4 RESOLUTION ESTABLISHING RATES, FEES AND
5 FINES FOR OPERATION AND MAINTENANCE OF THE WASTEWATER UTILITY

7 WHEREAS, the City of Petaluma operates and maintains a wastewater collection,
8 treatment, disposal and recycling system;
9 WHEREAS, changes to the rates and fees for use of the wastewater system have been
to proposed;
11 WHEREAS, the proposed changes were printed in the Argus Courier on October 13 and
12 October 20, 1999;
13 WHEREAS, the City Council conducted a duly noticed public meeting on November 1,
~4 1999 and heard and considered public comment on the proposed rates and fees at duly noticed
15 public hearings on November 15 and December 6, 1999;
~ 6 NOW THEREFORE IT BE RESOLVED that the City Council of Petaluma, California
repeals Resolution Nos. 87-114, 96-65 and 97-38 and establishes the following rates, fees and
18 fines for operation and maintenance of the wastewater utility:

20 ARTICLE I
2t GENERAL
22 SECTION 1.1 PURPOSE. (A) Revenue. The purpose of the wastewater service
23 charge is to raise revenue for the cost of operation and maintenance of the City of Petaluma's
24 wastewater utility used for the collection, treatment, disposal, and recycling of domestic
25 wastewater, industrial wastewater, commercial wastewater, and for payment of principal and
26 interest on bonds and capital recovery costs.
27 (B) Resolution. The purpose of this resolution is to establish a method of sharing the
28 cost of the operation and maintenance of the City's wastewater utility among the users of
29 wastewater service.

2 ARTICLE II
3 DEFINITIONS
4 SECTION 2.1 DEFINITIONS. Definitions of language used in this resolution shall be as
5 set forth in 15.44 through 15.76 of the Petaluma Municipal Code and as specified herein.
6 "Accessory Dwelling" means as specified in Article 21 of the Petaluma Zoning
7 Ordinance.
8 "Dwelling Unit" means:
9 (a) any single-family residential dwelling. or mobile home designed for occupancy by
10 one family, each of which shall be deemed equivalent to one dwelling unit, and
11 (b) any duplex, triplex, fourplex, townhouse or condominium, apartment house,
12 mobile home park or other multi-residential establishment, designed for occupancy for living
13 purposes by more than one family, which is divided into separate residential units, each of which
14 is designed for occupancy by one family only, each resident unit shall be deemed equivalent to
t 5 one dwelling unit.
l6 "Residential User" means any single-family residential dwelling or mobile home
17 designed for occupancy by one family, and any duplex, triplex, fourplex, townhouse or
18 condominium, apartment house, mobile home park or other multi-residential establishment,
19 designed for occupancy for living purposes by more than one family, which is divided alto
20 separate residential units, each of which is designed for occupancy by one family only.

22 ARTICLE III
23 RATES
24 SECTION 3.1 RESIDENTIAL USERS. (A) January 3, 2000. Starting January 3,
25 2000, the rate shall be $20.75 per month for each dwelling unit.
26 (B) January 2, 2001. Starting January 2, 2001, the rate shall be $25.75 per month for
27 each dwelling unit
28 (C) January 2, 2002. Starting January 2, 2002, the rate shall be $30.75 per month

1 (1) Januar~3, 2000. Starting January 3, 2000, the rate shall be the greater of:
2 (a) $20.75 per month for each account, or
3 (b) A fixed fee of $3.57 per month plus $2.11 for each 100 cubic feet (CCF) of water
4 used multiplied by the strength factor by user classification for Minor Users as defined in Section
5 15.64.020 of the Municipal Code.
6 (2) Januar~2, 2001. Starting January 2, 2001, the rate shall be the greater of:
7 (a) $25.75 per month for each account, or
8 (b) A fixed fee of $4.52 per month plus $2.60 for each 100 cubic feet (CCF) of water
9 used multiplied by the strength factor by user classification for Minor Users as defined in Section
~ 0 15.64.020 of the Municipal Code.
11 (3) January 2, 2002. Starting January 2, 2002, the rate shall be the greater of:
l2 (a) $30.75 per month for each account, or
13 (b) A fixed fee of $5.69 per month plus $3.07 for each 100 cubic feet (CCF) of water
14 used multiplied by the strength factor by user classification for Minor Users as defined in Section
15 15.64.020 of the Municipal Code.

