PCDC Resolution No. 2004-14 Page 1
NOW, THEREFORE, BE IT RESOLVED that the Petaluma Community Development
Commission hereby:
1. Finds that competitive bidding is not required by law because (i) California
Public Contract Code Section 20688.2, requiring competitive bidding for
redevelopment agency grading, clearing, demolition or construction does
not apply to the purchase of materials, and (ii) competitive bidding would
prevent the City of Petaluma, the Project Area and the PCDC from benefiting
from the purchase of custom designed materials from local manufacturers,
and (iii) competitive bidding may not result in a lower price for manufacture
of the street furniture than the prices quoted by Petaluma High School, Ridge
Foundry, Napa Valley Cast Stone and Canterbury International.
2. Authorizes and approves the sole source purchase of benches, both cast
iron/wood and metal plaza-style, tree grates, mid-block trash/recycle
receptacles on poles, corner anchor trash receptacles, bike bollards, traffic
bollards, and planter pots in accordance with the SPARC-approved
specifications in an amount not to exceed $345,000.
3. Authorizes and directs the Executive Director to execute contracts with
Petaluma High School, Ridge Foundry, Napa Valley Cast Stone and
Canterbury International for the foregoing purchases.
