HomeMy WebLinkAboutPCDC Resolution 2004-16 09/13/2004RESOLUTION 2004-16 PETALUMA COMMUNITY DEVELOPMENT COMIIAISSION ADOPTING A RESOLUTION APPROVING THE PROJECT BUDGET AUTHORIZING THE AWARD OF BID FOR CONSTRUCTION OF THE DOWNTOWN IMPROVEMENTS STREETSCAPE- LANDSCAPING, SIDEWALK TREATMENTS AND FURNISHINGS IN PHASE 1 PROJECT 0200603/9053 WHEREAS, on July 19, 2004, the Petaluma Community Development Commission ("PCDC") held a public hearing and adopted the FY 2004-05 PCDC Budget for the period from June 1, 2004 to June 30, 2005; and, WHEREAS, the Commission finds that the transactions authorized in this resolution are consistent with and effectuate the purposes of California Community Redevelopment Law (Health and Safety Code Section 33000 et seq.); and, WHEREAS, the Project is exempt from the California Environmental Quality Act ("CEQA") pursuant to Article 19, Section 15301, of Title 14 of the California Code of Regulations ("CEQA Guidelines"), because the project consists of repair, maintenance, and minor alteration of existing public structures and/or facilities involving negligible or no expansion of use beyond that existing at the time of the determination of exemption, including, but not limited to, restoration or rehabilitation of deteriorated or damaged structures, facilities, or mechanical equipment to meet current standards of public health and safety; and, WHEREAS, the Commission has an interest in expediting the construction of the Downtown Improvements-Streetscape-Landscaping, Sidewalk Treatments and Furnishings in Phase 1 Area, ("Downtown Improvements") project number 0200603/9053; and, WHEREAS, PCDC staff have worked diligently with ZAC Landscape Architects, Inc. to design and prepare construction bid documents and advertise for construction of this Project; and, WHEREAS, completion of the Downtown Improvements in this project will eliminate blighting conditions in the Project Area in that the present deteriorated condition of the sidewalk to be rehabilitated is unsightly, and creates pedestrian hazards; and, WHEREAS, the Commission and City staff are aware of no other source of funds reasonably available to undertake the Downtown Improvements as the only other source available for such purpose would be City general fund revenues which are committed for the provision of essential services such as police and fire services; and, PCDC Resolution No. 2004-16 Page 1 WHEREAS, California Health and Safety Code Section 33445 provides that a redevelopment agency may, with the consent of the legislative body, pay for the cost of the construction of improvements which are publicly owned if the Legislative body determines all of the following: 1. That the improvements are of benefit to the project area or the immediate neighbor hood in which the project is located; 2. That no other reasonable means of financing the improvements is available to the community and 3. That the payment of funds for the cost of the improvements will assist in the elimination of one or more blighting conditions inside the project area, and will be consistent with the implementation plan adopted by the redevelopment agency. WHEREAS, per California Public Contract Code Section 20688.2 and other applicable laws, competitive bids were solicited for the project; and, WHEREAS, the PCDC received two (2) bids for the Project; and, WHEREAS, the bids were opened on August 29, 2004, Base Bid plus Alterative A $947,591.40 and one for $1,443,622.00; and, WHEREAS, the bid invitation for the Project specified that the low bidder would be determined by the sum of the Base Bid plus Additive Alternate A; and, WHEREAS, Cagwin 8~ Dorward Landscape Contractors, submitted the low bid for the base bid plus Additive Alternate A for $947,591.40. NOW, THEREFORE, BE IT RESOLVED that the Petaluma Community Development Commission hereby: Finds that (i) the expenditure of tax increment funds to undertake the Downtown Improvements as set forth in this Resolution will be of benefit to the Project Areas, (ii) no other reasonable means of financing the Downtown Improvements is reasonably available, (iii) completion of the Downtown Improvements will eliminate blighting conditions in the Project Area; and (iv) completion of the Downtown Improvements is consist with the Implementation Plan adopted for the Project Area. 2. Authorizes the expenditure of tax. increment funds in the amount of $1,229,400 for the purpose of completing the. Downtown Improvements within the CBD Project Area. 3. Removes all discontinuities in the Cagwin 8~ Dorward Landscape Contractors bid. 4. Awards the Contract for the Downtown Improvements-Streetscape- Landscaping, Sidewalk Treatments and Furnishings in Phase 1 Area, Project PCDC Resolution No. 2004-16 Page 2 #C200603 to Cagwin & Dorward Landscape Contractors for $908,903 for the base bid only.
