HomeMy WebLinkAboutStaff Report 3.D 08/01/2016Agenda Item #3.D DATE: August 1, 2016 TO: Honorable Mayor and Members of the City Council through City Manager FROM: Dan StJ4 ,, .ASCE — Director, Public Works and Utilities Larry Zimmer, P.E. — Deputy Director, Public Works and Utilities SUBJECT: Resolution Authorizing Award of Contract for the Capri Creek Flood Reduction and Habitat Enhancement Project RECOMMENDATION It is recommended that the City Council adopt the attached Resolution Authorizing Award of Contract for the Capri Creek Flood Reduction and Habitat Enhancement Project. BACKGROUND Flood terracing within the Petaluma Watershed, in concert with the development of a river and creels front trail system, has been envisioned since the adoption of the River Access and Enhancement Plan in 1996 and is included in the General Plan 2025 adopted in 2008. The restoration of Capri Creek will create an opportunity to develop a stewardship program with neighboring residents surrounding Sunrise Park; a concept in line with Council priority to "Expand Adopt -A -Park Program." This project also implements General Plan Policy 2 -P -102 for the Northeast subarea of the City to "Encourage neighborhood adoption and participation in the restoration of natural habitats (e.g. creeks and urban separator)." In February 2013, the _City authorized the submission of a grant application to the Association of Bay Area Governments (ABAG) and the San Francisco Estuary Institute to request funds from the State of California Department of Water Resources (Ca1DWR). The funding structure established ABAG as the lead grantee and the public agency as the Local Project Sponsor. Each Local Project Sponsor is a sub - recipient under the grant and is responsible to perform grant administration and project management services. Petaluma partnered with the Sonoma Resource Conservation District on the application for Capri Creek. The funding agreement between the City and ABAG was executed in fall of 2014. The funding agreement with the Sonoma County Water Agency was executed in March of 2015. The project, designated C16301413, was approved in the FY 16/17 CIP Budget for a total of $1,140,000. On July 6, 2015, City Council authorized the execution of a Professional Services Agreement for design and engineering services with ESA. Design began in August 2015 and was completed in June 2016. On May 11, 2016, a public meeting was held with the neighborhood at the Petaluma Community Center to review the project. On June 15, 2016, the project's tree planting plan was proposed to the Tree Committee. Adopting the proposed resolution addresses and implements the following Council Goals: "Maintain a Safe Petaluma ", and "Complete Flood Control Projects ". DISCUSSION City staff prepared the contract documents and issued a Notice Inviting Bids on June 23, 2016. Staff verified that Hanford Applied Restoration and Conservation possesses the required Class A California Contractor's License, number 461167, which expires on February 28, 2018, which is appropriate for the work. The project consists of the following improvements: grading and off -haul of spoils to establish a re- aligned Capri Creek low -flow channel and associated floodplain bench enhancements and the installation of educational and maintenance access components. Specific work items include mobilization, installation and removal of temporary construction fencing, clearing and grubbing, select tree removal and relocation, development and implementation of a Storm Water Pollution Prevention Program, installation of biotechnical components and erosion control, design and installation of an irrigation system, soil preparation and native plant installation, and a one (1) year maintenance and monitoring period. The bid schedule identified two additive bid alternatives to allow the City to do additional improvements if funding permits. The base bid schedule covers the core elements of the flood terracing projects as described above. Bid alternative 1 would add 1,170 feet of concrete trail along the new terrace of Capri Creek, while bid alternative 2 would place 1,170 feet of quarry fines along the new terrace trail. The community garden, adjacent to the project, is outside the work limits and will remain accessible throughout construction. The project has been found to be consistent with CEQA and the Council adopted Mitigated Negative Declaration for the project on May 19, 2014 through passage of Resolution No. 2014- 074 N.C.S. Regulatory permits were obtained from California Fish and Wildlife, San Francisco Regional Water Quality Control Board and the Army Corp of Engineers that will require strict adherence throughout construction, and post construction reporting. 2 It is recommended that the City Council authorize the City Manager to execute a construction contract with the apparent low bidder, Hanford Applied Restoration and Conservation for the Capri Creek Flood Reduction and Habitat Enhancement Project for the base bid only. Staff will negotiate a revised price for the concrete trail and issue a change order. FINANCIAL IMPACTS The recommended construction contract is within the approved FY 16/17 CIP Budget. Therefore, there are no unbudgeted fiscal impacts that result from the proposed action. The project is primarily funded by the Ca1DWR Grant in the amount of $825,000. Matching funds are provided by the Sonoma County Water Agency from Zone 2A reserves in the amount of $217,000, and approximately $98,000 of Storm Impact Fees contributed by the City for grant match, project administration and construction management services. Location Map $ 98,000 $ 825,000 $ 217,000 $ 1,140,000 3 Attachment 1 RESOLUTION AUTHORIZING AWARD OF CONTRACT FOR THE CAPRI CREEK FLOOD REDUCTION AND HABITAT ENHANCEMENT PROJECT WHEREAS, City staff has prepared construction bid documents and advertised for construction of the Capri Creek Flood Reduction and Habitat Enhancement Project, Project Number C16301413, ( "the Project "); and WHEREAS, in accordance with the City of Petaluma Charter and Municipal Code, California Public Contract Code Section 20162 and other applicable law, City staff solicited bids for the Project; and WHEREAS, the Project was bid on June 23, 2016, and five bids were received and opened on July 14, 2016 in accordance with applicable law; and WHEREAS, the lowest responsible bid for the base bid was submitted by Hanford Applied Restoration and Conservation from Sonoma, CA for $761,250; and WHEREAS staff has determined that the Contractor's bid is responsive and satisfies the bidding requirements for the Project; and WHEREAS, staff has verified that Hanford Applied Restoration and Conservation possesses a valid California Contractor's License, Class A, number 461167 that is acceptable for the Project; and WHEREAS, the project was approved concurrently with the adoption of a Mitigated Negative Declaration, through Resolution #2014 -074 N.C.S. adopted by the City Council on May 19, 2014. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Petaluma hereby: 1. In accordance with the City of Petaluma Charter and Municipal Code, California Public Contract Code Section 20162 and other applicable law, waives any and all non- conformance in the bid of Hanford Applied Restoration and Conservation for the Capri Creek Flood Reduction and Habitat Enhancement Project, Project Number C 163 01413 and finds the bid of $628,000 to be the lowest, responsive bid and further finds that Hanford Applied Restoration and Conservation is the lowest responsible bidder. 2. Awards the contract for the Capri Creels Flood Reduction and Habitat Enhancement Project, Project Number C16301413 to Hanford Applied Restoration and Conservation in the amount of $628,000, the amount of the lowest responsive base bid, conditioned on Hanford Applied Restoration and Conservation timely executing the project contract and L, submitting all required documents, including but not limited to, executed bonds, certificates of insurance, and endorsements, in accordance with the project bid documents. 3. Directs staff to issue a notice of award to Hanford Applied Restoration and Conservation. 4. Authorizes and directs the City Manager to execute the project contract on behalf of the City of Petaluma upon timely submission by Hanford Applied Restoration and Conservation of the signed project contract and all other required documents, including but not limited to, executed bonds, certificates of insurance, and endorsements, in accordance with the project bid documents. 5 Attachment 2 CAPRI CREEK FLOOD REDUCTION AND HABITAT ENHANCEMENT PROJECT PROJECT NO.
