HomeMy WebLinkAboutStaff Report 5.C 04/03/2017DATE: April 3, 2017 Agenda Item #5.0 TO: Honorable Mayor and Members of the City Council through City Manager FROM: D GnS SCE — Director, Public Works & Utilities Ler, P.E. — Deputy Director, Public Works & Utilities SUBJECT: Resolution Authorizing Award of Contract for the Petaluma Boulevard South Sewer Trunk Main Replacement Project RECOMMENDATION It is recommended that the City Council approve the Resolution Authorizing Award of Contract for the Petaluma Boulevard South Sewer Trunk Main Replacement Project. BACKGROUND The subject Project was identified as a priority in the last Sewer Master Plan completed over a decade ago and has been in the City's CIP for several years. The project was delayed recently to allow Pacific Gas & Electric to replace the gas transmission main and allow the City to complete a more critical sewer improvement on Weller and D Streets. During one of the large storms of December 2014, the City experienced a high number of sanitary sewer overflows (SSOs) along Petaluma Boulevard South and some adjacent streets, due to the lack of capacity within the existing sanitary sewer system along with infiltration and inflow problems. This section of sewer is older and numerous pipe defects were identified through a routine video inspection of the pipe interior. To address this issue, a project was proposed to remove or abandon the existing sewer mains along Petaluma Boulevard South between Mountain View Avenue and H Street, and replace them with larger sewer mains that are capable of handling higher flows as shown in the Attachment 2. The Petaluma Boulevard South Sewer Trunk Main Replacement Project includes the abandonment of an existing 12 -inch sewer, and the removal of roughly 2,000 linear feet of both 6 -inch pipe and 18 -inch pipe and replacing them with 8 -inch and 21 -inch pipes, respectively. The sewer manholes along the new mains will be rehabilitated. All of the existing laterals, up to the back of the curb, will be replaced. Ancillary work includes replacement of sidewalk, curb and gutter, driveways, and curb ramps; removal of several trees; and replacement of traffic loops at the signalized intersections. This project will improve reliability, increase capacity, and reduce maintenance, inflow, and infiltration. The proposed action meets Council Goal: "Plan for and implement priority capital projects as funding permits." DISCUSSION A Notice Inviting Bids was advertised on February 9, 2017 and the bid opening was on March 2, 2017. Bid Alternate #1 included removing a 6 -inch pipe and installing a new 8 -inch pipe by trenching and excavating. Bid Alternate #2 includes the use of pipe bursting in places to replace the 6 -inch pipe with the 8 -inch pipe. The lowest apparent responsible and responsive bidder was Team Ghilotti, Inc., with a combined Base Bid and Bid Alternate #1 of $2,206,985. Team Ghilotti, Inc. has performed similar sewer projects throughout the area, including many in Petaluma. Team Ghilotti, Inc. possesses a valid Class "A" California Contractor's License, number 895384, which meets the contracting requirements to perform the work. A bid protest letter dated March 8, 2017 was received from Argonaut Constructors alleging that the apparent low bidder did not list subcontractor's license numbers in the "List of Subcontractors" form. Team Ghilotti, Inc. provided the Department of Industrial Relations (DIR) registration number for the subcontractors under the "Public Works Contractor Registration Number" column. The DIR registration number can only be obtained by a contractor holding a valid contractor's license number and are acceptable as a "Public Works Contractor Registration Number ". Therefore, it is recommended that the bid protest be rejected, as it has no merit. Construction management and inspection services will be conducted by City staff with assistance by an outside consultant for geotechnical and material testing. Construction is scheduled to begin in May 2017 and to be completed by late summer 2017. FINANCIAL IMPACTS The total projects budget for the Petaluma Boulevard South Sewer Trunk Main Replacement Project (C66401314) is $3,113,000. Location Map 3 Attachment 1 RESOLUTION AUTHORIZING THE AWARD OF CONTRACT FOR THE PETALUMA BOULEVARD SOUTH SEWER TRUNK MAIN REPLACEMENT PROJECT WHEREAS, in accordance with the City of Petaluma Charter and Municipal Code, California Public Contract Code Section 20162 and other applicable law, City staff prepared construction bid documents and solicited bids for the Project; and WHEREAS, the project was advertised on February 9, 2017, and six (6) bids were received and opened on February 22, 2017 in accordance with applicable law; and WHEREAS, the lowest responsible bid for the Project was submitted by Team Ghilotti, Inc., from Petaluma, CA for $2,206,985; and WHEREAS, the bid protest submitted by Argonaut Constructors on March 8, 2017 is rejected; and WHEREAS, staff has determined that the Contractor's bid satisfies the bidding requirements for the Project; and WHEREAS, staff has verified that Team Ghilotti, Inc. possesses a valid California Contractor's License, Class A, number 895384 that qualifies Team Ghilotti, Inc. to perform the Project; and WHEREAS, the Project is categorically exempt pursuant to California Environmental Quality Act ( "CEQA ") and Title 14, the California Code of Regulations ( "CEQA Guidelines "), Section 15302, because the project consists of replacement or reconstruction of existing utility systems and /or facilities involving negligible expansion of capacity. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Petaluma hereby: 1. In accordance with the City of Petaluma Charter and Municipal Code, California Public Contract Code Section 20162 and other applicable law, waives any and all non - conformance in the bid of Team Ghilotti, Inc. for the Petaluma Boulevard South Sewer Trunk Main Replacement Project No. C66401314, finds the bid of $2,206,985 to be the lowest, responsive bid and further finds that Team Ghilotti, Inc. is the lowest responsible bidder. 2. The bid protest by Argonaut Constructors is rejected. Team Ghilotti, Inc. complied with the bid procedures by listing the Department of Industrial Relations number rather than the contractors' license numbers. 3. Awards the contract for the Petaluma Boulevard South Sewer Trunk Main Replacement, Project No. C664013.14 to Team Ghilotti, Inc., in the amount of $2,206,985, the amount of the lowest responsive bid, conditioned on Team Ghilotti's rd timely executing the project contract and submitting all required documents, including but not limited to, executed bonds, certificates of insurance, and endorsements, in accordance with the project bid documents. 4. Approves a construction contract contingency of $443,415.00 5. Directs staff to issue a notice of award to Team Ghilotti, Inc. 6. Authorizes and directs the City Manager to execute the project contract on behalf of the City of Petaluma upon timely submission by Team Ghilotti, Inc. of the signed project contract and all other required documents, including but not limited to, executed bonds, certificates of insurance, and endorsements, in accordance with the project bid documents.
