Location Map Summary Statement: Work in Phase 2 of this project consisted of reconstructing the entire length of Payran Street from the Petaluma River to Jefferson Street, including replacement of existing sanitary sewer and water main, installation of storm drains, new curb or cobble curb replacement, gutter, sidewalk, installation of street lighting on the segment from the River to Washington, tree planting, and installation of an irrigation system from East Washington to Jefferson. North Bay Construction's original bid amount was $4,085,865.75. The original contingency balance for construction was $612,900. Contract Change Orders amounted to $612,502.41, which represents a 15% increase over the original contract, and is within the project contingency. Recommended City Council Action/Sueeested Motion: Adopt a resolution accepting the completion of the Various Street Reconstruction Project, Phase 2, Project No. C500206. BACKGROUND: MTC's pavement management study identified the need for reconstruction of project sections on Ely Boulevard, Caulfield Lane and Payran Streets. Due to the locations and scope of the improvements required, the projects were put into two separate construction packages. The construction contract for Phase 1, including Ely and Caulfield, was accepted on November 20, 2006. Phase 2, Payran reconstruction, included paving, replacement of sidewalks and curb ramps, required for ADA compliance, new water and sewer lines, lighting, landscaping and improved storm drainage. 3. Finance Department will release the 10% retention to the contractor within 60 days after Council acceptance, as noted in the contract documents. OUTCOMES OR PERFORMANCE MEASUREMENTS THAT WILL IDENTIFY SUCCESS OR COMPLETION: The work on Payran (Phase 2 of this project) was, itself, completed in three phases. The first phase consisted of installing the deep utilities, such as sewer main, laterals, drainage lines, inlets, and other related work. The second phase consisted of installing all remaining underground items on the entire project and completing the curb and gutter and roadway section, including finished paving from East Washington to the Petaluma River. The third phase consisted of all remaining work. Staff worked diligently in partnership with the contractor and all stakeholders to prosecute completion of all project phases, as planned, which enabled the work to be completed on time and within budget. Page 4 ATTACHMENTI RESOLUTION NO. 2007 - CITY OF PETALUMA ACCEPTING COMPLETION OF THE NORTH BAY CONSTRUCTION, INC. VARIOUS STREET RECONSTRUCTION PROJECT, PHASE 2, PROJECT NO. C500206 WHEREAS, in accordance with Section 68 of Article X of the City of Petaluma Charter Section 20162 of the Cali forma Public Contract Code and other applicable law, the City of Petaluma solicited bids for the Various Street Reconstruction Project, Phase 2, ("Project"); and WHEREAS, bids for the Project were opened on August 29, 2006 in accordance with California Public Contract Code Section 4105.5 and other applicable law; and WHEREAS, the apparent low bid for the Project was the bid of North Bay Construction, Inc. in the amount of $4,085,865.75; and WHEREAS, by Resolution No. 2006-157 adopted September 11, 2006, the City of Petaluma found the bid of $4,085,865.75 for the Project to be the lowest responsive bid and awarded the Project to North Bay Construction, Inc. in the amount of $4,085,865.75 conditioned on North Bay Construction's timely executing the Project contract and submitting all required documents, and authorized and directed the City Manager to sign the Project contract on behalf of the City of Petaluma upon such timely submission and to execute on behalf of the City of Petaluma any change orders and other amendments to the Project contract that are necessary to effectively complete the project and/or to realize the Project and/or cost benefits for the City of Petaluma, so long as such change orders or amendments do not result in an increase in excess of 15 percent of the total Project amount; and WHEREAS, the following Change Orders affecting the Project amount have been approved: Ij Change Order # Description Cost #1 Project Milestone Incentives $200,000.00 #2 Underground Utility Conflicts $33,147.20 #3 Changes Associated with PG&E Utilities $50,310.18 #4 Changes Associated with Water, Sewer and Drainage $82,721.32 #5 Relocation of water meters $16,122.78 #6 Potholing to locate Gas Laterals prior to Paving $34,075.99 #7 Sanitary Sewer Force Main $67,523.60 #8 Final Balancing of all Items -$28,559.56 #9 Changes Associated with Water, Irrigation, and Gas Services $47,930.83 #10 Removal, Grinding, & Replacement of Sycamore trees $37,854.16 #11 Additional Striping, Electrical and ADA Ramp Items $71,375.91 Total of all Change Orders $612,502.41 Page 5 WHEREAS, the final contract amount including all approved contract change orders is $4,698,368.16; and WHEREAS, City of Petaluma staff have inspected the Project and determined that it has been completed in accordance with the contract requirements subject to the Contractor's continuing warranty and other obligations pursuant to the contract; and WHEREAS, based on the foregoing, staff recommends acceptance of the Project on behalf of the City of Petaluma; NOW, THEREFORE, BE IT RESOLVED by the City of Petaluma that 1) The final total construction contract of $4,698,368.16 is approved and that the City Cleric is hereby authorized to sign the Notice of Completion. 2) Administrative Services is hereby authorized to release to North Bay Construction, Inc. all undisputed retention not subject to pending change orders, within sixty (60) days after Council acceptance, in accordance with the terms of the Project contract, California Public Contract Code Section 7107 and applicable law.
