and Authorizing the City Manager to Execute All Grant and Purchase Related
Documents.
RECOMMENDATION
It is recommended that the City Council adopt the attached Resolution Authorizing the Petaluma
Police Department to Apply for and Accept the Edward Byrne Memorial Justice Assistance
Grant Program FY 2016 Local Solicitation Funds in the Amount of $14,566 for the Purchase of
Portable Radios and Authorizing the City Manager to Execute All Grant and Purchase Related
Documents.
BACKGROUND
The Edward Byrne Memorial Justice Assistance Grant supports criminal justice activities and
programs. This particular grant utilizes a Part 1 Crimes index (specific felony crimes) to
calculate allocations to state and local governments each fiscal year. In the case of the City of
Petaluma, a grant allocation of $14,566 has been established by the U.S. Department of Justice
for FY 2016.
DISCUSSION
The Police Department has identified the need to purchase equipment to replace outdated, failing
portable radio equipment. The current police portables have been in operation for more than 12
years. These radios are beyond their life expectancy and are no longer supported for repair by
the manufacturer. Under the Department of Homeland Security grants in 2012 and 2014, thirty -
five portable radios were replaced. Under the FY 2013 and 2014 Byrne grants, an additional 24
portable radios were replaced. When four radios are purchased under this grant, current model
radios will be in place for the majority of field personnel.
This grant requires the local governing body to review the grant application and allow for public
comment prior to grant funding. This requirement will be met by the Council reviewing this
agenda report and adopting a resolution.
The attached grant application references the purchase of four portable radios.
FINANCIAL IMPACTS
The total equipment cost for this project is $15,417.48. The grant funding of $14,566 will cover
94.48% of the equipment cost for this project. Additional funding will be required for the
$851.48 balance of the equipment purchase, and will be provided from the supplies and
equipment accounts in the Police Department budget.

conditions of the Edward Byrne Memorial Justice Assistance Grant Program; and
WHEREAS, grant funds received shall be used to purchase the equipment necessary for
the replacement of outdated portable radios.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of

The Petaluma Polico Department intends to purchase four new portablo police radios to
replace outdated equipment no longer supported by the manufacturer. This pwchase is pact of
an overall effort, a portion of which was funded. by FY 2013, 2014 and 2015 Byre (JACT) grant
funds, to update emergency communications infiastructwe and equipment in compliance with
Federal interoperability guidelines.

Program Narrative
The City of Petaluuua, Califoxaaia, is file second largest oity, in Sonoma County with a
popidatlon of nearly 60,000 people. The police depaztanent currently has 62 sworn officers.
Thirty, six of these officers are assigazed to the patrol division and havo the highest need for
dependable radio rvApment. By 2012, all of fife portable radios assigned to sworn officers weave
over 10 gears old and were no longer supported by Motorola. As the radio equipment failed it
could not be repaired..
In 2012, through Department of Romeland Seciu* grant funding, 20 portable radios
were replaced. Funding xeceived through the FY 2013 and FY 2014 JAG grants replaced 24
portable yadxos. Ftunding from the FY 2016 JAG grant will be used toward the p- mchase of four
additional replacement radios, outfitted with technology up to speed with the current industry
standards. When the radio equipment is pmehased under this grant, a good portion of our officers
will have new radios but there will still be approximately 17 radios ixr need of replacement for
other staff members.
The total cost of these new radios will be $15,417.48. The amount of funding available to
the City of Petaluma under the FY 2016 JAG program is $14,566.00. The remaining balance of
$851.48 will be paid. by the City of Petaluma separate from any other source of Federal. finding.
All equipment purchased in this project is in compliance with FY 2016 SAFECOM
Guidance for Emergency Comau mkatiorls Grants ensuring intexopeiable communications.

The attached Budget Worksheet outlines all of rho equipment costs necessary for the
purchase of four poitable police replacement radios. $14,566.00 of these costs will be paid from
funds tirnder this grant program. The remaining equipment cost of $851.48 will be paid for by
the City of Petaluma separate Rom any Federal funding.
The purchase of the cquipment for this project will be made within 60 days of grant
funding as a one -time expense, The vendor used for this purchase will be Dailey -Wells
Communications, Inc. This vendor is currently working with the City of Petaluma as the radio
commm- eations service provider. They offer competitive rates for radios outfitted with
technology up to date industry standards.

This grant application is intended to be submitted for review and acceptance by the
Petaluma City Council at the August 1, 2016 council meeting. Advance notice will be posted on
the City Web Site and physically posted in City Hall, in accordance with local ordinance,
regarding the meeting date and the agenda items to be considered by the council. Thy public will
have an opportunity to make. comments regarding this punt application at the council meeting
per established procedures. The Petaluma City Council, by resolution, is expected to authorize
the City Manager to submit the grant application and execute all grant- related documents.

