s APPROVING THE PLANNED UNIT DISTRICT PLAN
6 FOR PARKWAY PLAZA .SHOPPING CENTER LOCATED
7 AT 701 SONOMA MOUNTAIN PARKWAY
8 ON A 7.13 ACRE PARCEL ON THE CORNER

14 WHEREAS, by Ordinance No. 2090 N.C.S., Assessor's Parcel Number 137-070-069
1 s comprising of a 7.13 acre parcel, have been rezoned to PUD (Planned Unit District); and
16
17 WHEREAS, by action taken on February 23, 1999, the Planning Commission considered
T8 and forwarded a recommendation to the City Council on the unit development plan for
19 Parkway Plaza Shopping Center, to allow development of a retail site; and
20
21 WHEREAS, the City Council finds that the requirements of the California Environmental
22 Quality Act (CEQA) have been satisfied through the preparation of an Initial Study and
23 adoption of Resolution No. 99-95 N.C.S., approving a Mitigated Negative Declaration to
24 address the specific impacts of the Parkway Plaza Shopping Center development;

26 WHEREAS, the City Council has reviewed the proposed PUD Development Plan, as set
27 forth in the attached Exhibit A, as revised or modified, and in accordance with the
28 recommendation of the Planning Commission, finds that:
29
30 1. The proposed Parkway Plaza Shopping Center results in a more desirable use of
31 land and a better physical environment than would be possible under any single
32 zoning district or combination of zoning districts.

l 2. The proposed Parkway Plaza Shopping Center development is proposed on a
2 property which has a suitable relationship to one or more thoroughfares (Sonoma
Mountain Parkway, Riesling Road and Capri Creek Court) and said thoroughfares
4 with the improvements herein required, are adequate to carry any additional
5 traffic generated by the development.

7 3. The plan for the Parkway Plaza Shopping Center development presents a unified
8 and organized arrangement of buildings and service facilities which are
9 appropriate in relation to adjacent or nearby properties. Adequate landscaping
to and screening is included to ensure compatibility with surrounding uses.
11 Conditions have been incorporated requiring design and development standards
12 that are compatible with neighboring developments.

14 4. Adequate available public and private spaces are designated on the PUD
15 Development Plan. Through mitigation measures and project conditions,
16 adequate building setbacks and other project amenities are provided.
17
18 5. The development of the subject Parkway Plaza project in the manner proposed by
19 the applicant, and as conditioned, will not be detrimental to the public welfare,
20 will be in the best interests of the City, and will be in keeping with the intent and
21 spirit of the zoning regulations of the City of Petaluma, with the Petaluma General
22 Plan and with the Corona/Ely Specific Plan.

24 6. The Parkway Plaza Shopping Center project is designed to be compatible with
25 surrounding uses.
26
27 7. The Parkway Plaza Shopping Center project will help the City further the
28 objectives, policies, and programs of the General Plan by providing jobs and
29 furthering economic goals.

1 WHEREAS, the PUD Development Plan shall go into effect concurrent with the effective
2 date of the rezoning as specified by Ordinance No. 2090 N.C.S..

4 NOW THEREFORE BE IT RESOLVED that the Parkway Plaza Shopping Center PUD
5 Development Plan as referred by the Planing Commission and presented at the April 12,
6 1999, meeting of this Council is hereby approved pursuant to Section 19A-504 of the
7 Zoning Ordinance No. 1072 N.C.S., as amended subject to the following conditions:

9 Conditions of PUD Development Plan
10
11 1. All mitigation measures adopted in conjunction with approval of the Mitigated
12 Negative Declaration (Resolution 99-95 N.C.S.) for the Parkway Plaza
13 commercial shopping center project are incorporated herein by reference as
l4 conditions of project approval. The project shall also comply with all applicable
15 mitigation's specified for properties within the Coronal/Ely Specific Plan Area as
16 contained in Resolution No. 89-122 N.C.S., which certified, approved and
17 adopted the Environmental Impact Report for the Corona/Ely Specific Plan.

