current
registration for the vehicle, PMC 1.10.075(G) (7).
The hearing was scheduled pursuant to NOTICE OF BEARTNG ON ADMINISTRATIVE
ORDER dated November 13, 2012 mailed to property owner and posted on the property.
Present at the hearing was Joe Garcia, Neighborhood Preservation Coordinator. The property
owner did not appear. Parties were sworn in by the Clerk,
EVIDENCE PPRESENTED AT THE HEARING
Joe Garcia submitted into evidence the 14EARING ON ADMINISTRATIVE ORDER STAFF
REPORT. It was received into evidence as Exhibit 1 without objection. Joe Garcia submitted
into evidence 5 photographs dated 12/05/2012 08 :00 through 08:01. The photographs were
received into evidence as Exhibits 2 --- 6 without objection.
Officer Garcia presented evidence of the violation of Municipal Codes, PMC 1.10,075(D), PMC
1,10.075(E), PMC 1.10.075(Id), PMC 13,04.020 and PMC 1.10.075(G) (7). The evidence
consisted of photographs (contained in Exhibits 1 -6) and testimony thereon. There was no
evidence presented on behalf of the property owner.
RELEVANT MUNICIPAL CODE PROVISIONS
Petaluma Municipal Code section 1.10,075. Attached hereto as Exhibit A.

Petaluma Municipal Code section 1,16.070.E provides that, "The administrative citation and any
report submitted by the code enforcement officer to the administrative hearing officer shall
constitute prima facie evidence of the respective facts contained in those documents.",
ANAL'YSIS/REASONS FOR DrCISION
The prima facie evidence is sufficient to find the existence of the conditions constituting the
violations specified in the Notice of Violation. Violations of PMC 1.10.075(D), PMC
1.10,075(E), PMC 1.10.075(H), PMC 13.04,020 and PMC 1. 10.075(0) (7) continue to exist on
the subject property.
DISPOSITION
1. Violations of PMC 1.10.075(D), PMC 1.10.075(E), PMC 1,10.075(H), PMC 13.04,020
and PMC 1.10.075(G) (7) continue to exist on the subject property.
2, Violations of PMC 1.10.075(D), PMC 1.10.075(E), PMC 1,10.075(H), PMC 13.04.020
and PMC 1.10.075(G) (7) continue to exist on the subject property from the date of the
Notice of Violation through the date of the Administrative Hearing.
3. Property Owner is ordered to abate the said violations within 15 days of the date of this
decision.
4. Property Owner is ordered to pay the City of Petaluma its administrative costs in the sutn
of $1,687.90 and administrative penalties in the amount of $24,000,00. Payment shall be
due on or before 90 days from the date of this decision. Payment is to be made to the
City of Petaluma, Administrative Services Department- Citations, 11 English Street,
Petaluma, CA 94952,
5. In the event that the Property Owner fails to abate the violations within 15 days of the
date of this decision. Administrative penalties shall accrue at the rate of $100.00 per day
per violation until abated.
6, The City Clerk is authorized to record a lien on the subject property at the Sonoma
County Recorder's Office for any administrative costs or penalties not tendered to the
City of Petaluma in the timeframes set forth herein.
7. In the event that the Property Owner fails to abate the violations herein by the compliance
dates set fortis herein, the City of Petaluma is authorized to abate or cause the abatement
of the said violations. In the event that the City of Petaluma undertakes to abate or cause
the abetment of the violations as provided in PMC 1.11.030, the City of Petaluma shall be
entitled to recover it costs associated therein. Such costs may be recovered by the City as
a personal obligation and /or through a lien or a special assessment on the subject property
as provided in PMC 1.14.140.
8. Any person aggrieved by the decision of an administrative heating officer on an

APPEAL OF AN ADMINISTRATIVE CI'T'ATION ON THE REAL PROPERTY LOCATED AT
1645 WEAVERLY DRIVE, PETALUMA, CALIFORNIA, APN: 007553 -011
On July 15, 2015, a duly noticed Public Hearing was held before Ira Leslie Lowenthal, a Hearing
Officer appointed by the City Council, City of Petaluma, to consider the appeal of an
Administrative Citation issued on certain real property located within the City of Petaluma
generally referred to as 1645 Weaverly Drive, Petaluma, CA 94954 and more particularly
described as Assessor's Parcel No. 007 - 553 -011 (subject property ").
At the hearing, all interested parties were given an opportunity to be heard. Testimony was given
by under oath by City of Petaluma staff, ,Toe Garcia, Neighborhood Preservation Coordinator
(Notice of Violation Issuing Officer), Deputy City Attorney Jordan Green and property owners
Kim Richardson and Arty Richardson, Public comment was received,
ISSUES - Notice of Violation pursuant to Petaluma Municipal Code (PMC)
ISSUE #1:
No active water service at the subject property in violation of PMC 1.10.085 L, 1 d.
ISSUE #2:
No active electrical or gas service at the subject property in violation of PMC 1.10.085 L, 1 i and o.

