5 APPROVING AN AMENDMENT TO THE GENERAL PLAN
6 TO REDESIGNATE A 1.9 ACRE PARCEL
7 FROM URBAN HIGH (UH) TO MIXED USE (MU) TO ALLOW ESTABLISHING
8 A BUSINESS PARK AT 1197 EAST WASHINGTON STREET, APN 007-361-022

11 WHEREAS, an application to amend the General Plan was filed on April 16, 1998 by Shawn
12 Montoya, on behalf of the property owner Sue Traitwein, requesting a General Plan Amendment
13 to redesignate a 1.9 acre parcel from Urban High to Mixed Use; and
14
15 WHEREAS, the Planning Commission held a duly noticed public hearing for the proposed
16 General Plan Amendment on January 12, 1999 and February 23, 1999 and considered all written
17 and verbal reports and testimony on the matter before recommending approval of the General
18 Plan Amendment to the City Council; and
19
20 WHEREAS, all reports and communications to the Planning Commission were forwarded to the
21 City Council; and

23 WHEREAS, the City Council held a duly noticed public hearing on the proposed Amendment on
2~4 April 5, 1999 before rendering its decision; and

1 WHEREAS, the potential environmental impacts of the proposed Amendment have been
2 considered, and proper action has been taken by the City council in compliance with the
3 California Environmental Quality Act and local environmental guidelines in that a Mitigated
4 Negative Declaration has been adopted regarding the requested General Plan Amendment.

6 NOW THEREFORE BE 1T RESOLVED that the Petaluma City Council hereby approves the
7 Amendment to the General Plan land use designation from Urban High to Mixed Use (see
8 Attached Exhibit A) allowing the Martin Historic Plaza, a business park, to establish at this
9 location, based upon the findings specified below:

11 Findings for General Plan Amendment
12 1. The proposed Amendment is in conformance with the Petaluma General
13 Plan and will help to implement goals, objectives and programs of the
14 General Plan relating to the development of underutilized properties and
15 encouraging development within the Urban Limit Line.

17 The 1.9-acre parcel is underutilized, as the existing single-story residence
18 is unoccupied. The Mixed-Use designation allows a broader range of uses
19 to be developed at this site.

21 2. The proposed Amendment is deemed to be in the public interest to provide
22 for orderly development of appropriate office and professional uses.

24 The Mixed-Use designation at this location will not create a nuisance to
25 existing adjacent commercial and residential properties.

27 3. The proposed Amendment is consistent and compatible with the rest of the
28 General Plan and any implementation programs that may be affected.

2 The Mixed-Use designation at this site incorporates the policies to develop
3 underutilized properties of the General Plan. Additionally, the proposal
4 adheres to the design guidelines within the General Pan that are required
5 of properties,. which are along Gateway designations.

7 4. The potential impacts of the proposed Amendment have been assessed and
8 have been determined not to be detrimental to the public health, safety or
9 welfare.

11 The Mixed Use designation will not create any negative traffic impacts to
12 the existing Level of Service at the intersection of Ellis Street and Sturcon
13 Way or Ellis Street and East Washington. The detailed traffic study
14 indicates that there would be less of an impact to these intersections if
15 office/commercial uses were to be developed at this site than if residential
16 uses were to occur at this location.

18 5. The proposed Amendment has been processed in accordance with the
19 applicable provisions of the California Government Code and the
20 California Environmental Quality Act (CEQA).

1 In compliance with the requirements of the California Environmental
2 Quality Act, an Initial Study was prepared for the General Plan
3 Amendment proposed for the site from Urban High to Mixed Use. Based
4 upon the Initial Study, a determination was made with the incorporation of
5 mitigation measures that no significant environmental effects would result.
6 A copy of this Notice was published in the Argus Courier and provided to
7 residents and occupants within 300 ft. of the site, in compliance with
8 CEQA requirements.
