3. PUBLIC COMMENT
The Committee will hear public comments only on matters over which it has jurisdiction. There
will be no Committee /Commission discussion or action. The Chair will allot no more than three
minutes to any individual. If more than three persons wish to speak, their time will be allotted
so that the total amount of time allocated to this agenda item will be 15 minutes.

Council member King was absent. No report was given.
B. Pedestrian and Bicycle Committee — Richard Marzo
Commissioner Marzo was absent. No report was given.

S. STAFF COMMENT
A. Planning Manager's Report
Planning Manager, Heather Hines, reported that the Planning Commissioners' Conference is on
Saturday December 3rd from 9:00 -1:00 at Sonoma State University. She also announced that
she is considering adjusting the second Planning Commission meeting dates in November and
December to avoid holiday conflicts. She suggested moving the November 20th meeting to
November 29th and the December 27th meeting to December 20th. Although she hasn't heard
from everyone, there is already a quorum for those meetings.

A. Approval of Minutes of joint Planning Commission /HCPC Meeting of Tuesday, September 13,
2016.

A. Lakeville Business Park PCD Amendment — Amendment to the existing Lakeville Business Park
Planned Community Development to allow Fitness /Health Facility as a conditionally permitted

Daniel Mandel, Gibson, Dunn and Crutcher, Legal Counsel to Tom McLaughlin, reiterated his
client's concerns about the proposed modifications to the Lakeville Business Park PCD. Mr.
McLaughlin is concerned about upsetting the balance of the business park and about important
land use decisions being made at an administrative level with a minor use permit for fitness
facilities. His client would like to see changes made only to lots 20 and 21. Mr. Mandel stated
that there was also concern about the CECA analysis which stated that there is no possibility
that the project may have an effect on the environment.

B. Text Changes to the City of Petaluma Implementing Zoning Ordinance, Chapter 15
(Preservation of the Cultural and Historic Environment); Text Changes to the City of Petaluma
Municipal Code, Chapter 2.30 (Historical and Cultural Preservation Committee) — Modifications
to amend the Petaluma Implementing Zoning Ordinance and Petaluma Municipal Code to
separate the composition of the Historical and Cultural Preservation Committee from the
Planning Commission and redefine the powers and duties of both. Staff: Heather Hines,

Motion: Continue to a date certain of October 11, 2016 for modifications to amend the
Petaluma Implementing Zoning Ordinance and Petaluma Municipal Code to
separate the composition of the Historical and Cultural Preservation Committee
from the Planning Commission and redefine the powers and duties of both made
by Jennifer Pierre, seconded by Diana Gomez.
Vote: Motion carried 7 - 0.

demolish an existing detached garage and replace it with a new detached garage including a
364 square foot study at the second story within the Oakhill- Brewster Historic District. Also
being requested is an exception to the garage setback on Galland Street.
