HomeMy WebLinkAboutResolution 99-168 N.C.S. 08/16/1999 ~ , I~eSOlUt10I1 lr o. 99-168 l~l .C.~. 2 of the City of Petaluma, California 3 4 5 RESOLUTION ADOPTING A NEGATIVE DECLARATION 6 FOR THE REZONING OF THE DOWNTOWN COMMERCIAL 7 .DISTRICT TO APPLY AN HISTORIC OVERLAY ZONING DISTRICT, FOR 8 THE AMENDMENTS TO ARTICLE 17 OF THE ZONING ORDINANCE, 9 AND FOR THE ADOPTION OF THE PETALUMA 1o HISTORIC COMMERCIAL DISTRICT DESIGN GUIDELINES 11 12 13 WHEREAS, the Planning Commission held a public hearing on the proposed Rezoning, Zoning 14 Ordinance Amendment, Petaluma Historic Commercial District Design Guidelines, and Negative 15 Declaration. on June 8, 1999, after giving notice of said hearing, in the manner, for the period, 16 and in the form required by Ordinance No.. 1072 N.C.S., as amended; and 17 18 WHEREAS, at the end of the public hearing the Planning Commission voted 5-0, with one 19 abstention, to recommend that the City Council adopt a Negative Declaration and approve the 20 project; and 21 22 WHEREAS, the City Council held a public hearing on the proposed project on August 16, 1999, 23 after giving notice of said hearing in a manner, for the period, and in the form required by 24 Ordinance No. 1072 N.C.S., as amended; and 25 26 WHEREAS, the City Council finds that, pursuant to Article 6, Negative Declaration Process, of 27 the California Environmental Quality Act (CEQA) Guidelines, the requirements of CEQA have 28 been satisfied through the preparation of an Initial Study, and that a Negative Declaration is 29 appropriate to the project, based on the following findings: 30 31 1. That pursuant to Article 6, Negative Declaration Process, of the California Environmental 32 Quality Act (CEQA) Guidelines, the requirements of CEQA have been satisfied through 33 the preparation of an Initial Study, and a Negative Declaration is appropriate to the 34 project. 35 Resolution No. 99-168 N.c.s. Page 1 oft 1 2. That no development projects are proposed with this project. Therefore, based upon the 2 Initial Study, there is no substantial evidence that the project would have a significant 3 effect on the environment. 4 5 3. That the project does not have the potential to affect wildlife resources as defined in the 6 Fish and Game Code, either individually or cumulatively, and is exempt from Fish and 7 Game filing fees because the subject area is a fully developed commercial district and no 8 projects are proposed at this time. 9 10 4. That the project is not located on a site listed on any Hazardous Waste Site List compiled 11 by the State pursuant to Section 65962.5 of the California Government Code. 12 13 5. That the Planning Commission reviewed the Initial StudylNegative Declaration and 14 considered public comments before making a recommendation on the protect. 15 16 6. That the record of proceedings of the decision on the project is available for public 17 review at the City of Petaluma Planning Department, City Hall, 11 English Street, 18 Petaluma, California. 19 20 NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Petaluma does 21 hereby adopt a Negative Declaration for the Rezoning of the Downtown Commercial District to 22 apply an Historic Overlay Zoning District, for amendments to Article 17 of the Zoning 23 Ordinance, and for the adoption of the Petaluma Historic Commercial District Design 24 Guidelines. Under the power and authority conferred upon this Council by the Charter of said City.
