HomeMy WebLinkAboutStaff Report 3.A 01/24/2011DATE: TO: FROM: SUBJECT V2 F W , F R 'WEE 'Er January 24, 2011 Honorable Mayor and Members of the City Council through City Manager Larry Zimmer, Public Works Engineering Manager Resolution Accepting Completion of the Construction Contract for the 2010 Slurry Seal Project RECOMMENDATION It is recommended that the City Council adopt the attached resolution accepting completion of the construction contract for the 2010 Slurry Seal Project. BACKGROUND The Department of Public Works prepared plans and specifications for this project. Bids were opened on July 14, 2010, and on August 2, 2010, the City Council awarded the construction contract to American Asphalt Repair & Resurfacing, Inc. ("Contractor"). The Contractor has satisfactorily completed the construction contract for $278,959.25. The estimated total cost of the project, including construction contract, construction management and inspection, design, administration and overhead, is $360,000. Slurry seal is a preventive maintenance measure, recommended for streets in good condition with light cracking. Prior to start of the slurry seal operation, staff noticed the existence of many wide, deep and long cracks on Noriel Lane, one of the scheduled streets, caused by movement in the adobe (clay) soil over the summer. The recommended repair for pavement distress of this kind is removal and replacement of base material and asphalt pavement. Because of the presence of this severe. distress, Noriel Lane was no longer suitable for slurry seal application. Therefore, it was removed from the contract, Which allowed for increases or decreases in area, since payment to the contractor was based on the actual area slurry sealed as measured by City staff. To add another street segment at that time was not feasible, so the resulting item under -run shown following the Contract Change Orders in the attached resolution will be used for future street maintenance. Per contract requirements, retention will be released within sixty days after Council acceptance of this project. Agenda Review:) City Attorney J Finance Director City Manager DISCUSSION Staff recommends accepting completion of the construction contract, since American Asphalt Repair & Resurfacing, Inc. has fulfilled all contract requirements. Approval of this resolution will assure release of retention to the Contractor. FINANCIAL IMPACTS The estimated total cost of the project, including construction contract, construction management and inspection, design, administration, and overhead, is $360,000. A total project budget of $391,440 (State Proposition 1B & Street Maintenance Fund) was authorized by Resolution 2010- 142 on August 2, 2010. The unused budget will be returned to the Street Maintenance Fund — Account # 2411-24110-54150 for future use. C16101008 WHEREAS, in accordance with Section 68 of Article X of the City of Petaluma Charter, Section 20162 of the California Public Contract Code and other applicable law, the City of Petaluma solicited bids for the 2010 Slurry Seal Project ("Project"), and WHEREAS, bids for the Project were opened on July 14, 2010 in accordance with California Public Contract Code Section 4104.5 and other applicable law; and WHEREAS, the apparent low bid for the Project was the bid of American Asphalt Repair & Resurfacing, Inc. in the amount of $298,265.12; and WHEREAS, by Resolution No. 2010-142, adopted on August 2, 2010, the City Council of the City of Petaluma found the bid of $298,265.12 for the Project to be the lowest responsive bid and awarded the Project to American Asphalt Repair & Replacement, Inc. in the amount of $298,265.12, conditioned on American Asphalt Repair & Replacement, Inc.'s timely executing the Project contract and submitting all required documents, and authorized and directed the City Manager to sign the Project contract on behalf of the City, upon such timely submission, and to execute on behalf of the City any change orders and other amendments to the Project contract that are necessary to effectively complete the project and/or to realize the Project and/or cost benefits for the City, so long as such change orders or amendments do not result in an increase in excess of $44,000; and WHEREAS, the following contract change orders (CCO) affecting the Project amount have been approved; and Chance Order Number Description CCO#1 Replace existing parking stall striping CCO#2 Re -negotiate unit prices for some bid items due to quantity decreases in excess of 25% as allowed by the project specifications CCO#3 Delete two portable changeable message signs ; and Total change orders: Sum of over- and under -runs: Amount $933.00 $1,731.00 ($2,400.00) $264.00 ($19,569.87) WHEREAS, the final contract amount, as amended, including all change orders, is $278,959.25; and WHEREAS, City staff have inspected the Project and determined that it has been . completed in accordance with the contract requirements, subject to the Contractor's continuing warranty and other obligations pursuant to the contract; and WHEREAS., based on the foregoing, staff recommends acceptance of the Project on behalf of the City; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Petaluma as follows: 1. The contract entitled 201.0 Slurry Seal, Project No. C1 61,01008, with the final contract amount of $278,959.25, is accepted as complete, subject to the Contractor's continuing warranty and other obligations pursuant to the contract. 2. The City Clerk/Recording Secretary is hereby authorized and directed to file a Notice of Completion concerning the Project with the Sonoma County Clerk's Office within ten (10) days of the date of this Resolution. 3.
