HomeMy WebLinkAboutResolution 99-069 N.C.S. 03/22/1999 Resolution l~To. 99-ss I~1.C.S. 1 2 of the City of Petaluma, California 3 4 5 APPROVAL OF THE BODEGA AVENUE WIDENING PROJECT 6 AND ASSOCIATED 1VIITIGATED NEGATIVE DECLARATION 7 8 9 WHEREAS, the City of Petaluma is the proponent for a project to improve Bodega Avenue to from the intersection at North Webster Street to the city limits (approximately 200 hundred feet 11 past Bantam Way). The proposed improvements include replacing the signal at North Webster 12 Street; and install a new traffic signal at Bantam Avenue, a middle turn lane to provide for left- 13 turn movements, bike lanes, sidewalks, pedestrian ramps, planter strips and street trees. The 14 project also includes the replacement of utilities including storm drains, water and sewer lines 15 and an asphalt overlay. Some right-of--way acquisition is required on certain properties, and 16 17 WHEREAS, a Neighborhood Workshop was held on November 20, 1997, to meet with the 18 residents in the project area and assess any special concerns they may have and their preference 19 for either separated or monolithic sidewalk in front of their property, and 20 21 WHEREAS, a subsequent meeting was held on December 17, 1997, with the owners of the six 22 parcels (401-551 Bodega Avenue) on the south side of Bodega Avenue west of North Webster 23 Avenue to address the location of the sidewalk, and 24 25 WHEREAS, other meetings were held on January 7 and September 23, 1998, with Mr. Gilardi 26 and the tenants of the market bait shop, floor covering and dairy supply at 884 Bodega Avenue 27 (northwest corner of Bodega Avenue and Ruth Court) to work out some safety and access issues 28 associated with the corner, and 29 30 WHEREAS, on February 4, 1998, the Site Plan and Architectural Committee (SPARC) 31 reviewed and approved the design plans for improvements to include a street tree planter strip or 32 yard trees (in monolithic sidewalk areas), and tree species. All conditions of that SPARC 33 approval are incorporated in the approval of this improvement project, and R~ot~c;onrra. 99-69 rr.c.s. Page 1 of 10 1 1 2 WHEREAS, an Initial Study was prepared and the results of the study indicated that the 3 proposed Bodega Avenue Widening Project, as mitigated, will not cause any significant adverse 4 environmental impacts, and all mitigations are incorporated into the approval of the project, and 5 6 WHEREAS, the City Council held a noticed public hearing on the Bodega Avenue Widening 7 Project on December 7, 1998, and considered all written and verbal communications concerning 8 potential environmental impacts resulting from the project before rendering a decision, 9 1o NOW, THEREFORE, BE IT RESOLVED that the City Council approves the Mitigated 11 Negative Declaration and Bodega Avenue Widening Project from North Webster Street to the 12 city limits (approximately 200 feet past Bantam Way), subject to the following Findings and 13 Mitigation Measures: 14 15 Findings for Mitigated Negative Declaration 16 17 a. An initial study has been prepared and proper notice provided in accordance with 18 California Environmental Quality Act (CEQA) and local guidelines. 19 20 b. Based upon the Initial Study and comments received, potential impacts could be avoided 21 or reduced to a level of insignificance by mitigation measures attached as conditions of 22 approval. There is no substantial evidence that the project, as conditioned, would have a 23 significant effect on the environment. 24 25 c. A monitoring program has been included to ensure compliance with the adopted 26 mitigation measures, if any. 27 28 d. The Bodega Avenue Widening Project does not have potential to affect wildlife resources 29 as defined in the Fish and Game code, either individually or cumulatively and is exempt 3o from Fish and Game filing fees. 31 Reso. 99-69 NCS Page 2 of 10 2 1 e. Two sites within the project area are listed on the Sonoma County Hazardous Materials 2 List. The Gilardi property at 884 Bodega Avenue (APN 006-470-006) had a leaking 3 underground storage tank that was removed in 1994. Soil remedy was completed and 4 monitoring wells exist at the site. To date, the cleanup has not been finalized. The 5 Colvin property at 412 Bodega Avenue (APN 006-221-076 &'077) was the location of a 6 .leaking underground storage tank, which was removed and finalized on January 13, 1993. 7 8 f. The City Council reviewed the Initial Study/Negative Declaration and considered the 9 comments before making a decision on the project. 10 11 g. The record of proceedings of the decision on the project is available for public review at 12 the City of Petaluma, Planning Department, City Hall, 11 English Street, Petaluma, 13 California. 