SUBJECT: Resolution Authorizing Grading for the Residences at Riverfront Subdivision
(Phase I) Prior to Final Map Approval.
RECOMMENDATION
It is recommended that the City Council adopt a Resolution Authorizing Grading for the
Residences at Riverfront Subdivision (Phase I) Prior to Final Map Approval.
BACKGROUND
The Residences at Riverfront Subdivision (Phase I) consists of 19 single family homes and is
part of the overall Riverfront development. The subdivision received tentative map approval by
the City Council on July 7, 2014. The final map and improvement plans have been submitted to
the City of Petaluma and are currently in the review process. The developer, Comstock Homes,
is requesting permission to commence grading activity on the subdivision site prior to final map
approval.
According to section 20.36.010 of the Petaluma Municipal Code, no permanent improvement
work shall be commenced until improvement plans and profiles have been approved by the City
Engineer, and a subdivision improvement contract has been executed in writing between the
subdivider and the City. These approvals follow the Council's approval of the final map for this
phase of the project, which has not yet occurred. The project final map is anticipated to come
before the City Council for consideration in late winter /early spring of 2017. While grading is
not considered a permanent improvement as defined in this section, the City requires the
developer to enter into a grading agreement and provide a surety to secure the performance of
any grading work that occurs prior to the final subdivision improvement contract.
DISCUSSION
The purpose of the recommended resolution is to allow the Residences at Riverfront (Phase I)
site to be rough graded and the underlying soils to be prepared for construction in advance of
issuance of permits for site and building improvements, which are currently scheduled to start
spring of 2017. A portion of the Riverfront Subdivision, in the Hopper Street and mixed -use area
is currently under construction. The grading plan for the Residences at Riverfront (Phase I) has
been carefully reviewed and is approved for construction pending City Council authorization.
The geotechnical report required for rough grading was reviewed and the report
recommendations are appropriate for the grading request and final development proposal.
If the subdivider fails to secure final map approval, or the project is abandoned after the grading
is complete, the subdivider is required to restore the graded area to its prior condition as stated in
the grading agreement.
FINANCIAL IMPACTS
The final map and improvement plan applications for the Residences at Riverfront Subdivision
(Phase I) are subject to cost recovery. Costs for staff time spent reviewing the grading prior to
final map approval, in addition to the final map and improvement plan review, are 100%
recovered through application deposits submitted by the developer. This action does not impact
the General Fund.

RESOLUTION AUTHORIZING GRADING FOR THE RESIDENCES AT
RIVERFRONT SUBDIVISION (PHASE I) PRIOR TO FINAL MAP APPROVAL
WHEREAS, the developer, Comstock Homes, has requested permission to grade the
Residences at Riverfront Subdivision (Phase I) site at 500 Hopper Street prior to final map
approval; and,
WHEREAS, the developer agrees to comply with the City Grading and Erosion Control
Ordinance No. 1576 NCS and Storm Water Ordinance No. 2209 NCS; and,
WHEREAS, the developer agrees to comply with the Regional Water Quality Control
Board's policies, file a Notice of Intent and prepare a Storm Water Pollution Prevention Plan;
and,
WHEREAS, the developer agrees to enter into a grading agreement and provide surety
to secure the performance of the grading work; and,
WHEREAS, the developer shall obtain a grading permit from the Building Department
prior to performing any grading work.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Petaluma as
follows:
Grading of the Residences at Riverfront Subdivision (Phase I) prior to final map
approval is authorized, conditioned on:
a. The developer's first entering into a grading agreement with the City and
providing security satisfactory to the City to secure performance of the
grading work.
b. The developer's first obtaining a grading permit from the City's Building
Department.
c. The developer's first filing a Notice of Intent and preparing a Storm Water
Pollution Prevention Plan and developer's compliance with the requirements
of the Regional Water Quality Control Board.
d. The developer's compliance with the City's Grading and Erosion Control
Ordinance, No. 1576 NCS and its Storm Water Ordinance, No. 2209 NCS.
2. The City Manager is authorized to execute agreement documents as necessary and
appropriate to implement the authorization contained in this resolution.

Final Map and Improvement plans. We ask this to best prepare for winter conditions and make best use
of our time prior to the full subdivision plan approvals. The property is located near the intersection of
Caulfield and Hopper street.