Accumulation of junk, trash, garbage, debris, and mattresses on the subject property visible from
off-site view and is creating an insect and rodent infestation in violation of PMC 1.10.075 G. 1, 3
and 9.

PMC Section 1.16.030 allows administrative penalties up to $1,000.00 a day, per violation and
administrative costs pursuant to PMC 1,14.050. The City requests $49,000.00 for "Exterior
Violations" for 49 days as of July 14, 2015, The City requests $47,000.00 for "Structure not
secured to prevent unauthorized entry" for 47 days as of July 12, 2015 (date of compliance).
It is noted by the Hearing Officer that the hearting is based on the violations contained in the
NATIVE OF VIOLATION PURSUANT TO P.M.C, CHAPETER 1.14; 1645 Weaverly Dive
(A,P,N, 007 - 533011). The issue of "Structure not secured to prevent unauthorized entry" was
not contained in said Notice and is therefore not a proper subject for this hearing,
ADMINISTRATIVE COSTS
The City of Petaluma requests administrative costs in the sum of $3,470.78 as set forth in Exhibit
4 received into evidence, Additional costs as the result of this hearing are hearing officer fees in
the surer of $1,460.00, Total administrative costs are $4,930.78.
REASONS FOR DECISION
The City acknowledges the abatement of Issues #1 and 42 above.
As set forth in Civil Penalties above, the City's request for penalties in the sum of $47,000,00 for
"Structure not secured to prevent unauthorized entry" is denied without prejudice as an improper
subject of this hearing.
The City has proved by a preponderance of the evidence that that the violation of PMC 1, 10,075 G,
I and 3 is a third violation.
The property owners admit the violation of PMC 1.10.075 G. 1 and 3 exists. The property owners
state that the basis for their appeal is the inability to pay the penalties and costs requested by the

HAVING CONSIDERED ALL OF THE EVIDENCE PRESENTED, THE NEARING
OFFICER MAKES THE FOLLOWING FINDINGS OF FACT AND CONCLUSION OF
LAW:
1. The violation of PMC 1,10.085 L. 1 d, has been abated.
2. The violation of PMC 1.10,085 L. 1 i and o, has been abated.
3, The City's request for penalties in the sum of $47,000,00 for "Structure not secured to prevent
unauthorized entry" is an improper subject of this hearing.
4. There exists an accumulation of junk, trash, garbage, debris, and mattresses on the subject
property visible from off -site view and is creating an insect and rodent infestation in violation of
PMC 1,10, 075 G, 1 and 3.
5, The Property Owners have been provided sufficient notice and time for abatement of the
accumulation of junk, trash, and debris throughout the property.
b, The City is authorized to issue penalties up to $1,000 per day, per violation, and has
through the issuance of numerous previous administrative citations.
BASED UPON THE FOREGOING FINDINGS OF FACT AND CONCLUSIONS OF
LAW, IT IS HEREBY ADJUDGED AND DECREED THAT:
1. A violation of PMC 1. 10,075 G 1 and 3 as specified in the Notice of Violation has
existed and continues to exist on the subject property from the date of the Notice of Violation
through July 14, 2015,
2, The Petaluma Municipal Code and the City's adopted Schedule of Penalties allow for
penalties up to $1,000 per clay, per code violation,
3a, Arty Richardson and Kim Richardson are ordered to pay the City of Petaluma $1,000 per
day, per code violation, in administrative penalties for the violation of PMC 1. 10,075 G. 1 and 3
specified in the Notice of Violation that have existed on the property from the compliance date of
May 25, 2015, through July 14, 2015 in the total sum of $49,000,00 within 90 days from the date of
the Hearing Officer's decision, Payment is to be made to the City of Petaluma, Administrative
Services Department- Citations, 11 English Street, Petaluma, CA 94952,
b. Notwithstanding 3a, above, in the event that all violations of PMC 1,10,075 G 1 and 3 are
abated within said 90 days, the sum of $7,500.00 only, shall be paid within 90 days from the date
of the Hearing Officer's decision, Payment is to be made to the City of Petaluma, Administrative