STANDARD ASSURANCES
The Applicant hereby assures and certifies compliance with all applicable Federal statutes, regulations,
policies, guidelines, and requirements, including 2 C.F.R. Part 2800 (Uniform Administrative
Requirements, Cost Principles, and Audit Requirements for Federal Awards by the Department of
Justice), and Ex. Order 12372 (intergovernmental review of federal programs). The applicant also

1. It has the legal authority to apply for federal assistance and the institutional, managerial, and financial
capability (including funds sufficient to pay any required non - federal share of project cost) to ensure
proper planning, management, and completion of the project described in this application.
2. It will establish safeguards to prohibit employees from using their positions for a purpose that

3. It will give the awarding agency or the Government Accountability Office, through any authorized

2. DEBARMENT, SUSPENSION, AND OTHER RESPONSIBILITY MATTERS (DIRECT RECIPIENT)
Pursuant to Executive Order 12549, Debarment and Suspension, implemented at 2 CFR Part 2867, for
prospective participants in primary covered transactions, as defined at 2 CFR Section 2867.20(a), and
other requirements:
A. The applicant certifies that it and its principals:
(a) Are not presently debarred, suspended, proposed for debarment, declared ineligible, sentenced to a
denial of Federal benefits by a State or Federal court, or voluntarily excluded from covered transactions
by any Federal department or agency;
(b) Have not within a three -year period preceding this application, been convicted of or had a civil
judgment rendered against them for commission of fraud or a criminal offense in connection with
obtaining, attempting to obtain, or performing a public (Federate, State, or local) transaction or contract
under a public transaction; violation of Federal or State antitrust statutes or commission of embezzlement,
theft, forgery, bribery, falsification or destruction of records, making false statements, or receiving stolen
property;
(c) Have not within a two -year period preceding this application been convicted of a felony criminal
violation under any Federal law, unless such felony criminal conviction has been discldked in writing to
the Office of Justice Programs (OJP) at Ojpcompliancereporting @usdoj.gov, and-, after such disclosure,

debarment of the applicant is necessary to protect the interests of the Government in this case.
(d) Are not presently indicted for or otherwise criminally or civilly charged by a governmental entity
(Federal, State, or local) with commission of any of the offenses enumerated in paragraph (b) of this
certification; and
(e) Have not within a three -year period preceding this application had one or more public transactions
(Federal, State, or local) terminated for cause or default.
B. Where the applicant is unable to certify to any of the statements in this certification, he or she shall
attach an explanation to this application.
3. FEDERAL, TAKES
A. If the applicant is a corporation, the applicant certifies that either (1) the corporation has no unpaid
Federal tax liability that has been assessed, for which all judicial and administrative remedies have been
exhausted or have lapsed, that is not being paid in a timely manner pursuant to an agreement with the
authority responsible for collecting the tax liability, or (2) the corporation has provided written notice of
such an unpaid tax liability (or liabilities) to OJP at Ojpcompliancereporting , @usdoj.gov, and, after such

B. Where the applicant is unable to certify to any of the statements in this certification, he or she shall

4. DRUG-FREE WORKPLACE (GRANTEES OTHER THAN INDIVIDUALS)
As required by the Drug -Free Workplace Act of 1988, and implemented at 28 CFR Part 83, Subpart F, for
grantees, as defined at 28 CFR Sections 83.620 and 83.660:
A. The applicant certifies that it will or will continue to provide a drug -free workplace by:
(a) Publishing a statement notifying employees that the unlawful manufacture, distribution, dispensing,
possession, or use of a controlled substance is prohibited in the grantee's workplace and specifying the
actions that will be taken against employees for violation of such prohibition;
(b) Establishing an on -going drug -free awareness program to inform employees about
(1) The dangers of drug abuse in the workplace;
(2) The grantee's policy of maintaining a drug -free workplace;
(3) Any available drug counseling, rehabilitation, and employee assistance programs; and
(4) The penalties that may be imposed upon employees for drug abuse violations occurring in the
workplace;
(c) Making it a requirement that each employee to be engaged in the performance of the grant be given a
copy of the statement required by paragraph (a);
(d) Notifying the employee in the statement required by paragraph (a) that, as a condition of employment
under the grant, the employee will
(1) Abide by the terms of the statement; and
(2) Notify the employer in writing of his or her conviction for a violation of a criminal drug statute occurring
in the workplace no later than five calendar days after such conviction;
(e) Notifying the agency, in writing, within 10 calendar days after receiving notice under subparagraph
(d)(2) from an employee or otherwise receiving actual notice of such conviction. Employers of convicted
employees must provide notice, including position title, to: Department of Justice, Office of Justice
Programs, ATTN: Control Desk, 810 7th Street, N.W., Washington, D.C. 20531. Notice shall include the
identification number(s) of each affected grant;
(f) Taking one of the following actions, within 30 calendar days of receiving notice under subparagraph
(d)(2), with respect to any employee who is so convicted
(1) Taking appropriate personnel action against such an employee, up to and Including termination,
consistent with the requirements of the Rehabilitation Act of 1973, as amended; or
(2) Requiring such employee to participate satisfactorily in a drug abuse assistance or rehabilitation
program approved for such purposes by a Federal, State, or local health, law enforcement, or other
appropriate agency;
(g) Making a good faith effort to continue to maintain a drug -free workplace through implementation of
paragraphs (a), (b), (c), (d), (e), and (f).
