Maintenance and Monitoring Plan
RECOMMENDATION
It is recommended that the City Council adopt the attached Resolution Authorizing a
Professional Services Agreement with Winzler & Kelly for the Development of the
Shollenberger Dredge and Disposal Site Management, Maintenance, and Monitoring Plan.
BACKGROUND
Periodic dredging of the Petaluma River is authorized by the US Army Corps of Engineers
(USAGE) in order to remove accumulated sediment deposits at the bottom of the river.
Dredging is required to maintain river navigability and is restricted to the area within the Turning
Basin to south of Adobe Creek. The last dredging event was in 2002 and is normally performed
every 5 — 7 years. The Turning Basin was dredged separately in 2007 to remove sediment
deposited from a large storm event. That project was funded through FEMA.
Since 2002, the City has worked toward obtaining approval to continue using the Shollenberger
site as a disposal area for dredging anticipated in 2011. The 2002 Biological. Opinion (BO) on
the Petaluma River Dredging and Disposal Project determined the dredge -spoils site contained
pickle weed vegetation and annual grasslands considered potential Salt Marsh Harvest Mouse
habitat. The City.has responded to this BO by proposing development and implementation of a
monitoring and management plan to restore a 48 -acre mitigation site adjacent to the dredge
spoils site to be reserved as Salt Marsh Harvest Mouse habitat. The City constructed a berm to
separate these 48 acres in the southern portion of the site, which is identified on the attached
Location Map.
In early 2010, ,as part of the dredge and stom rrecovery work effort, Recovery Operation
Specialty Services (ROSS) completed a preliminary draft version of the Shollenberger
Management Maintenance and Monitoring Plan (SMMMP). The purpose of the SMMMP is to
ensure the City is compliant with requirements stipulated in the Biological Opinion. The
preliminary draft plan prepared by ROSS would require the City to perform maintenance and

monitoring for the site, at a cost estimated to exceed a million dollars during a six year time
frame.
DISCUSSI®N
The current Shollenberger Dredge and Disposal Site Management, Maintenance and Monitoring
Plan Development project. involves revising the draft SMMMP created by ROSS to produce a
new document that encompasses a comprehensive but more cost-effective approach to comply
with the Biological Opinion requirements.
A contract initiated a work effort to prepare the above referenced Plan. ROSS developed
multiple drafts of the proposed document but was unable to meet the needs of the City with
regard to a consistent implementable document within the City's fiscal constraints. Early drafts
of the document were prematurely submitted to the Department of Fish and Game, Corps of
Engineers, National Marine Fisheries Services, and the Regional Water Quality Control Board
for review. The document is not complete and has not been approved by the City or the
regulatory agency. The work effort currently proposed allows the City to rethink the measures
proposed in the preliminary document to accommodate both the site and species specific issues,
to fit more reasonably into the monitoring budget, and to comply with the Biological Opinion as
interpreted by the regulatory agencies. The base data from- the preliminary report, prepared by
ROSS, will be utilized to all extent possible in creating the new Plan. The prior contract with
ROSS was terminated in late spring, 2010 after numerous rounds of review and failure to agree
on a specific direction and solution to achieve a final document. Given that ROSS was unable to
meet the needs of the City in an appropriate fashion, the staff took action to pursue a different
consultant with a newer approach to meeting the needs of both the City and the applicable
regulatory agencies.
Winzler & Kelly indicated in their proposal that they will take a different approach than ROSS
by using.the guidelines in.the Confined Disposal of Dredge Material, EM 1110-2-5027 (USACE,
September 1987). The SMMMP is to include criteria for evaluating the proposed measures and
requirements defined in the Biological Opinion to evaluate the performance of restoration of
habitat at the mitigation parcel; production and submittal of a final version of the SMMMP
incorporating comments provided by the City; meeting coordination between the City and
permitting agencies to discuss and reach an agreement regarding the elements of the SMMMP;
coordination for negotiations between the City with the United States Army Corps of Engineers
(USACE), U.S. Fish and Wildlife Service, California Department of Fish and Game, and San
Francisco Regional Water Quality Control Board agencies to obtain permit approvals. The goal
is to create a cost-effective SMMMP that the City can commit to implementing, while obtaining
authorization and permits to dredge the Petaluma River by the end of 2011.
The Request for Proposal was sent to seven consulting firms on September 20, 2010. Three
proposals were received by October 26, 2010.
Among the various criterion used to select the most qualified consultant were evaluating the
estimated personnel hours per project proposal, reference in the proposal to relevant dredge
activity regulatory guidance documents, the proposed method of monitoring the endangered

