RESOLUTION AUTHORIZING AWARD OF CONTRACT
FOR THE ELLIS CREEK SOLIDS HANDLING UPGRADES PROJECT
WHEREAS, City staff has prepared construction bid documents and advertised for
construction of the Ellis Creek Solids Handling Upgrades Project Number C66501305, ("the
Project"); and
WHEREAS, in accordance with the City of Petaluma Charter and Municipal Code,
California Public Contract Code Section 20162 and other applicable law, City staff solicited bids
for the Project; and
WHEREAS, the Project was bid on April 20, 2016, and five bids were received and
opened on June 1, 2016 in accordance with applicable law; and
WHEREAS, the lowest responsible bid with the bid alternate for the Project was
submitted by C. Overaa & Co. from Richmond, CA for $6,204,000; and
WHEREAS, staff has determined that the Contractor's bid satisfies the bidding
requirements for the Project; and
WHEREAS, staff has verified that C. Overaa & Co. possesses a valid California
Contractor's License, Class A, number 106793 that is acceptable for the Project; and
WHEREAS, on January 4, 2016, the City Council, by Resolution No. 2016-007 N.C. S.,
certified the 2015 Biomass-to-Biofuel Addendum (Addendum No. 5) to the Water Recycling
Facility and River Access Improvements EIR, approved the revisions to the project, and made
findings of fact; and
WHEREAS, on January 4, 2016, the City Council, by Resolution No. 2016-008 N.C. S.,
approved the Biomass-to-Biofuel Improvements as described in Addendum 5 and adopted a
Mitigation Monitoring Program; and
WHEREAS, the proposed project is part of the Biomass-to-Biofuel Improvements which
would modify the Ellis Creek Water Recycling Facility to accept high-strength waste from local
food and beverage industries and convert it to compressed natural gas (CNG) to power City
vehicles; and
WHEREAS, the project funds are budgeted in the City's 16/17 budget as project
C66501305.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Petaluma hereby:

1. In accordance with the City of Petaluma Charter and Municipal Code, California
Public Contract Code Section 20162 and other applicable law, waives any and all
non-conformance in the bid of Contractor for the Ellis Creek Solids Handling
Upgrades Project, Project Number 066501305 and finds the bid from C. Overaa &
Co. of $6,204,000 to be the lowest responsive and responsible bid for the project; and
2. Awards the contract for the Ellis Creek Solids Handling Upgrades Project, Project
Number C66501305 to C. Overaa & Co. in the amount of $6,204,000 on the
condition that C. Overaa Company timely executes the project contract and submits
all required documents, including but not limited to, executed bonds, certificates of
insurance, and endorsements, in accordance with the project bid documents; and
3. Authorizes and directs the City Manager to execute the project contract on behalf of the
City of Petaluma.
Under the power and authority conferred upon this Council by the Charter of said City.
