HomeMy WebLinkAboutResolution 99-205 N.C.S. 10/18/1999 1 Resolution No. 99-205 N.C.S. 2 of the City of Petaluma, California 3 4 RESOLUTION DETERMINING THAT A PROJECT AREA 5 COMMITTEE SHALL NOT BE FORMED 6 IN CONNECTION WITH THE PROPOSED AMENDMENT 7 TO THE PETALUMA COMMUNITY DEVELOPMENT 8 REDEVELOPMENT PROJECT 9 10 11 WHEREAS, the Community Development Commission of the City of Petaluma, 12 California (the "Commission") is preparing a proposed amendment (the "Amendment") to the 13 Redevelopment Plan for the Petaluma Community Development Redevelopment Project (the 14 "Project"); and l5 16 WHEREAS, Section 33385.3 of the California Community Redevelopment Law (Health 17 and Safety Code Section 33000 et seq.) requires that a project area committee be formed if none 18 exists and a redevelopment agency proposes to amend a redevelopment plan to (1) grant 19 authority to the agency to acquire by eminent domain property on which persons reside in a 20 project area in which a substantial number of low and moderate income persons reside or (2) add 21 territory in which a substantial number of low and moderate income persons reside and grant 22 authority to the agency to acquire by eminent domain property on which persons reside in the 23 added territory; and 24 25 WHEREAS, the proposed Amendment does not grant new eminent domain authority or 26 add territory as described in Section 33385.3; 27 28 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PETALUMA, 29 CALIFORNIA DOES HEREBY RESOLVE AS FOLLOWS: 30 31 Section 1. The City Council hereby finds and determines that the proposed 32 Amendment will not grant new authority to the Agency to acquire by eminent domain property 33 in the Project Area on which persons reside or (2) add territory to the Project Area. The City Resolution No. 9 9-2 05 x c s Page 1 of 2 w 1 Council further determines that a project area committee shall not be formed in connection with 2 the proposed Amendment. 3 4 Section 2. The Executive Director of the Agency is hereby authorized and directed to 5 consult with and obtain the advice of residents and community organizations within the Project 6 Area and provide such residents and organizations with the Amendment prior to its submission 7 to the City Council. Under the power and authority conferred upon this Council by the Charter of said City.