species habitat, as well as project team qualifications and experience. Winzler & Kelly was
selected because their project team is familiar with the Shollenberger site, have experience
managing dredge activities in the San Francisco Bay Area, Las Gallinas Creek Dredging and
Maintenance Project, and San Francisco Marina West Harbor Renovation Project. Please also
note, Winzler & Kelly was the only proposer that did not indicate that species monitoring will be
conducted by trapping the Salt Marsh Harvest Mouse. Trapping of the Salt Marsh Harvest
Mouse is expensive and could result in harming the animals that the City and regulatory agencies
are striving to protect.
While cost was a factor in evaluation of proposals, it was not the sole determining factor.
Proposals ranged from a low of $58,450 to a high of $78,515. Winzler & Kelley's proposed cost
was $63,950. Winzler & Kelly was asked to provide a revised estimated project cost to include
additional coordination meetings that have been added to the scope of service, resulting in a cost
estimate of $76,270.
FINANCIAL IMPACTS
Total estimated project budget is $80,070, including a 5% contingency to allow for unanticipated
services and/or meetings. The total FY 2010/11 budget for this project is included in account
number 6600.66600.54140. There is $225,000 budgeted for consulting services and it was
anticipated that this project would require funding of approximately $70,000. The project will
extend into the 11/12 fiscal budget when an additional $10,000 will be requested to cover the
remaining anticipated costs for the project completion.

WHEREAS, City staff prepared a project scope and distributed a Request for Proposals for the
professional services required for this Project; and
WHEREAS, the Request for Proposals was sent to seven consulting firms on September 20,
2010, and three (3) project -proposals were received by the October 26, 2'010 deadline; and
WHEREAS, the proposal submitted by Winzler & Kelly, Santa Rosa, CA for $76,270, satisfies
the proposal requirements; and
WHEREAS, staff has determined that Winzler & Kelly is the most responsive and qualified
proposer to meet the requirements for the Project; and
WHEREAS, the Project addresses compliance with Section 7 of the 'Endangered Species Act to
protect the Salt Marsh Harvest Mouse.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City hereby:
1. Approves the Project Budget in the amount of $80,070.
2. Approves the Professional Services Agreement attached as,Exhibit A for the
development of the Shollenberger Dredge and Disposal Site Management, Maintenance,
and Monitoring Plan, in the amount of $76,270,.conditioned on Winzler & Kelly timely
executing'the project contract and submitting all required documents, including but not
limited t'o certificates of insurance in accordance with the project proposal documehts.
3. Authorizes.the:City Manager or his designee to execute said agreement on.behalf of the
City of Petaluma.

and indemnity by the City, unless the time for responding, has been extended- by an
authorized representative of the City in writing. If the Consultant fails to accept tender of
defense and indemnity within '30 calendar days, .in addition to any other remedies
authorized by law, so much of the money. due or that may become due the -Consultant
under this Agreement as shall reasonably"be con'sid'ered necessaryby the City; may be
retained .by the City until disposition has been made of the matter subject to tender, or
until the Consultant accepts the tender, whichever occurs first: In the event that the City
must file responsive documents in a matter tendered to Consultant prior to Consultant's

services subject to California Civil Code Section 2782.8, as may be amended from time
to time, Consultant's duty to indemnify shall only be to the maximum extent permitted by

completed' several alternative analyses for disposal of
