S. 1 2 of the City of Petaluma, California 3 4 5 DENYING THE APPEAL AND CONFIRMING TIIE PLANNING COMMISSION 6 AND PLANNING DIRECTOR'S DETERMINATION TFIAT THE FERRIN 7 TENTATIVE PARCEL MAP IS NOT DEEMED APPROVED BY OPERATION 8 OF LAW UNDER TIIE SUBDIVISION MAP ACT, ANDiOR THE PERMIT 9 STREAMLINING ACT, FOR 2432, 2430, & 2494 I STREET, APN 019-401-013. to 11 12 WHEREAS, on June 8, 1999, the Planning Commission held a public hearing, heard 13 testimony and reviewed the appeal by the appellant regarding the Planning Director's 14 determination that the Ferrin Tentative Parcel Map is not deemed approved by operation 15 of law under the Subdivision Map Act, and/or the Permit Streamlining Act, for 2432, 16 2430 & 2494 "I" Street; and 17 18 WHEREAS, on June 8, 1999, the Planning Commission denied the appeal and upheld the 19 Planning Director's determination that the Ferrin Tentative Parcel Map is not deemed 20 approved by operation of law under the Subdivision Map Act, and/or the Permit 21 Streamlining Act, for 2432, 2430 & 2494 "I" Street; and 22 23 WHEREAS, that denial was appealed by the applicant, Diane Allen, to the City Council 24 on June 22, 1999, and 25 26 WHEREAS, the City Council held a public hearing, heard testimony on July 19, 1999, 27 and 28 Resolution No. 99-)_ 4 8 N.C.S. 4laA~e. 1 of 2 1 1 WHEREAS the City Council further finds that the denial of the appeal by the Planning 2 Commission is based on the following finding: 3 4 That concerns raised by the public regarding potential environmental impacts related to 5 the construction of two new hammerhead turn-arounds warrants the preparation of an 6 Initial Study, and therefore, the project is not categorically exempt from the California 7 Environmental Quality Act. 8 9 NOW THEREFORE, BE IT RESOLVED, that the City Council hereby denies the appeal to by the appellant regarding the Planning Commission's determination that the Ferrin 11 Tentative Parcel Map is not deemed approved by operation of law under the Subdivision 12 Map Act, and/or the Permit Streamlining Act, for 2432, 2430 & 2494 "I" Street, based on 13 the following finding: ]4 15 That concerns raised by the public regarding potential environmental impacts related to 16 the construction of two new hammerhead turn-arounds warrants the preparation of an 17 Initial Study, and therefore, the project is not categorically exempt from the California l 8 Environmental Quality Act. 19 Under the power and authority conferred upon this Council by the Charter of said City.
