WHEREAS, by action taken on December 14, 2010.the Planning Commission at a duly noticed public hearing considered the proposal and forwarded a recommendation to the City Council to approve the rezoning; and WHEREAS, the City Council finds that the requirements of the California Environmental Quality Act (CEQA) have been satisfied through the preparation of an Initial Study and approval of a Mitigated Negative Declaration and Mitigation Monitoring and Reporting Program to address the specific impacts of the PEP Wood Sorrel Senior Housing Project; and WHEREAS, on February 7, 2010, the City Council held a duly noticed public hearing to consider the zoning ordinance amendment of the subject properties from Planned Community District and Planned Unit District .to R-5, and NOW 'THEREFORE, BE IT ORDAINED that the Petaluma City Council hereby ;approves the ,reclassification of the subject parcels from Planned Community ,District and Planned Unit District to R-5 for the Project based on the. findings made below: 1. The proposed amendment to the Implementing Zoning Ordinance to Rezone the subject properties. from PUD -Planned Unit District (APN137-170-037) and PCD -Planned Community District (APN 137-061-023) to R-5 is consistent with and implements the High Density Residential land use classification of the General Plan. 2. The proposed rezoning to R-5 is consistent with the Petaluma General Plan Housing Element .policies which direct the City: to continue to work with non-profit housing 15 organizations to benefit from their expertise in and resources for developing and supporting affordable housing (nearly all affordable housing projects in the city have been developed in partnership with non-profit organizations such as Burbank Housing Development Corporation, Eden Housing, and Petaluma Ecumenical Properties). I The public necessity, convenience and general welfare clearly permit and will be furthered by the proposed amended Planned Unit District and Planned Community District zoning to R-5 in that the amended zoning designation will result in residential uses that are appropriate and compatible with the existing surrounding uses; permit a project design that provides a greater useable open and community space, increase the City's affordable housing stock; and provide infill residential development of fairly high intensity that is close to public transportation and services, furthering the City's greenhouse gas reduction efforts and climate protection goals. The project plans present ,a unified and organized arrangement of lots and public streets, appropriate to adjacent And nearby properties. Proposed landscaping would further ensure compatibility. The proposed project would also require Site Plan and Architectural Review and approval by the Planning Commission. 4. The requirements of the California Environmental Quality Act (CEQA) have been satisfied through the preparation of an Initial Study and Mitigated Negative Declaration for the Project. Mitigation measures have been proposed and agreed to by the applicant that will reduce potential impacts to less than significant. A copy of the notice of intent to adopt a mitigated negative declaration was published in the Argus Courier and provided to residents and occupants within 500 feet of the site, in compliance with CEQA requirements. i INTRODUCED and ordered Posted/Published this day of ADOPTED this day of , 2011, by the following vote: AYES: NOES: ABSENT: ABSTAIN: Irt . . _''a `,,. v ._.. w . i '.. ._ __ • Y. . . - .. .. _ ._, w .1•i .. .. ...a. .... .• .n .....i .. .S.' 8.. .-. i. wi ....u.—n"_.Y_ .rTJ..._ ' ...._ . -CT DESCRIPTION PROJE Zoning Ordinance Amendmen'j Rezone the subject parce.1s from PCD (Planned Community D'istrict) and PU-D (Planed Unit District) to R-5 (Multi Family) Site Pla,.n and Architectural Review, a 50 residential units of senior housing Associated landscaping improvements, common areas such as.. the CorMmunity room, community gardens, aInd horseshoe pits for W the residents )0 ITE PLAN ------------------------------------- ---------------------------------------- 0 ----------------------- NORTH MCDOWELL BOULEVARD WOOD SORREL SENIOR APARTMENTS A PEP HOUSING COMMUNITY WOOD SORREL DRIVE and VARBERRY DRIVE,,PEI'ALUMA CONCEPTUAL SITE PLAN 9UNRI3E a FE„LLUM„ OJECTOATA RS 20NINO REQUIRE wE TIERNEY/FIGUEIREDO ® ARCHITECTS uMAIA ........... Jjp lllj III Z ING & GENERAL PLAN 0 N lm- ZONING, Planned Unit District — (Parcel # 1.37-170-037.) and Planned Community District — (Parcel 137-061-023) No development standards were ever adopted under the current zoning designation.