8, The City of Petaluma is authorized to abate or cause the abatement of a nuisance condition if the
property ovaiers fail to abate the violations within the time frames set forth above, If the City
undertakes to abate or eliminate any nuisance condition as provided in PMC Section 1.11.030, the
City shall be entitled to recover all costs of abatement incurred in performing such work and other
costs necessary to enforce the order. Such costs may be recovered by the City as a personal
obligation and /or through a lien or a special assessment on the affected property as

A duly noticed Public Hearing was held on September 2, 2015, before Vanessa Aching
Davenport, an Administrative Hearing Officer appointed by the City Council, City of Petaluma,
to consider the appeal of an administrative citation as to that certain real property located at 1645
Weaverly Drive Petaluma, California 94954, and more particularly described as Assessor's
Parcel No.: 007- 553.011 (the property "), All interested parties were provided an opportunity to
be heard; All oral testimony was taken under oath, including that of property owners and Arty
Richardson and Kim Richardson and interested party Kyle Richardson, as well as Joe Garcia,
City of Petaluma, Neighborhood Preservation Coordinator who is the Issuing Officer and
designated Code Enforcement Official.
I. ISSUES TO BE DECIDED:
A. Background: A Notice of Violation (hereafter "NOV ") dated June 24, 2015 was issued for the
subject property for violations for interior substandard housing conditions. A prior NOV was issued
on May 19, 2015 for alleged substandard exterior conditions atthe property. Outstanding violations
with respect to conditions set forth in the May 19, 2015 NOV ( #I: lack of water service at the subject
property, #2" lacic of active electrical or gas service at the subject property and #3: accumulation of
junk, trash, garbage, debris, and mattresses on the subject property visible from off- -.site view and
creating an insect and rodent infestation) were the subject of a separate Administrative Citation
Appeal Hearing, which decision was tendered on July 15, 2015. Those issues areNOT the subject of
the present hearing.
B. June 24, 2015 NOV (Pages 49 and 50 of Staff Report, Exhibit 1)t The alleged violations noted
and cited by the City of Petaluma in the June 24, 2015 NOV were as follows:
1, Lack of functioning carbon monoxide detectors in the home in violation of H &S 17926(a).
2. Uusanitaiy conditions throughout the structure, including backed tip toilets, rotten garbage,
and insect infestations in violation of PMC 1.10.085(E)(6), PMC 1.10,085(L)(1)(k), PMC
1.10.085(L)(1)(1), PMC 1.10.085(S).
3. Missing electrical cover plates in the interior of the structure in violation of PMC
1.10.085(B)(7), PMC 1.10.085(2), PMC 1.10.085(N).
4. Lack of water service resulting in unflushed toilets full of urine and feces in violation of
PMC 1.10.085(B)(8), PMC 1.10.085(E)(3), PMC 1.10.085(E)(5), PMC 1, 10,085(L)(1)(a),

15, Improper materials used for waste drains under the vanity sinks in violation of PMC