19 2. At the time of final review by Site Plan and Architectural Review Committee
20 (SPARC) for approval of the PUD Development Plan, written PUD Development
21 Standards shall be met and shown on plans for building permit approval.
22
23 3. All requirements of the Building Division, Fire Marshal, Engineering, Police
24 Department and Public Works Departments shall be met and reflected on plans
25 submitted for development permit issuance.
26
27 4. A raised textured path shall be used for the bicycle/pedestrian path which extends
28 across the subject property, from the park access Riesling to the Tuxhorn
29 Subdivision. Pedestrian crosswalk lights/control devices shall be installed at
30 Riesling Road.

l 5. The developer shall be required to enlarge the entrance into the shopping center
2 on Sonoma Mountain parkway for easier ingress and egress. An acceleration and
3 deceleration (right turn-in) lane on Sonoma Mountain Parkway shall be provided.

5 6. The applicant shall be required to widen the entrance on Sonoma Mountain
6 Parkway for easier ingress and egress into the shopping center and provide am
7 acceleration and deceleration lane on Sonoma Mountain Parkway.

9 7. The applicant shall be required to use ground lighting wherever possible and non-
to transformer style lights or lights which or not noisy shall be used. The lights shall
11 be reviewed by the Site Plan & Architectural Review Committee (SPARC) prior
l2 to the issuance of a Certificate of Occupancy.

14 8. No parking shall be permitted on Riesling Road along the shopping center side.
15 The applicant shall be required prior to occupancy to paint the curbs red.
16
l7 9. More architectural detailing, trellis work and landscaping shall be provided to
18 soften the rear of Major Building "A" (the grocery store). The plans shall be
19 reviewed by the Site Plan & Architectural Review Committee (SPARC).
20
2l 10. The applicant shall be required to install, if possible, onsite vegetated swales to
22 help reduce the amount of waste petroleum products that may other wise get into
23 the storm drainage system.
24
25 11. More or continuous awnings shall be installed for summer and winter protection
26 of pedestrians along the walkways. The revisions shall be reviewed by the Site
27 Plan & Architectural Review Committee (SPARC).

1 12. The applicant shall be required to increase the number of evergreen trees on
2 Riesling Road and Sonoma Mountain Parkway. This shall be reviewed by the
3 Site Plan & Architectural Review Committee (SPARC) as part of the final
4 landscape plan.

6 13. The applicant shall be required to install street trees on the residential side of
7 Riesling Road to help soften the view of the shopping center.
8
9 14. The applicant is encouraged to explore the idea of second story office and/or
l0 residential uses above buildings "B" and "C".

12 15. Delivery trucks shall be encouraged by the store tenants to be routed from the
13 north and shall be discouraged from using East Washington Street.
14
15 16. Hours for delivery trucks shall be from 8:30 AM to 4:30 PM.
16
17 17. The Planned Unit Development Plan shall be modified to exclude the following
18 uses: auto service stations, entertainment/dancing establishments, convenience
19 markets, fast-food restaurants, veterinary clinics, auto part stores, fortune-telling
20 and related activities, auto repair, and car wash operations.
21
22 18. The applicants/developer shall defend, indemnify, and hold harmless the City or
23 any of its boards, commission, agents, officers, and employees from any claim,
24 action or proceeding against the City, its boards, commission, agents, officers, or
25 employees to attach, set aside, void, or annul, the approval of the project when
26 such claim or action is brought within the time period provided for in applicable
27 State and/or local statutes. The City shall promptly notify the applicants/
28 developers of any such claim, action, or proceeding. The City shall coordinate in
29 the defense. Nothing contained in this condition shall prohibit the City from
30 participating in a defense of any claim, action, or proceeding if the City bears its
31 own attorney's fees and costs, and the City defends the action in good faith.

1 The Engineering Department has reviewed the submittal of the Parkway Plaza (Gatti
2 Retail) application and requires the following conditions to be met:

4 1. Provide Sonoma County Water Agency approval for all drainage improvements.
5
6 2. Provide a detailed grading plan for improvements within the right of way and on
7 site including street improvements, utilities, earthwork, drainage and all
8 transitions at property lines.

l0 3. All existing and proposed easements associated with the subject development are
11 to be included on the plans..

t 3 4. Provide a fully dimensioned site plan as a portion of the improvement plans
14 including distances from property lines to buildings and parking. This site plan
15 shall also provide accurate metes and bounds of all property lines, radii of all
l6 curves, and central angles.

l8 5. Frontage improvements are required along Riesling Road, Sonoma Mountain
1.9 Parkway, and Capri Creek Cotu-t including City of Petaluma standard curb, gutter,
20 sidewalk, street lights, fire hydrants, catch basins, etc. Right of way dedication
21 may be required to incorporate such improvements.

