SUBJECT: Resolution Authorizing Award of Contract for the Park Place Drive Water
Service Replacement Project
RECOMMENDATION
It is recommended that the City Council approve the Resolution Authorizing the Award of
Contract for the Park Place Drive Water Service Replacement Project.
BACKGROUND
The current project continues the City program to replace defective water services that result in
frequent pipe breaks and water leaks. Many of the water services installed during the 1970's and
early 80's included polybutylene "blue- tube" piping to connect the water main to the customer's
water meter. Polybutylene (PB) is plastic resin used to manufacture pipes and fittings that
becomes brittle causing micro- fractures and pipe failure. The industry has since moved away
from its use, however, and many cities, including Petaluma, are left with thousands of PB water
services. Maintenance crews routinely replace these old services as they fail. The subject project
will upgrade the deteriorated water services and water main service saddles to current City
standards in the Park Place Development. The increased number of failures of PB service lines
has elevated the priority of this project.
The City has approximately 4,200 polybutylene service lines remaining to be upgraded.
Approximately 1,800 services have been upgraded in the past. The City has approximately
18,500 service lines. This project will replace a total of 170 polybutylene service lines with high -
density polyethylene (HDPE) pipe leaving roughly 4,000 to be upgraded in the future. The water
service replacements will be phased over multiple years due to the cost and size of the project.
The projects are prioritized based on failure rates.
DISCUSSION
The project was designed and contract documents compiled in -house by City staff. A Notice
Inviting Bids was advertised on January 18, 2017 and five (5) bids were received as follows:

Lowest Responsible Bidder
The lowest responsible and responsive bidder, Michael Paul Company, has performed various
water projects for the City of Petaluma. Staff verified that Michael Paul Company possesses a
valid Class A California Contractor's License, number 386001, which qualifies Michael Paul
Company to perform the work. Michael Paul Company has performed similar work in Petaluma,
Terra Linda, Mill Valley, and Santa Rosa.
Construction is scheduled to begin in April 2017 and to be completed by June 2017.
Construction management and inspection services will be performed by City staff with assistance
by an outside consultant for geotechnical and material testing. It is expected that additional
services will be change ordered into the contract since the bid prices were favorable compared to
the Engineer's Estimate. For that reason, the contract contingency is recommended to be
$111,700, which allows maximum production with the existing budget.
The proposed action meets Council Goals: "Plan for and implement priority capital projects as
funding permits."
FINANCIAL IMPACTS
The project was added to the CIP in the 2016/2017 First Quarter Budget Adjustment and the
current action has no unanticipated impacts to the existing FY 16/17 budget. The following table

RESOLUTION AUTHORIZING THE AWARD OF CONTRACT FOR THE PARK
PLACE DRIVE WATER SERVICE REPLACEMENT PROJECT
WHEREAS, in accordance with the City of Petaluma Charter and Municipal Code,
California Public Contract Code Section 20162 and other applicable law, City staff prepared
construction bid documents and solicited bids for the Project; and
WHEREAS, the project was bid on January 18, 2017, and five (5) bids were received
and opened on February 22, 2017 in accordance with applicable law; and
WHEREAS, the lowest responsible bid for the Project was submitted by Michael Paul
Company, from Petaluma, CA for $438,300; and
WHEREAS, staff has determined that the Contractor's bid satisfies the bidding
requirements for the Project; and
WHEREAS, staff has verified that Michael Paul Company possesses a valid California
Contractor's License, Class A, number 386001 that qualifies Michael Paul Company to perform
the Project; and
WHEREAS, the Project is categorically exempt pursuant to California Environmental
Quality Act ( "CEQA ") and Title 14, the California Code of Regulations ( "CEQA Guidelines "),
Section 15301, because the project consists of repair and maintenance to an existing public
street.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Petaluma hereby:
1. In accordance with the City of Petaluma Charter and Municipal Code, California Public
Contract Code Section 20162 and other applicable law, waives any and all non-
conformance in the bid of Michael Paul Company for the Park Place Drive Water Service
Replacement, Project No. C67501714, finds the bid of $438,300 to be the lowest,
responsive bid and further finds that Michael Paul Company is the lowest responsible
bidder.
1 Awards the contract for the Park Place Drive Water Service Replacement Project No.
C67501714 to Michael Paul Company, in the amount of $438,300, the amount of the
lowest responsive bid, conditioned on Michael Paul Company's timely executing the
project contract and submitting all required documents, including but not limited to,
executed bonds, certificates of insurance, and endorsements, in accordance with the
project bid documents.
4. Directs staff to issue a notice of award to Michael Paul Company.
5. Authorizes and directs the City Manager to execute the project contract on behalf of the
City of Petaluma upon timely submission by W.R. Forde Associates of the signed project
contract and all other required document, including but not limited to, executed bonds,
certificates of insurance, and endorsements, in accordance with the project bid
documents.