14 15 Mitigation Measures 16 17 All mitigation measures as specified in the Initial Study for the Bodega Avenue Widening 18 Project are incorporated as follows: 19 20 I. EARTH: 21 22 1. All earthwork, grading, trenching, backfilling, and compaction operations shall be 23 conducted in accordance with the City of Petaluma's Grading and Erosion Control 24 Ordinance #1576, Title 17, Chapter 17.31 of the Petaluma Municipal Code. 25 26 2. Throughout the construction process, disturbance of groundcover shall be minimized and 27 the existing vegetation shall be retained to the extent possible to reduce soil erosion. 28 29 MonitorinE: 30 31 1. Regularly scheduled field inspections by the City Engineering Department Inspectors Reso. 99-69 NCS Page 3 of 10 3 1 shall be conducted to ensure that all applicable codes, conditions and mitigation measures 2 are being properly implemented through construction of the project. 3 4 II. AIR s 6 I. Standard Best Management Practices regarding dust control measures shall be 7 implemented including maintenance of moist soil conditions, particularly on windy days. 8 9 2. During excavation and/or fill activities, haul trucks used to transport soil shall utilize 1o tarps or other similar covering devices to reduce dust emissions. 11 12 3. Motorized equipment operated during construction activities shall be properly muffled 13 and maintained to minimize emissions. Equipment shall be turned off when not in use. 14 15 4. Post-construction revegetation, repaving or soil stabilization of exposed soils shall be 16 completed in a timely manner. 17 18 Monitoring• 19 20 1. Dust control measures shall be incorporated into the plans and job specifications prior to 21 advertising for bids. 22 23 2. The City's inspectors and the applicant shall insure that the above mitigation measures are 24 implemented. Periodic and scheduled inspections shall occur to ensure implementation 25 of the above mitigation measures. 26 27 3. The improvement drawings shall reflect that exposed areas shall be planted in a timely 28 manner. City inspectors shall ensure that said planting is installed prior to acceptance of 29 improvements. 30 31 4. Plans submitted for development permit approval shall contain specifications meeting Reso. 99-69 NCS Page 4 of 10 4 1 City Ordinance requirements regarding air quality. 2 3 III. WATER 4 5 1. All construction activities shall be performed in a manner that minimizes the sediment and/or 6 pollutants entering directly or indirectly into the storm drain system or ground water. The 7 following provisions shall be incorporated into the construction plans and specifications: 8 9 a. Construction plans shall include specifications for construction staging areas and 10 areas for storage of any hazardous materials (i.e. motor oil, fuels, paints, etc.) used 11 during construction. All construction staging areas shall be located away from any 12 stream and adjacent drainage areas to prevent runoff from construction areas from 13 entering into the drainage system. Areas designated for storage of hazardous 14 materials shall include proper containment features to prevent contaminants from 15 entering drainage areas in the event of a spill or leak. 16 17 b. No debris, soil, silt, sand, cement, concrete or washings thereof, or other construction 18 related materials or wastes, oil or petroleum products or other organic or earthen 19 material shall be allowed to enter any drainage system. All discarded material 20 including washings and any accidental spills shall be removed and disposed of at an 21 approved disposal site. Appropriate disposal methods and/or facilities shall be 22 designated on the construction plans or specifications. 23 24 Monitoring: 25 26 1. Construction practices to reduce sediment and pollution shall be incorporated into the 27 plans and job specifications. 28 29 2. City inspectors shall insure that all required construction activities occur consistent with 3o the mitigation measures and terms and conditions of approval. 31 Reso. 99-69 NCS Page 5 of 10 5 1 IV. PLANTS 2 3 1. Replacement trees, shrubs, and hedges shall be provided where removed. New planter 4 strips with street trees will be provided in locations where separated sidewalks are 5 constructed. 6 7 2. Construction plans and specifications shall identify the locations of existing trees to be 8 preserved and removed. Where existing trees are to be preserved, a tree protection plan 9 showing details for installation of protective fencing, root protection and follow-up 1o recovery methods such as mulching and watering schedule, shall be included. I1 12 3. Landscape plans for the right-of--way areas shall reflect use of water conserving plant 13 materials. 14 IS Monitoring• 16 17 1. The Planning Department will review and approve the proposed landscape plans for 18 conformance prior to advertising for bids. 19 20 2. All public improvements, including landscaping, shall be subject to inspections by City 21 staff for compliance with the approved plans; construction permits and project mitigation 22 measures/conditions of approval prior to acceptance of improvements. 