PETALUMA COMMUNITY DEVELOPMENT COMMISSION
AUTHORIZING THE PURCHASE OF A PREFABRICATED PEDESTRIAN BRIDGE TO CROSS
WASHINGTON CREEK AS PART OF THE PETALUMA RIVER TRAIL PROJECT
WHEREAS, on June 16, 2003, the Petaluma Community Development Commission
("PCDC") held a public hearing and adopted the FY 2003-04 PCDC Budget for the
period from July 1, 2003 to June 30, 2004;
WHEREAS, the Commission finds that the transactions authorized in this resolution are
consistent with and effectuate the purposes of California Community Redevelopment
Law (Health and Safety Code Section 33000 et seq.);
WHEREAS, the Commission has an interest in expediting the construction of the
River Trail Enhancement project number 9876/C200503;
WHEREAS, City staff has investigated potential sources, soliciting three bids, from
which such a pedestrian bridge may be obtained;
WHEREAS, City staff have identified a supplier who can manufacture such a
bridge in accordance with the specifications provided by the structural engineer of
CSW Stuber-Stroeh Engineering Group;
WHEREAS, California Public Contract Code Section 20688.2, requiring
competitive bidding for redevelopment agency grading, clearing, demolition or
construction does not apply to the purchase. of materials, such as a pedestrian bridge;
WHEREAS, City staff have identified Wheeler Consolidated, as the lowest responsible
quote for the specified bridge, which has quoted a maximum unit price of $27,735 for a
55-foot pedestrian bridge, including, taxes and delivery to the construction site;
WHEREAS, City staff have been advised that production of the bridge will require
a 12 week manufacturing process; and
NOW, THEREFORE, BE IT RESOLVED that the Petaluma Community Development
Commission hereby:
Finds that competitive bidding is not required by law because (i}
California Public Contract Code section 20688.2 requiring competitive
bidding for redevelopment agency grading, clearing, demolition or

construction does not apply to the purchase of materials, and (ii)
competitive bidding would be disadvantageous to the City of Petaluma,
the Project Area and the PCDC because it would unreasonably delay
implementation of public improvements necessary for the implementation
of the Project Area redevelopment plan, and (iii) competitive bidding
would be unlikely to result in a lower price for manufacture of the
pedestrian bridge than the price quoted by Wheeler Consolidated.
2. Authorizes and approves the purchase of a pedestrian bridge for
$27,735.00.
3. Authorizes and directs the Executive Director to execute a contract with
Wheeler Consolidated for the foregoing purchase in an amount not to
exceed $27,735.00.
