SUBJECT: Resolution Ratifying the Tentative Agreement Reached by the Duly Authorized
Representatives of the City of Petaluma and the Peace Officers' Association of
Petaluma
RECOMMENDATION
It is recommended that the City Council adopt the Resolution ratifying the Tentative Agreement
reached by the duly authorized representatives of the City Of Petaluma and the Peace Officers'
Association of Petaluma (POAP).
BACKGROUND
Section 4.1 of the POAP Memorandum of Understanding (MOU) effective July 1, 2015 —
June 30, 2017 provides for a wage re- opener for the purposes of a potential salary adjustment.
This action ratifies the Tentative Agreement reached by the parties.
DISCUSSION
The City and POAP met and conferred for the sole purpose of discussing whether a salary
adjustment may take place effective for fiscal year 2016/17 pursuant to Section 4.1 of the POAP
MOU. Prior to the commencement of negotiations, the parties updated the compensation survey
as required under Section 4.3 of the MOU. The survey showed Police Officer to be 7.01 %
behind the average of the comparator agencies as of April 2016.
The parties have reached a Tentative Agreement which may be found at Exhibit A. If ratified by
the City Council, all POAP - represented positions will receive a 3.5% equity adjustment effective
the pay period beginning September 25, 2016, as well as a one -time, non- PERSable cash
payment of $1,000. The parties also agreed to extend the current contract to June 30, 2018, and
re -open negotiations in April 2017 for the sole purpose of discussing a potential salary
adjustment during fiscal year 2017/18.
FINANCIAL IMPACTS
The cost for the 3.5% equity adjustment is approximately $292,000 to the General Fund for the
remainder of FY 2016 /17 and $388,500 annually. Cost of the $1,000 cash payment is $75,000,
for a total FY 2016/17 cost of $367,000. Ongoing resources related to fee updates, along with
one -time revenues received related to real property transfer taxes and mandated cost
reimbursements have been identified to fund the recommended costs.

RESOLUTION RATIFYING THE TENTATIVE AGREEMENT REACHED BY THE
DULY AUTHORIZED REPRESENTATIVES OF THE CITY OF PETALUMA AND
THE PEACE OFFICERS' ASSOCIATION OF PETALUMA
WHEREAS, the City of Petaluma, through its duly authorized representatives, and the Peace
Officers' Association of Petaluma (POAP), through its duly authorized representatives, have
concluded their mutual obligation to meet and confer in good faith with respect to the wage re- opener
provided by Section 4.2 of the POAP Memorandum of Understanding (MOU) effective
July 1, 2015 — June 30, 2017, in accordance with the Meyers - Milias -Brown Act and the City's
Employer - Employee Relations, Rules and Regulations (Resolution No. 55412 N.C.S.); and
WHEREAS, the duly authorized representatives of the City and the POAP have executed this
Tentative Agreement pursuant to Section 15, Resolution No. 5512 N.C.S. and recommend its approval by
the City Council; and
WHEREAS, the City Manager, pursuant to Section 28 of the Charter of the City of Petaluma,
and as the City's Municipal Employees' Relations Officer (Resolution No. 5375 N.C.S.), is required and
empowered to make a recommendation to the City Council on matters related to employees'
compensation; and
WHEREAS, the City Manager has reviewed and concurs with said Tentative Agreement for
POAP and does recommend that the City Council ratify said Tentative Agreement.
NOW, THEREFORE, BE IT RESOLVED that the Tentative Agreement, being in the best
interests of the City of Petaluma, is ratified and the terms and conditions of said Tentative Agreement,
attached to and incorporated as Exhibit A, shall be effective September 25, 2016.
EXHIBIT A
Agreement between
Police Officers' Association of Petaluma
and the City of Petaluma
Having met and conferred in good faith on the Wage Re- Opener provided in Section 4.1(b) of
the Police Officers' Association of Petaluma Memoranda of Understanding July 1, 2015 —
June 30, 2017, and in accordance with the Meyers- Milias -Brown Act and the City's Employer -
Employee Relations, Rules and Regulations (Resolution No. 55412 N.C.S.), the parties agree as
follows:
• All Unit 6 members shall receive a 3.5% equity adjustment effective September 25, 2016.
This equity adjustment shall not be retroactive nor adjusted to reflect a July I effective
date. Salary ranges shall be as specified in Exhibit A for each classification.
• All Unit 6 members shall receive a $1,000 one -time, non- PERSable cash payment in the
pay period following Council approval.
• The parties agree to extend the current contract to June 30, 2018.
• The parties agree to re -open negotiations in April 2017 for the sole purpose of discussing
a potential salary adjustment during fiscal year 2017118. The only item that is subject to
this re- opener is a potential salary adjustment. If an agreement on the wage re- opener is
not reached by the parties until after July 1, 2017, any salary adjustment shall be, at the
City's option, either retroactive to July 2, 2017, or adjusted to reflect the lost value going
forward as if the adjustment had been implemented on July 2, 2017. For example, if the
parties agreed to an adjustment of 2 %, but said adjustment is not implemented until
January of 2017, then the adjustment in January would be 4 %; if it were implemented in
October of 2016, it would be 3 %.
• In preparation for the wage re- opener, the City agrees to update the compensation survey
found at Section 4.3 of the MOU no later than April 1, 2017.
This agreement amends the current MOU, but it does not otherwise modify any other provisions
of the MOU regarding wages, hours or other terms and conditions of employment.