23 6. All existing overhead utility lines and poles on-site and on peripheral streets shall
24 be identified and shown as being placed underground.
25
26 7. Identify the location and size of existin and proposed sanitary sewer, fire
27 hydrants, water mains, and storm drains on the plan both on site and along
28 adjacent streets. Include reference source (i.e. City of Petaluma file number) for
29 existing off-site existing utilities. The slopes and elevations of rp oposed sewers
3o and storm drains shall be indicated.

1 8. Provide the location of proposed building setback lines on the site plan.

3 9. An erosion control plan must be provided.

5 10. Water pressure calculations shall be required for this development verifying the
6 system adequacy for fire flows and domestic services.

8 11. All work in the public right-of--way requires an excavation permit from the
9 Engineering Department.

1 ~ 12. Provide a detailed landscaping plan as a portion of the improvement plans. Note
~ 2 that a separate water meter shall be required for landscape irrigation systems or as
~ 3 required by staff.

15 13. Driveway access to Sonoma Mountain Parkway, Riesling Road, and Capri Creek
16 Court shall be approved by the City Traffic Engineer.
17
18 14. Verify with the use of templates that delivery truck turning movements can be
19 achieved along the access drive and loading areas of the site plan.

2l 15. Surface drainage from the site shall not cross over sidewalks.
22
23 All requirements of the Building Division shall be met, including:
24
25 1. Grading must be certified when completed to indicate compliance with approved
26 plans and will be required for occupancy.
27
28 2. Certify pad elevations before building slab on grade. is poured.,
29
30 3. Soils with expansion index greater than 20 requires special design foundation per
31 Uniform Building Code 1803.2.

1 4. Mixed occupancy separation as described in Chapter 3 of the 1994 UBC must be
2 followed.

4 5. All roofing shall be "B' rated or better per Ordinance No. 174411988.

6 6. Show site drainage and grading topography.

8 7. Indicate all utilities on site plan.

10 8. Responsible party to sign plans.

12 9. Submit soils report to verify foundation design.

14 10. Indicate group occupancy, type of construction, square footage.

16 11. Plans must show compliance to 199 UBC, UPC, UMC, and 1993 NEC. Plans
17 must also show compliance to current Title 24 Energy Conservation and/pr
1 s Disabled Access Requirements.

20 12. Provide structural calculations for all non-conventional design items.
21
22 13. Demolition permit required to remove any structure.
23
24 14. Abandonment of water well or septic system must be done under permit from
25 County of Sonoma Public Health Department.

27 Fire Marshal:

29 1. Post address at or near main entry door -minimum four- (4) inch letters on
30 contrasting. background.

1 2. Address locator required to be posted at or near the driveway entrance.
2 Reflectorized numbers are acceptable. Location and design to be approved by the
3 Fire Marshal's office.

5 3. The building(s) shall be protected by an automatic fire extinguishing system as
6 required by the Uniform Fire Code.

8 4. Provide to the Fire Marshal's office, a minimum of two (2) sets of fire sprinkler
9 plans and calculations for approval and issuance of permit prior to installation of
10 system.
11
12 5. Sprinkler system shall be provided with central station alarm monitoring which
3 shall notify the fire department in the event of water flow. In addition, a local
l4 alarm shall be provided on the exterior and interior of the building..

16 6. Fire hydrants shall be spaced at a maximum of 300 feet apart. Location and type
17 of fire hydrants are to be approved by the Fire Marshal's office. Submit plans.
18
19 7. Add as a general note to plans:
20 a. No combustible construction is permitted above the foundation unless an
21 approved asphalt surfaced road is provided to within one hundred-fifty
22 (150') of the farthest point of a building or structure.
23 b. All fire hydrants for the project must be tested, flushed, and in service
24 prior to the commencement of combustible construction on the site.
25
26 8. Minimum fire flow required for this project. is 2500 gallons per minute at 20
27 pounds per square inch (psi).

1 9. All required fire lanes, in which no parking is allowed, shall be designated by
2 painting curbs red. Where no curb exist, signs approved by the fire marshal shall
3 be installed.

5 10. Provide electrical conduit from post indicator valve to alarm panel location for
6 tamper switch as underground improvements are being installed.
8 11. Contractor shall provide the Fire Marshal's office with two (2) sets of plans for
9 the underground fire service main for permit approval, prior to commencement of
10 work.

12 12. A two-inch clearance shall b~e provided around fire sprinkler lateral and riser at
13 foundation and floor slab.
