SUBJECT: Resolution Ratifying the Tentative Agreement Reached by the Duly Authorized
Representatives of the City of Petaluma and the Petaluma Public Safety Mid -
Management Association —Unit 10
RECOMMENDATION
It is recommended that the City Council adopt the attached Resolution Ratifying the Tentative
Agreement Executed by the Duly Authorized Representatives of the City of Petaluma and the
Petaluma Public Safety Mid - Management Association.
BACKGROUND
The Petaluma Public Safety Mid - Management Association (PPSMMA) Memoranda of
Understanding (MOU) is effective July 1, 2014 through June 30, 2017. Section 6.2 of the MOU
provides for a wage reopener for the purpose of discussing a potential salary adjustment for the
fiscal year 2016 -2017. The City has met and conferred with PPSMMA representatives and the
parties have reached a Tentative Agreement. The recommended action ratifies the Tentative
Agreement reached by the parties. The Tentative Agreement is attached as Exhibit A to the
Resolution.
DISCUSSION
The City and the PPSMMA have met and conferred and reached a Tentative Agreement on
wages, cost off -sets, and term. The Tentative Agreement is similar to the wage reopener
agreement ratified with the Petaluma Peace Officers Association. The tentative agreement
includes a base wage adjustment of 3.5 %, effective the pay period beginning November 6, 2016,
and a non - PERSable cash payment of $1,000. As well, members of PPSMMA will continue to
provide the cost off -set of a 50% reduction in the number of Administrative Leave hours
available for annual cash -out. PPSMMA has also agreed to extend the MOU for one additional
year, to June 30, 2018, with a wage reopener for FY 2017 -2018.
FINANCIAL IMPACTS
All costs are attributable to the General Fund. The estimated cost of the Agreement for the
remainder of this fiscal year, including cost off -sets, is $54,842. The estimated cost of the base
wage adjustment for the remainder of the fiscal year is $55,792, with an estimated on -going
annual cost of $76,725. The estimated one -time cost of the non - PERSable cash payment is
$9,913. The estimated cost off -set for the reduction in available annual cash -out hours is
<$10,863> for the current fiscal year. Ongoing resources related to fee updates, along with one-
time revenues received related to real property transfer taxes and mandated cost reimbursements
have been identified to fund the recommended costs.

RESOLUTION RATIFYING THE TENTATIVE AGREEMENT REACHED BY THE
DULY AUTHORIZED REPRESENTATIVES OF THE CITY OF PETALUMA AND
THE PETALUM PUBLIC SAFETY MID - MANAGEMENT ASSOCIATION
WHEREAS, the City of Petaluma, through its duly authorized representatives, and the
Petaluma Public Safety Mid - Management Association ( PPSMMA), through its duly authorized
representatives, have concluded their mutual obligation to meet and confer in good faith with
respect to the wage re- opener provided by Section 6.2 of the PPSMMA Memorandum of
Understanding (MOU) effective July 1, 2014 — June 30, 2017, in accordance with the Meyers -
Milias -Brown Act and the City's Employer - Employee Relations, Rules and Regulations
(Resolution No. 55412 N.C.S.); and
WHEREAS, the duly authorized representatives of the City and the PPSMMA have
executed this Tentative Agreement and recommend its approval by the City Council; and
WHEREAS, the City Manager, pursuant to Section 28 of the Charter of the City of
Petaluma, and as the City's Municipal Employees' Relations Officer (Resolution No. 5375
N.C.S.), is required and empowered to make a recommendation to the City Council on matters
related to employees' compensation; and
WHEREAS, the City Manager has reviewed and concurs with said Tentative Agreement
for PPSMMA and does recommend that the City Council ratify said Tentative Agreement.
NOW, THEREFORE, BE IT RESOLVED that the Tentative Agreement, being in the
best interests of the City of Petaluma, is ratified and the terms and conditions of said Tentative
Agreement, attached to and incorporated as Exhibit A, shall be effective on the pay period
beginning November 6, 2016.
Wage Reopener
Petaluma Public Safety Mid - Management Association -- Unit 10 MUU
1) Base wage increase 3.5 %, effective the pay period beginning November 6, 2016.
2) $1000 Non- PERSable cash payment, applied in the pay period beginning November 6, 2016.
3) 1 Year extension of current contract, to June 30, 2018.
4) Continuation of off -set that reduces the number of hours of Administrative Leave available
for annual cash -out. This shall be same language as in current MOU (section 12.1 and 12.3)
with date changes to reflect the effective period as FY 2016 -17.
5) Wage reopener in May of 2017 for the sole purpose of discussing whether a potential salary
adjustment will take place during the fiscal year 2017 -2018.