18 (B) Permitted Industrial Users.
19 (1) January 3, 2000. Starting January 3, 2000, the rate shall be the greater of:

3 (3) January 2, 2002. Starting January 2, 2002, the rate shall be the greater of:
4 (a) $30.75 per month for each account, or
5 (b) A fixed fee of $5.69 per month plus $3.07 for each 100 cubic feet (CCF) of water
6 used or discharged.
7 (4) Hi hg_Strength Surcharge. (a) Surcharge Thresholds. In addition to the
8 charges set forth herein, Permitted Industrial Users whose wastewater is sampled and analyzed,
9 and exceeds the thresholds set forth as follows, a high strength surcharge will be imposed as
1 o provided in Chapter 15.64 of the Petaluma Municipal Code and as specified herein.

2 (C) Sample Collection and Laborator~ysis. The City shall charge for samples
3 collected by the City and analyzed by the City or an outside laboratory for the purpose of
4 determining wastewater surcharges or as violation follow-up sampling. Charges shall be
5 assessed for collecting the sample and for laboratory analysis of the sample.
6 (1) Collection Charges. (a) For the Purpose of Determining Wastewater
7 Surcharges. The charge for collecting a "grab" sample shall be $60. The charge for collecting a
8 "composite" sample shall be $235..
9 (b) For Violation Follow-Up Sampling. The charge for collecting a "grab" sample
to shall be $90. The charge for collecting a composite sample shall be $350.
l 1 (2) Laborato~ysis Char es. (a) Outside Laboratories. Samples
12 analyzed by outside laboratories shall be charged at cost per sample.

t (b) City Laboratory. Samples analyzed by the City's laboratory for conventional
2 pollutants shall be $125 per sample.
3 (D) Example Calculation of Wastewater Charge. Illustrated below is an example
4 calculation of the user fee and high strength surcharge for a Permitted Industrial User whose
5 wastewater, when discharged into the City's wastewater utility, has concentrations that exceed
6 the threshold level for BOD as setforth herein. The example calculates the charge for the rate
7 structure after January 2000, January 2001 and January 2002.

3 SECTION 3.3 OTHER SPECIAL DISCHARGES. (A) Septic Waste. Discharge of
4 septic waste shall be charged at $0.194 per gallon of discharge. Discharge may not occur
5 without a permit.
6 (B) Short-Term Discharge. A short-term discharge fee is hereby established at
7 $0.05 per gallon, with a $500.00 minimum fee, plus a permit fee of $100.00. These fees shall
8 apply to direct temporary discharges from a point of discharge for which a City connection
9 charge is inapplicable or for which connection charges sufficient to address the temporary
1 o discharge have not been paid, including, but not limited to, temporary discharges of
1 l groundwater. Discharge may not occur without a permit and may not continue for more than one
12 year from the effective date of permit. If the discharge period does continue beyond one year,
13 discharger will be assessed applicable and then-current wastewater service and connection fees.
14 The decision to accept any such temporary discharge and all requirements pertaining to the