21, The existence of non- approved electrical connections on the exterior of the structure in
violation of PMC 1.10,085(B)(7), PMC 1. 10,085(l), PMC 1.10.085(N).
The compliance date for the above mentioned violations was Sunday, July 26, 2015 with a
follow -up inspection being conducted on Monday, July 27, 2015.
II. APPLICABLE LAW:
A. As set forth with particularity above;
B, PMC 1,10.075 as to what constitutes a public nuisance substandard maintenance conditions; and
C, PMC 1, 14,020, PMC 1.14.050 as to due process and imposition of penalties,
III. EXIHBITS RECEIVED INTO EVIDENCE:
Exhibit 1: Without objection, a spiral -bound report entitled HEARING ON ADMINISTRATIVE
ORDER - STAFF REPORT containing twenty -three (23) separate documents consisting of 84 total
pages was xeceived into evidence as Exhibit 1.
Exhibit 2: Without objection, a two (2) page stapled document entitled 1645 Weaverly Drive
Administrative Costs and Penalties Worksheet was received into evidence as Exhibit 2.
Exhibit 3: Without objection, a five (5) page stapled document each of the first four pages
containing four color photographs per page, and the fifth page containing 3 photographs. The first
three pages of photographs are date - stamped "08/27/2015" while the last two pages ofphotographs
are date - stamped "09/01/2015" for a total of nineteen (19) photograph copies, was received into
evidence as Exhibit 3.
IV. CIVIL PENALTIES;
Pursuant to PMC Section 1.14.050, the City of Petaluma alleges it is entitled to issue penalties for
failure to comply with the June 24, 2015 Notice of Violation (hereafter, "NOV "),
Pursuant to PMC Section 1.14.100, the City ofPetaluma requests imposition of a penalty of $25 per
day, per violation since the compliance date of July 26, 2015, listed in the NOV is appropriate and
requested Civil Penalties in the amount of $925.00 through September 1, 2015 (37 days afterthe date
of compliance) for each of the four then outstanding violations (identified as #'s 3, 5, 7 and 19 listed
in the June 24, 2015 NOV) plus $800.00 ($25 X 32 days) for the lacy of fire protection in the garage
ceiling (access panel) until abatement on August 27, 2015 (identified as #11 in the June 24, 2015
NOV) and that such payment be made to the City within 90 days from the date of this decision.

The City of Petaluma also requests that the additional administrative penalties of $50.00 per
violation, per day, be imposed, from the date of this hearing for any code violations that have not
been corrected by the compliance date specified in this Administrative Hearing Decision,
V. ADMINISTRATIVE COSTS:
Pursuant to PMC Section 1.14.120, the city may recover its costs to abate nuisance conditions or
other code violations, including without limitation the costs of any appeals Bearing or OSC hearing
(including staff time necessary to prepare for and attend an appeals hearing or OSC hearing), any re-
inspections required to determine or confirm that compliance has been achieved, production of all
staff reports, environmental tests or measurements that are deemed necessary or appropriate by the
enforcement officer, third -patty inspection(s) or consultant services as deemed necessary by the city
and any attorneys' fees incurred in pursuing enforcement.
The City of Petaluma requests administrative costs in connection with this enforcement action in the
amount of $1,643.04 from the date of the NO`V through the Compliance date listed in the NOV,
of July 26, 2015. (Exhibits 2 and 3) In addition, the City requests further and additional costs
related to this hearing of this matter: the Administrative Hearing Officer fees in the amount of
$2,676.71 and the cost of Neighborhood Preservation Officer /Code Enforcement Officer, Joe
Garcia's attendance and testimony at the administrative hearing, inthe amount of $103.24 (1 hour at
$103.24 hourly rate) for a cumulative total of $4,422.99 (i.e. $1,643.04 plus $2,676.71 plus
$103.24)
Interested party Kyle Richardson and property owner Kim Richardson admitted that the conditions
and defects complained of by the City of Petaluma at the hearing existed and do in fact continue to
exist as of date of the hearing on September 2, 1015, except fox the violation as to the missing
electrical cover plates in the interior of the structure, (Item #3 of the conditions listed in the NOV)
which they claim was abated on the night of September 1, 2015.
The property owners also claim that the admitted code violations are minor violations, which are
merely decorative, not substandard and are minor maintenance issues, not of a nature amounting to
that of a public nuisance warranting imposition of penalties by the City. They also claim that the
conditions complained of were previously dealt with in the previous July 15, 2015 hearing and that
the City of Petaluma is engaged in harassment of the property owners who have lived at the property
since 1969, for their alleged association with known criminals.
VI. HAVING CONSIDERED all the evidence presented, both oral and documentary, the
Administrative Hearing Officer malms the following FINDINGS OF FACT AND
CONCLUSIONS OF LAW:
1. The City has proven by a preponderance of the evidence that various substandard housing
condition violations of a serial nature have occurred at the subjectproperty despite code enforcement
actions by the City of Petaluma as early as June of 2012, during the ownership of the present
property owners who have been residing at the property since 1969,

