RESOLUTION ACCEPTING COMPLETION OF THE
2007 SANITARY SEWER MAIN REPLACEMENT PROJECT
EXECUTIVE SUMMARY:
D'Arcy & Harty Construction, hnc. has completed the 2007 Sewer Main Replacement Project for
$715,896. The base contract total cost is $654,137, and four contract change orders were issued
in the total amount of $61,759. The contract change orders were approved for design revisions
to address previously unknown underground conditions. The total budget for construction is
$812,027.
2. BACKGROUND:
To maintain and improve the condition of the City's wastewater system, the Department of
Water Resources and Conservation annually replaces or rehabilitates deteriorating sanitary sewer
mains throughout the City. The 2007 Sanitary Sewer Main Replacement involves replacing or
rehabilitating approximately 4,000 feet of sanitary sewer mains on Keller Street between
Western Avenue and "A" Street, Sixth Street between "A" Street and `B" Street, Post Street
between Bassett Street and `B" Street, Bassett Street between Post Street and Upham Street,
English Street between Upham Street and Western Avenue, Fair Street between Dana Street and
300 feet east of Dana Street, Sheldon Street between Dana Street and English Street, Webster
Street between Western Avenue and Dana Street, and Bodega Avenue between Ruth Court and
100 feet east of Ruth Court, to improve service and reduce maintenance costs. These locations
are illustrated on Exhibit A.
Department of Water Resources and Conservation staff prepared the plans and specifications for
this project. The Notice Inviting Bids was issued on January 25, 2007. Bids were received and
opened on February 22, 2007. The contract was awarded by the City Council on March 19, 2007.
Construction began on June 4, 2007, and was completed on September 24, 2007.
Informational notices on the project were sent to nearby residences and businesses before
construction began. A copy of the notice is included as Exhibit B.

5. CONCLUSION:
Following the acceptance of the project, the City Cleric will file a Notice of Completion with the
Sonoma County Recorder, and the Finance Department will release the retention money to the
contractor within 60 days.
OUTCOMES OR PERFORMANCE MEASUREMENTS THAT WILL IDENTIFY SUCCESS OR
COMPLETION:
Successful completion of the project.
RECOMMENDATION:
City Management recommends the City Council adopt the resolution accepting completion of
the 2007 Sewer Main Replacement Project.
ADOPTING A RESOLUTION ACCEPTING COMPLETION OF THE
2007 SEWER MAIN REPLACEMENT PROJECT,
PROJECT NO. 8221-54151
WHEREAS, in accordance with Section 68 of Article X of the City of Petaluma Charter,
Section 20162 of the California Public Contract Code and other applicable law, the City of
Petaluma solicited bids for the 2007 Sewer Main Replacement project ("Project"); and
WHEREAS, bids for the Project were opened on February 22, 2007 in accordance with
California Public Contract Code Section 4104.5 and other applicable law; and
WHEREAS, the apparent low bid for the Project was the bid of D'Arcy & Harty Construction,
Inc. in the amount of $706,027; and
WHEREAS, by Resolution No. 2007-042 adopted March 19, 2007 the City Council of the City
of Petaluma found the bid of $706,027 for the Project to be the lowest responsive bid and
awarded the Project to D'Arcy & Harty Construction, Inc. in the amount of $706,027
conditioned on D'Arcy & Harty Construction, Ine.'s timely executing the Project contract and
submitting all required documents and authorized and directed the City Manager to sign the
Project contract on behalf of the City upon such timely submission and to execute on behalf of
the City any change orders and other amendments to the Project contract that are necessary to
effectively complete the project and/or to realize the Project and/or cost benefits for the City so
long as such change orders or amendments do not result in an increase in excess of 20 percent of
the total Project amount; and
WHEREAS, the following change orders affecting the Project amount have been approved:
Change Order No. 1: English Street Design Revisions $50,039
Change Order No. 2: Bodega Avenue Design Revisions $8,503
Change Order No. 3: English Street Differing Site Conditions $737
Change Order No. 4: Post and Bassett Street Revisions $2,480
Total Change Orders: $61,759
; and
WHEREAS, the final contract amount as amended including all change orders is $715,896; and
WHEREAS, City staff have inspected the Project and determined that it has been completed in
accordance with the contract requirements subject to the Contractor's continuing warranty and
other obligations pursuant to the contract; and

WHEREAS, based on the foregoing, staff recommends acceptance of the Project on behalf of
the City;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Petaluma as
follows:
1. The contract entitled 2007 Sewer Main Replacement Project, Project No. 8221-54151
with a final contract amount of $715,896 is accepted as complete subject to the
Contractor's continuing warranty and other obligations pursuant to the contract.
The City ClerldRecording Secretary is hereby authorized and directed to file a Notice
of Completion concerning the Project with the Sonoma County Clerk's Office within
ten (10) days of the date of this Resolution.
Staff are hereby authorized and directed to release all undisputed retention not subject
to pending change orders within sixty (60) days of the date of this Resolution and in
accordance with the terms of the Project contract, California Public Contract Code
Section 7107 and applicable law.
