HomeMy WebLinkAboutPlanning Commission Resolution 2016-07 06/14/2016RESOLUTION NO. 2016-07 CITY OF PETALUMA PLANNING COMMISSION RESOLUTION OF THE CITY OF PETALUMA PLANNING COMMISSION APPROVING AN AMENDMENT TO CONDITION NO. 21 OF THE SITE PLAN AND ARCHITECTURAL REVIEW APPROVAL FOR THE CADER CORPORATE CENTER PROJECT UNDER PLANNING COMMISSION RESOLUTION NO. 2015-15 APN: 005-040-057 FILE NO: PLSR-15-0005 WHEREAS, Danny Garon ("Applicant") submitted an application for Site Plan and Architectural Review approval for the Cader Corporate Center project ("Project") located at 1480 Colder Lane (APN 005-040-057); and WHEREAS, at a duly noticed public hearing of September 8, 2015, the Planning Commission approved the Project through Resolution No. 2015-14 (Mitigated Negative Declaration) and Resolution No. 2015-15 (Site Plan and Architectural Review); and WHEREAS, Danny Garon ("Applicant") submitted an application to amend the language of Condition No. 21 of Planning Commission Resolution No. 2015-15 granting Site Plan and Architectural Review approval for the Project; and WHEREAS, the amendment application concerns changes to the maximum permitted air conditioned space, prohibition on commercial refrigeration and equipment, assumed employee numbers, and minimum area of solar arrays ("Revised Project"); and WHEREAS, prior to acting on this application, the Planning Commission approved an Addendum to the Mitigated Negative Declaration (MND) approved on September 8, 2015 via Resolution 2015-14; and WHEREAS, the Planning Commission held a duly noticed public hearing to consider application on June 14, 2016; and WHEREAS, public notice was published in the Argus Courier and mailed to residents and occupants within 500 feet of the project site in compliance with state and local law; and NOW THEREFORE, BE IT RESOLVED THAT: A. The foregoing recitals are true and correct and incorporated herein by reference. B. Based on the staff report, staff presentation, comments received and the public hearing, the Planning Commission makes the following findings based on substantial evidence in the record: 1. The Revised Project is consistent with the General Plan 2025 Business Park land use designation in that light processing and manufacturing and wholesale and distribution, are principally permitted uses. In particular, the project is consistent with the following goals, policies, and programs of the 2025 General Plan 1-P-9 Support continued development and intensification of employment centers. Planning Commission Resolution No. 2016-07 Page 1 4-P-9 Require a percentage of parking spaces in large parking lots or garages to provide electrical vehicle charging facilities. 4-P-19 Encourage use and development of renewable or non-traditional sources of energy 5-P-22 Preserve and enhance pedestrian connectivity in existing neighborhoods and require well connected pedestrian network linking new and existing developments to adjacent land uses. 2. The Revised Project is consistent with the Business Park (BP) zoning district as it would not alter any previously approved feature relating to compliance with development standards of the BP zoning district, including, but not limited to, setbacks, Floor to Area Ratio (FAR), and building height. 3. The Revised Project does not create the need for new findings under Implementing Zoning Ordinance §24.010 (G)(1) (Site Plan and Architectural Review) and all the prior approval findings under that section provided by Planning Commission Resolution No. 2015-15 are hereby incorporated by reference. C. Based on its review of the entire record herein, including the staff report, all supporting, referenced, and incorporated documents and all comments received and foregoing findings, the Planning Commission hereby approves the following amendment to Condition No. 21 of Planning Commission Resolution No. 2015-15 (underline = addition; strikethFeugh = deletion): "The potential environmental effects of the project were studied and based upon a project description utilized in an Initial Study prepared pursuant to the California Environmental Quality Act. Certain elements of the project description are necessary to prevent one or more significant effects. Therefore, to ensure this approval results in project consistent with the description relied upon in the Initial Study, Prior to building permit issuance, the following applicant proposed conditions shall be shown on plans submitted for construction purposes and the Project shall include: a) No more than 37,967 23,692 square feet er8:8% of the total building square footage for the site shall be air conditioned. b) Up to 63,500 square feet may be for N -s commercial refrigeration rooms and/or equipment C) At least 40,000 16,208 square feet of solar arrays shall be maintained in good working condition and are to remain in operation throughout the life of the project. Areas where solar is not to be installed shall be pre -wired to allow for future installation of solar panels." d) Changes to the project qualifying for an Addendum to the adopted Mitigated Negative Declaration under California Environmental Quality Act Guidelines �§ 15162 and 15164 may be reviewed and approved by the Planning Manager.