1 Arty Richardson et al and Kim Richardson the property owners and Responsible parties pursuant
to PMC 1. 10,020 were duly served at the address listed with the Tax Assessor's Office, with all
required notices pertaining to this administrative hearing, (Page 12 of Staff Report, Exhibit 1)
3, The City has proved by a preponderance of the evidence that as of the July 27'x`, 2015 re-
inspection date, the following violations were still outstanding at the property, past the July 26, 2015
compliance date outlined in the NOV:
(a) Item 95 listed in the NOV: An improperly maintained and improperly operating
furnace. PMC 1.10.085(B)(6), PMC 1.10.085(H), PMC 1.10.085(L)(1)(e), PMC
1.10.085(P).
(b) Item #7 listed in the NOV: Faucet (Bose bib) handles missing for the clothes washer
connection. PMC 1.10.085(B)(8), PMC 1.10,085(E)(3), PMC 1.10.085(L)(1)(d), PMC
1.10.085(0).
(c) Item #11 listed in the NOV: Existence of holes in the fire waII of the garage in
violation of PMC 1.10.085(x), PMC 1.10.085(Q), PMC 1.10.085(U).
(d) Item # 19 listed in the NOV: Missing or peeling paint on the exterior of the
structure. PMC 1.10.075(13), PMC 1.10.085(B)(2), PMC 1.10.085(G), PMC
1,10.085(L)(1)(1).
4. AuLrust 7, 2015 Notice of Hearing: On this date, the City duly served on the property owners a
NOTICE OF HEARING ON ADMINSTRATIVE ORDER which purported to set forth still-existing
code violations on the property as of that date. (See page 68 of Exhibit 1)
The Notice of Hearing failed to include item #3 of the original NOV alleged violations:
Missing electrical cover plates in the interior of the structure in violation of PMC 1.10.085 (B)(7),
PMC 1, 10.085(1), PMC 1,10.085(N).
Therefore as a matter of due process this alleged violation will not be considered for purposes ofthis
hearing, or for imposition of penalties, PMC 1.14.020, PMC 1.14.050.
5. September 2, 2015 Hearing: At the hearing on September 2, 2015, The City of Petaluma admitted
that . the lack of fire protection in garage ceiling (access panel) alleged violation had been
satisfactorily abated as of September t, 2015, leaving only the following alleged violations: (Exhibit
2)
6. The property owners alleged that the admitted code violations outstanding are "decorative" in
nature and that the City of Petaluma's intent is to continue to impose penalties and abatement costs
on the property owners such that they will be forced to sell the property and move away because of
the numerous arrests and telephone calls thatthe City claims to have made response to, over several
years, No evidence of harassment or retaliation by the City of Petaluma was substantiated,

7. There existed and continues to exist, the following conditions which are in violation of applicable
law and constitute a public nuisance as defined under Chapter 1.10 of the Petaluma Municipal Code
(PMC) as follows:
(a) An improperly maintained furnace in violation of PMC 1.10.085(B)(6), PMC
1.10.085(H), PMC 1.10.085(L)(1)(e), PMC 1.10.085(P).
(b) Faucet (hose bib) handles missing for the clothes washer connection in violation of
PMC 1.10.085(B)(8), PMC 1.10.085(E)(3), PMC 1.10.085(L)(1)(d), PMC 1.10,085(0),
(c) Missing or peeling paint on the exterior of the structure in violation of PMC
1.10.075(B), PMC 1.10.085(B)(2), PMC 1,10,085(G), PMC 1.10.085(L)(1)(I).
8, The property owners, Arty Richardson et al and Kim Richardson despite having made significant
efforts to abate many of the violations itemized in the June 24, 2015 NOV, at the subject property,
have not abated the violations described above,
9, Based on the testimony and the facts of this case, the property owners have been provided
sufficient notice and time for abatement of the substandard housing conditions and defects described
in the NOV.
10, The City is authorized to issue penalties up to $1,000 per day, per violation.
VII. BASED UPON THE FOREGOING FINDINGS OF FACT AND CONCLUSIONS OF
LAW, IT IS HEREBY ADJUDGED AND DECREED THAT:
1. The testimony and documentary evidence presented at the hearing has established by a
preponderance of evidence that the substandard property maintenance conditions as set forth
below and identified in the June 24 2015 Notice of Violation issued, served and received by the
responsible parties existed through September 2, 2015, continue to exist and constitute a public
nuisance under Chapter 1.10 of the Petaluma Municipal Code:
(a) An improperly maintained furnace in violation of PMC 1,10.085(13)(6), PMC
1.10.085(H), PMC 1.10,085(L)(1)(e), PMC 1.10.085(P);
(b) Faucet (hose bib) handles missing for the clothes washer connection in violation
of PMC 1.10,085(B)(8), PMC 1.10.085(E)(3), PMC 1.10.085(L)(1)(d), PMC
1.10.085(0);
(c) Missing or peeling paint on the exterior of the structure in violation of PMC
1,10.075(B), PMC 1.10.085(11)(2), PMC 1,10.085(G), PMC 1.10.085(L)(1)(1).
2. The violation consisting of the existence of holes in the fire wall of the garage in violation of
PMC 1.10.085(K), PMC 1.10,085(Q), PMC 1.10,085(U) has been abated.