1 acceptance of such temporary discharge, wastewater service charges, shall be based on an
2 evaluation of the effect on capacity, compliance with regulations, and any other factors that
3 could affect the overall operations of the wastewater treatment facility. Such discharges shall
4 fully comply with all applicable federal, state and local laws, regulations and orders, including,
5 but not limited to, the City's sewer use regulations as described in Sections 15.48 through 15.76
6 of the Petaluma Municipal Code.
7 SECTION 3.4 RATES FOR WASTEWATER USERS OUTSIDE OF THE CITY
8 LIMITS. (A) Residential Users. Residential users outside of the City limits shall be
9 charged $0.80 per month for each dwelling unit in addition to the charge setforth in Section 3.1.
l o (B) Non-Residential Users. Non-residential users outside of the City limits shall
11 be charged $0.80 per month for each account in additional to the charge setforth in Section 3.2.

l s ARTICLE IV
l6 ADMINISTRATIVE FINES
17 SECTION 4.1 GENERAL. Any user discharging wastewater in excess of the
18 wastewater strength limitations specified in Section 15.48.030 of the Petaluma Municipal Code
19 and as specified herein shall be subject to the following fine schedule. If more than one violation
20 of the same limit occurs within one calendar month, the largest exceedence shall be used to
21 determine the fine.
22 SECTION 4.2 FINES. (A) Initial Fine For Violations. (1) Calculation.
23 Initial fines shall be calculated as follows:

1 ARTICLE V
2 WASTEWATER CONNECTION FEES
3 SECTION 5.1 GENERAL. Connection may be made to the City's wastewater
4 collection system trunk lines in locations approved by and subject to the regulations of the City
5 Council, upon payment to the City of the connection fees specified below and other
6 specifications hereinafter indicated.
7 SECTION 5.2 CONNECTION FEES. (A) Residential Customers. The
8 connection fee shall be $3,046 per dwelling unit.
9 (B) .Accessory Dwelling. The connection fee shall be $1,195 per dwelling unit.
10 (C) Non-Residential Customers. (1) Formula. The wastewater connection
11 fee for non-residential customers shall be based upon the daily flow, BOD and SS of the
12 wastewater being discharged, except the minimum fee shall be same for residential customers
13 per Section 5.2(A). These three parameters shall be applied to the following formula and
14 associated unit costs to determine the connection fee:
15 Fee = (DF) x ($13.01/gpd) + ($810.21/lb) x (BOD x DF x (1/1,000,000) x 8.34)

22 mg/L =milligrams per liter
23 (2) Loading Parameters. Values for DF, BOD and TSS shall be estimated using
24 Table 5-1. The "Type of Business/Industry" to be used as the basis for the calculation shall be as
25 determined by the Director of Water Resources and Conservation or his/her designee.
26 (3) ,Reconciliation. After connection, the City shall monitor and track the
27 customer's flow based on water use meter readings for a reconciliation period not to exceed one
28 year. After the reconciliation period, the City shall recalculate the connection fee using the BOD
29 and TSS values estimated in Table 5-1 and the actual average flows as monitored and recorded
3o by the City.

1 (a) Difference Less Than or Equal To $250. If the difference between the
2 recalculated connection fee and the original connection fee is less than or equal to $250, no
3 reconciliation shall be made.
4 (b) Difference Greater Than $25 L If the recalculated connection fee exceeds
5 the original connection fee paid by $251 or more, the customer shall pay the total difference
6 between the original connection fee paid and the recalculated connection fee. If the recalculated
7 connection fee is less than the original connection fee paid by $251 or more, the City shall refund
8 the total difference between the original connection fee paid and the recalculated connection fee.
9 (D) Connection Fee on Rebuilding, Remodelin og r Expansion of Existing Non-
1o Residential Customer Facilities. In the event of any expansion, remodeling or rebuilding of
11 any non-residential building, structure, or premises, currently connected to the wastewater
12 system, in a manner which increases the loading parameters, an additional connection fee shall
13 be due at the time of issuance of the building permit. This additional connection fee shall be
14 calculated as follows:

17 "ACF" is the additional connection fee;
i s "NCF" is the new connection fee calculated per Section 5.2(C) with the values of
19 the loading parameters (PDF, BOD and TSS) to be determined based on the
20 facility after the expansion, remodeling or rebuilding (note: this is not to be the
21 incremental increase in loading - it is to represent the total loading of the facility);
22 and
23 "OCF" is the old connection fee calculated per Section 5.2(C) with the values of
24 the loading parameters to be based on the facility prior to any expansion,
25 remodeling or rebuilding.
26 (E) Annual Economic Adjustment To Connection Fee. On July 1 of each year,
27 commencing on July 1, 2001, the connection fees and unit costs described herein shall be
28 adjusted to account for increases or decreases in the index set forth below. The connection fees
29 and unit costs shall be adjusted as follows.

1 (1) Annual Economic Adjustment To Connection Fee For Residential Customers.
2 The connection fee for residential customers shall be adjusted in accordance with the
3 following formula:

5 Wherein,
6 "NCFRes" is the new or adjusted connection fee for residential customers for the
7 upcoming fiscal year;
8 "OCFRes" is the connection fee in effect during the current fiscal year; and
9 "ENR Annual Change" is the percentage change in the Engineering News Record
10 Construction Cost Index for the San Francisco area from December for the second
11 prior calendar year to December for the prior calendar year.
l2 (2) Annual Economic Adjustment To Connection Fee For Accessory Dwellings.
13 The connection fee for accessory dwellings shall be adjusted in accordance with the
14 following formula:

16 Wherein,
17 "NCFAcc" is the new or adjusted connection fee for accessory dwellings for the
18 upcoming fiscal year;
19 "OCFAcc" is the connection fee in effect during the current fiscal year; and
20 "ENR Annual Change" is the percentage change in the Engineering News Record
21 Construction Cost Index for the San Francisco area from December for the second
22 prior calendar year to December for the prior calendar year.
23 (3) Annual Economic Adjustment To Connection Fee For Non-Residential
24 Customers. The unit costs for DF, BOD and TSS used in calculating the connection fee for
25 non-residential customers shall each be adjusted in accordance with the following formula:

28 "NUC" is the new or adjusted unit cost for PDF, BOD or TSS for non-residential
29 customers -for the upcoming fiscal year;

1 "OUC" is the unit cost for PDF, BOD or TSS in effect during the current fiscal
2 year; and
3 "ENR Annual Change" is the percentage change in the Engineering News Record
4 Construction Cost Index for the San Francisco area from December for the second
5 prior calendar year to December for the prior calendar year.
6 SECTION 5.3 COMPUTATION AND PAYMENT OF CONNECTION FEES.
7 (A) General. The Director of Water Resources and Conservation or his/her
8 designee shall compute all fees set forth in Section 5.2. Payment for the connection fees shall be
9 made in full prior to the actual issuance of the building permit for the structure, work or
1o improvement proposed to be connected to the wastewater system, with the exception of a Car
11 Wash, Garden/Nursery and a Laundry Facility, as noted on Table 5-I, wherein the basis for the
12 comnection fee shall be actual water usage.
13 (B) Computation of Water Usage Based Connection Fee For Car Wash,
14 Garden/Nursery and Laundry Facility The connection fee for a Car Wash, Garden/Nursery
15 and a Laundry Facility shall be based on actual water usage, as shown on Table 5-1. For these
l6 facilities, the City shall measure actual water usage for a time period as determined by the
17 Director of Water Resources and Conservation or his/her designee, but not to exceed a period of
18 one (1) year. This measured water usage, along with the loading parameters shown in Table 5-l,
19 shall be the basis for calculation of the connection fee. A connection fee in the amount equal to
20 that of Residential customers per Section 5.2(A) shall be paid prior to the actual issuance of the
21 building permit. After the water usage has been measured and the actual connection fee
22 determined, the customer shall pay the balance of the connection fee within thirty (30) days of
23 issuance of notification from the City. The notification shall be issued by the Director of Water
24 Resources and Conservation or his/her designee and shall indicate the due date.
