Summary Statement:
On July 11, 2007, the City received 3 bids for FEMA Street Pavement Replacement 2007 Project Nos. F070006,
F071106, F073106, F073306, F073606, F073706, F073906, F074106, and F074406, ranging from $369,295.40 to
$438,471.80. In general, the work includes repair of a 1,265 foot section of gravel shoulder along the east side of
Stony Point Rd., north of Petaluma Blvd. N.; repair of a section of ditch slope at the SW comer of Petaluma Blvd.
N. and Industrial Ave.; and street pavement replacement on sections of Maria Dr., Ely Blvd. S., Casa Grande Rd.
and Pine View Way.

1. EXECUTIVE SUMMARY:
On July 11, 2007, the City received 3 bids for FEMA Street Pavement Replacement 2007
Project Nos. F070006, F071106, F073106, F073306, F073606, F073706, F073906,
F074106, and F074406, ranging from $369,295.40 to $438,471.80. In general, the work
includes repair of a 1,265 foot section of gravel shoulder along the east side of Stony
Point Rd., north of Petaluma Blvd. N.; repair of a section of ditch slope at the SW corner
of Petaluma Blvd. N. and Industrial Ave.; and street pavement replacement on sections of
Maria Dr., Ely Blvd. S., Casa Grande Rd. and Pine View Way.
2. BACKGROUND:
During the storm events of December 17, 2005 to January 3, 2006, rising flood waters
caused the following to occur: washed out gravel shoulder along the north shoulder of
Stony Point Rd., and washed out gravel shoulder at the end of a concrete slab within 10
ft. of a traffic lane on Petaluma Blvd. N., scouring the adjacent drainage ditch.
During the storm events of March 29, 2006 to April 16, 2006, record-setting heavy rains
resulted in prolonged surface runoff, roadway flooding and adjacent soil saturation,
causing sections of Maria Dr., Ely Blvd. S., Casa Grande Rd. and Pine View Way to
subside vertically.
The costs for the various work areas are to be tracked separately for FEMA cost recovery.
All work associated with this contract will be 100% funded by FEMA.
3. ALTERNATIVES:
A. Award the contract.
B. Reject the bids and re -advertise.
C. Reject the bids and do not perform the work.

FINANCIAL IMPACTS:
The engineer's estimate was $330,769.00. The following is the summary of bids:

The above budget is an estimate of the actual project cost. FEMA/OES will reimburse
the City 100% of the actual costs for design, construction management/inspection, and
construction.
CONCLUSION:
On July 11, 2007, the City received 3 bids for this project. The apparent low bidder is
FEDCO Construction Co., with a low bid of $369,295.40. Staff believes that the City
received good bids and is recommending award of the contract.
OUTCOMES OR PERFORMANCE MEASUREMENTS THAT WILL IDENTIFY SUCCESS OR
COMPLETION:
Following the award, the Contractor will enter into agreement with the City and submit
the required contract documents, bonds and insurance. Construction is anticipated to start
by the end August, 2007.
7. RECOMMENDATION:
Adopt the resolution awarding the construction contract to the low bid submitted by
FEDCO Construction Co. in the amount of $369,295.40 and authorize the City Manager
to execute the construction contract.

RESOLUTION APPROVING THE PROJECT BUDGET AND
AUTHORIZING THE AWARD OF CONTRACT TO
FEDCO CONSTRUCTION, INC. FOR THE
FEMA STREET PAVEMENT REPLACEMENT 2007
PROJECT F070006, F071106, F073106, F073306, F073606,
F073706, F073906, F074106, AND F074406
WHEREAS, City staff has worked diligently with FEMA/OES consultants to
prepare construction bid documents and advertise for construction of this Project; and
WHEREAS, in accordance with California Public Contract Code Section 20162
and other applicable law, City staff solicited bids for the Project; and
WHEREAS, the project was bid on July 11, 2007, and three (3) bids were
received and opened in accordance with applicable law; and
WHEREAS, the lowest bid for the Project was from FEDCO Construction, Inc.
for $369,295.40; and
WHEREAS, staff has determined that FEDCO Construction, Inc.'s bid satisfies
the bidding requirements for the Project; and
WHEREAS, staff has verified that FEDCO Construction Inc. possesses a valid
California Contractor's License, Class A, number 479227 that qualifies FEDCO
Construction Inc. to perform the Project; and
WHEREAS, the Project has a Negative Declaration under the California
Environmental Quality Act ("CEQA"), pursuant to Article 19, Section 15301, of Title 14
of the California Code of Regulations ("CEQA Guidelines").
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City
hereby:
1. Approves the Project Budget in the amount of $521,745.40.
2. In accordance with California Public Contract Code Section 20162 and other
applicable law, waives any and all non -conformances in the bid of FEDCO
Construction, Inc. for the FEMA Street Pavement Replacement 2007 Project and
finds the bid of $369,295.40 to be the lowest, responsible bid.

3. Awards the contract for the FEMA Street Pavement Replacement 2007 Project to
FEDCO Construction, Inc. in the amount of $369,295.40, the amount of the
lowest responsible bid, conditioned on FEDCO Construction, Inc. timely
executing the project contract and submitting all required documents, including
but not limited to, executed bonds, certificates of insurance, and endorsements, in
accordance with the project bid documents.
4. Directs staff to issue a notice of award to FEDCO Construction, Inc.
5. Authorizes and directs the City Manager to execute the project contract on behalf
of the City of Petaluma upon timely submission by FEDCO Construction, Inc. of
the signed project contract and all other required documents, including but not
limited to, executed bonds, certificates of insurance, and endorsements, in
accordance with the project bid documents.