23 24 V. NOISE 25 26 1. All construction activities shall comply with applicable Zoning Ordinance and Municipal 27 Code Performance Standards. 28 29 2. All construction activities shall be limited to 8:00 a.m. to 6:00 p.m. Monday through 30 Friday and 9:00 a.m. to 5:00 p.m. on Saturdays. Construction shall be prohibited on 31 Sundays and all holidays recognized. by the City of Petaluma. Reso. 99-69 NCS Page 6 of 10 6 1 2 3. All machinery and vehicles involved in the construction of the project shall be properly 3 maintained and shall be equipped with appropriate mufflers. Equipment shall be turned 4 off when not in use. 5 6 4. To reduce noise impacts, construction maintenance, storage and staging areas for 7 construction equipment shall avoid proximity to residential areas to the maximum extent 8 practicable. Stationary construction equipment, such as compressors, mixers, etc., shall 9 be placed away from residential areas, when feasible. 10 11 5. A project manager shall be responsible for responding to any complaints from the 12 neighborhood about excessive noise during construction periods. The project manager's 13 telephone number shall be conspicuously posted at the construction site. The project 14 manager shall determine the cause of noise complaints (e.g. starting too early, faulty 15 muffler, etc.) and shall take practical action to correct the problem. lb 17 Monitoring: 18 19 1. Noise mitigation measures shall be incorporated into the plans and specifications for the 20 Bodega Avenue Improvement project. 21 22 VI. TRANSPORTATION/CIRCULATION 23 24 1. A Traffic Control Plan shall be incorporated in the plans and specifications approved by 25 the City's Traffic Engineer, prior to construction activity. At least one lane of traffic in 26 each direction shall be maintained at all times through the construction period, unless a 27 temporary detour plan is submitted and approved by the City Traffic Engineer. During 28 non-working hours, open trenched and construction hazards shall be provided with 29 signage, flashers, and barricades approved by the street superintendent to warn oncoming 3o motorists, bicyclists, and pedestrians of potential safety hazards. 31 Reso. 99-69 NCS Page 7 of 10 7 1 2. All road surfaces shall be restored to pre-project conditions after completion of any 2 project-related utility installation activities. 3 4 3. Any pedestrian access through and/or adjacent to the project site shall remain 5 unobstructed during project construction or an alternate route established as approved by 6 the Director of Engineering. 7 8 Monitorin~• 9 10 1. Inspection by City staff for compliance with the approved improvement plans, City Street 11 Standards and all adopted mitigation measures and conditions of approval shall. be 12 required prior to City acceptance of the improvements. 13 14 15 VII. PUBLIC SERVICES 16 17 1. Landscape plans for the right-or-way areas shall reflect use of water conserving materials. 18 All public area landscaping shall be installed prior to acceptance of the public 19 improvements by the City. Individual property owners will maintain the replacement 20 trees planted in the front yards. 21 22 Monitoring: 23 24 1. Landscape plans shall be reviewed by the Planning Department to incorporate the use of 25 plant materials and/or design strategies to minimize maintenance requirements and fire 26 risk for all right-of--way landscape areas. 27 28 VIII. DRAINAGE 29 30 1. All utilities will be shown on the plans, subject to Engineering Department review and 31 approval prior to advertisement for bid. Reso. 99-69 NCS Page 8 of 10 8 1 2 2. The Project Engineer shall verify the horizontal and vertical location of all existing 3 utilities in the area and shall design any proposed subsurface work or utility extensions to 4 avoid disruption of services, where feasible. All high-risk utilities (i.e. high-pressure gas 5 lines) shall be potholed prior to construction. 6 7 Monitorin~• 8 9 1. All required mitigation measures shall be reflected on the improvement plans. 10 11 IX. AESTHETICS 12 13 1. Previous mitigations, including required landscape improvements, etc., will mitigate 14 potential visual impacts, if any. 15 16 X. ARCHAEOLOGICAL 17 18 1. For all construction .activities, potential to uncover unknown archeological resources 19 exist. Archaeological features include, but may not be limited to, artifacts of stone, shell, 20 bone, or other natural materials. Should any artifacts, cultural remains or potential 21 resources be encountered during construction activities, work in the area. of the find shall 22 cease and the construction contractor shall notify the Director of Planning and a qualified 23 archaeologist shall be consulted for evaluation of the artifacts and to recommend future 24 action. The local Indian community shall also be notified and consulted in the event any 25 archaeological remains are uncovered. 26 27 Monitorin~• 28 29 1.