3. The issue of missing cover plates at dryer and dishwasher was not noted in the Notice of
Hearing served on August 7, 2015 and is not subject to adjudication herein.
4. The Petaluma Municipal Code and the City's adopted Schedule of Penalties allows for
penalties up to $1,000 per day, per code violation.
5. The property owners Arty Richardson et al and Kim Richardson are hereby ordered to pay the
City of Petaluma $25.00 per day, per code violation, in administrative penalties for the violations
specified in the Notice of Violation that have existed on the property from the compliance date of
August 5, 2015, in the total amount of $3.575.00 ($925.00 X 3 for the outstanding violations
through September 1, 2015, plus $800.00 for the abated fire protection in garage ceiling violation,
through August 27, 2015), within 90 days from the date of this Administrative Hearing
decision. Payment is to be made to the City of Petaluma, Administrative Services
Department - Citations, 11 English Street, Petahtma, CA 94952,
6. The property owners Arty Richardson et ai and Kim Richardson, are hereby ordered to pay the
City of Petaluma its existing administrative costs through.August 5, 2015, of $1,643.04, plus the
additional administrative costs for staff preparation and attendance at the scheduled administrative
hearing, of $103.24 and the Administrative Hearing Officer's expenses, in the amount of
$2,676.71 for a cumulative total of 4$ ,422.99 within 90 days fiom. the date of the Hearing
Officer's decision. Payment is to be made to the City of Petaluma, Administrative Services
Department - Citations, It English Street, Petaluma, CA 94952.
7. The City Clerk of the City of Petaluma is hereby authorized to record at the Sonoma County
Recorder's Office a lien against the subject property for the combined total of the administrative
costs and penalties awarded by the Administrative Hearing Officer, to the extent that such amount
has not been tendered to or recovered by the City within 90 days of the date of the Hearing
Officer's decision.
8. Property owners Arty Richardson et al and Kim Richardson are hereby ordered to corrector
eliminate any violation, including a proposed schedule for correction or elimination of said
violation within thirty (30) days from the date of this Administrative Hearing Decision, or
October 12, 2015.
9. The City also is hereby authorized to impose additional administrative penalties of $50.00 per
violation, per day, from the September 2, 2015 date of this hearing for any code violations that
have not been corrected by the compliance date specified in the .blearing Officer's Decision, of
October 12, 2015.
10. The City of Petaluma is hereby authorized to abate or cause the abatement of a nuisance
condition in the event that the property owners Arty Richardson et al and 1,Cim Richardson
have refused or have otherwise neglected to take steps to correct or eliminate said conditions by
October 12, 2015. If the City of Petaluma undertakes to abate or eliminate any nuisance condition
as provided in PMC Section 1;11,030, the City shall be entitled to recover all costs of abatement

incurred in performing such work and other costs necessary to enforce this order. Such costs may
be recovered by the City as a personal obligation and/or through a lien or a special assessment on
the affected property as provided in Section 1,14.140.
11. Pursuant to PMC Section 1.14.110, this decision is a final decision, subj ect to a right to
judicial review in accordance with California Code of Civil Procedure Sections 1094,5 and 1094.6
and Government Code Section 53069.4.

Pursuant to Government Code Section 3 8773.5 (c), the City of Petaluma is hereby
notifying you that the property may be sold after three years by the tax collector for
unpaid delinquent assessments. The tax collector's power of sale shall not be affected by
the failure of the property owner to receive notice. The assessment may be collected at
the same time and in the same manner as ordinary municipal taxes are collected, and shall
be subject to the same penalties and the same procedure and sale in case of delinquency
as provided for ordinary municipal taxes. All. laws applicable to the levy, collection and
enforcement of municipal taxes shall be applicable to the special assessment. However, if
any real property to which the cost of abatement relates has been transferred or conveyed
