9 IMPROVEMENT PROGRAM FUNDING FOR $720,000.00 AND
10 COMMITTING TIIE NECESSARY' LOCAL MATCH FGR TAE

17 WHEREAS, the Transportation Equity Act for the 21St Century (TEA 21) (Public Law 105-
18 178, June 9, 1998) and the TEA 21 Restoration Act (Public Law 105-206; July 22, 1998) continue the
19 Surface Transportation Program (23 U.S.C. § 133 and the Congestion Mitigation and Air Quality
20 Improvement Program (CMAQ) (23 U.S.C. § 149); and

22 WHEREAS, pursuant to TEA 21, and the regulations promulgated thereunder, eligible project
23 sponsors wishing to receive Surface Transportation Program or Congestion Mitigation and Air Quality
24 Improvement Program grants for a project shall submit an application first with the appropriate
25 metropolitan transportation planning organization (MPO), for review and inclusion in the MPO's
26 Transportation Improvement Program (TIP); and
27
28 WHEREAS, the Metropolitan Transportation Commission is the MPO for the San Francisco
29 Bay region; and
30
31 WHEREAS, the City of Petaluma is an eligible project sponsor for Surface Transportation
32 Program or Congestion Mitigation and Air Quality Improvement Program funds; and

34 WHEREAS, the City of Petaluma wishes to submit a grant application to MTC for funds from
35 the Surface Transportation Program or Congestion Mitigation and Air Quality Improvement Program
36 in fiscal year 1999-2000 for the following project:

1 Improvement of the pedestrian/bicycle access at the intersection of E.
2 Washington St. and McDowell Blvd. and construction of a sidewalk/bike
3 lane along the north side of E. Washington St.

5 WHEREAS, MTC requires, as part of the application, a resolution stating the following:
6 1) the commitment of necessary local matching funds of at least 11.5%; and
7 2) that the sponsor understands that the Surface Transportation Program and Congestion
8 Mitigation and Air Quality Improvement Program funding is fixed at the programmed
9 amount, and therefore any cost increase cannot be expected to be funded with Surface
10 Transportation Program or Congestion. Mitigation and Air Quality Improvement
11 Program funds; and
12 3) the assurance of the sponsor to complete the project as described in the application, and
13 if approved, as programmed in MTC's TIP; and
14 4) that the sponsor understands that funds must be obligated by September 30, 2000, or the
15 project may be removed from the program.

18 the City Manager is authorized to execute and file an application for funding under the Surface
19 Transportation Program or the Congestion Mitigation and Air Quality Improvement Program of TEA
20 21 in the amount of $720,000.00 for the improvement of the pedestrian/bicycle access at the
21 intersection of East Washington Street; and
22
23 BE I'I' FITR'I'HER RES®LVEI) that the City Council of the City of Petaluma by adopting
24 this resolution does hereby state that:
25 1) The City of Petaluma will provide $163,000.00 in local matching funds; and
26 2) The City of Petaluma understands that the Surface Transportation Program and
27 Congestion Mitigation and Air Quality Improvement Program funding for the project is
28 fixed at $720,000.00, and that any cost increases must be funded by the City of
29 Petaluma from local matching funds, and that the City of Petaluma does not expect any
30 cost increases to be funded with Surface Transportation Program or Congestion
31 Mitigation and Air Quality Improvement Program funds; and

1 3) The McDowell Boulevard/East Washington Street Improvements Project No. 9863
2 (Phase III) will be built as described in this resolution and, if approved, as programmed
3 in Metropolitan Transportation Commission (MTC) Transportation Improvement
4 Program (TII'); and
5 4) The program funds are expected to be obligation by September 30, 2000.
