HomeMy WebLinkAboutPCDC Resolution 2004-11 07/12/2004RES®LUTI®N 200411 PETALUMA COMMUNITY DEVELOPMENT COMMISSION RESOLUTION AUTHORIZING THE AWARD OF BID FOR THE INSTALLATION OF A PEDESTRIAN BRIDGE TO CROSS WASHINGTON CREEK AND CONSTRUCTION OF A PEDESTRIAN AND BICYCLE PATHWAY AS PART OF THE PETALUMA RIVER/TRAIL ENHANCEMENT PROJECT AREA 3 PROJECT #9876/C200503 WHEREAS, on June 16, 2003, the Petaluma Community Development Commission ("PCDC") held a public hearing and adopted the FY 2003-04 PCDC Budget for the period from July 1, 2003 to June 30, 2004; and, WHEREAS, the Commission finds that the transactions authorized in this resolution. are consistent with and effectuate the purposes of California Community Redevelopment Law (Health and Safety Code Section 33000 et seq.); and, WHEREAS, the Commission has an interest in expediting the construction of the River Trail Enhancement, Area 3, project number 9876/C200503; and, WHEREAS, PCDC staff have worked diligently with CSW Stuber-Stroeh Engineering Group to design and prepare construction bid documents and advertise for construction of this Project; and, WHEREAS, Per California Public Contract Code Section 20688.2 and other applicable laws, competitive bids were solicited for the project; and, WHEREAS, the PCDC received eight (8) bids for the Project; and, WHEREAS, the bids were opened on May 10, 2004, and ranged from $817,085. to $1,304,071. for the sum of the Base Bid plus all five alternate pathway surface options; and, WHEREAS, the bid invitation for the Project specified that the low bidder would be determined based on the amounts bid for the base bid and the sum of all five Alternate pathway surfaces A, B, C, D and E; and, WHEREAS, Frontier Construction, submitted the low bid for the base bid plus the five Alternates A, B, C, D, and E for $817,085; and, WHEREAS, the PCDC staff received correspondence from Maggiora Ghilotti, Inc. and Tri- County Electrical protesting against the award of fhe Project to Frontier Construction; and, WHEREAS, Frontier Construction withdrew their bids due to a clerical mistake and the PCDC consents to relieve Frontier Construction from its bid in accordance with Public Contracts Code Section 5100 et. seq., and, PCDC Resolution No. 2004-1 1 Page 1 WHEREAS, Maggiora Ghilotti, Inc. submitted the next lowest bid for the base bid plus the five Alternates A, B, C, D and E for $895,895. NOW, THEREFORE, BE IT RESOLVED that the Petaluma Community Development Commission hereby: 1. Approves the Plans and Specifications Prepared by CSW Stuber-Stroeh Engineering Group, Inc. 2. Approves the Project Budget. 3. Removes all discontinuities in the Maggiora Ghilotti, Inc. bid. 4. Awards the Contract for the Petaluma River Trail Enhancement Project, Project #C200503 to Maggiora Ghilotti, Inc. for $703,145, which is the sum of the base bid plus Alternate A for a Quarry Fine pathway surface.
