16 WHEREAS, the Transportation Equity Act for the 21~` Century (TEA 21) (Public Law 105-
17 178, June 9, 1998) and the TEA 21 Restoration Act (Public Law 105-206, July 22, 1998) continue the
18 Surface Transportation Program (23 U.S.C. § 133 and the Congestion Mitigation and Air Quality
19 Improvement Program (CMAQ) (23 U.S.C. § 149); and
20
21 WHEREAS, pursuant to TEA 21, and the regulations promulgated thereunder, eligible project
22 sponsors wishing to receive Surface Transportation Program or Congestion Mitigation and Air Quality
23 Improvement Program grants for a project shall submit an application first with the appropriate
24 metropolitan transportation planning organization (MPO), for review and inclusion in the MPO's
25 Transportation Improvement Program (TIP); and
26
27 WHEREAS, the Metropolitan Transportation Commission is the MPO for the San Francisco
28 Bay region; and
29
30 WHEREAS, the City of Petaluma is an eligible project sponsor for .Surface Transportation
31 Program or Congestion Mitigation and Air Quality Improvement Program funds; and

33 WHEREAS, the City of Petaluma wishes to submit a grant application to MTC for funds from
34 the Surface Transportation Program or Congestion Mitigation and Air Quality Improvement Program
35 in fiscal year 1999-2000 for the following project:
36 Funding of a Petaluma Transit maintenance and operating facility.

1 WHEREAS, MTC requires, as part of the application, a resolution stating the following:
2 1) the commitment of necessary local matching funds of at least 11.5%; and
3 2) that the sponsor understands that the Surface Transportation Program and Congestion
4 Mitigation and Air Quality Improvement Program funding is fixed at the programmed
5 amount, and therefore any cost increase cannot be expected to be funded with Surface
6 Transportation Program or Congestion Mitigation and Air Quality Improvement
7 Program funds; and
8 3) the assurance of the sponsor to complete the project as described in the application, and
9 if approved, as programmed in MTC's TIP; and
10 4) that the sponsor understands that funds must be obligated by September 30, 2000, or the
11 project may be removed from the program.

13 NOW, THEREFORE, ~E IT RESOI,VEI) by the City Council of the City of Petaluma that
14 the City Manager is authorized to execute and file an application for funding under the Surface
15 Transportation Program or the Congestion Mitigation and Air Quality Improvement Program of TEA
16 21 in the amount of $652,000.00 for the improvement of the pedestrian/bicycle access at the
17 intersection of East Washington Street; and
18
19 RE IT FURTHER RESOLVEID that the City Council of the City of Petaluma by adopting
20 this resolution does hereby state that:
21 1) The City of Petaluma will provide $85,000.00 in local matching funds; and
22 2) The City of Petaluma understands that the Surface Transportation Program and
23 Congestion Mitigation and Air Quality Improvement Program funding for the project is
24 fixed at $652,000.00, and that any cost increases must be funded by the City of
25 Petaluma from local matching funds, and that the City of Petaluma does not expect any
26 cost increases to be funded with Surface Transportation Program or Congestion
27 Mitigation and Air Quality Improvement Program funds; and
28 3) The Petaluma Transit maintenance and operation facility will be built as described in
29 this resolution and, if approved, as programmed in Metropolitan Transportation
30 Commission (MTC) Transportation Improvement Program (TIP); and
31 4) The program funds are expected to be obligation by September 30, 2000.
