RESOLUTION ACCEPTING COMPLETION OF THE 2005 OXIDATION POND 1
DIKE REPAIR PROJECT
PROJECT NO. C500405
1. EXECUTIVE SUMMARY:
Ghilotti Construction Company has completed the Oxidation Pond 1 Dike Repair Project, which
involved removing plant material and placing rip -rap for erosion protection from wind and
aeration equipment around Oxidation Pond No. 1.
2. BACKGROUND:
This project is the third of three projects designed to improve the treatment capacity of the
oxidation ponds and prepare the oxidation pond site for construction of the Ellis Creek Water
Recycling Facility. The first project was the Interim Aerator Improvement project, and included
installation of aerators in Oxidation Pond No. 4. This project began in Summer 2005 and is
scheduled to be completed in January 2006. The second project, the Phase II Biosolids Removal
Project, included removal of approximately 1,300 tons of biosolids from Oxidation Pond No. 1.
This project was completed in November.
The third project is the 2005 Oxidation Pond 1 Dike Repair Project. Portions of the dikes
surrounding the oxidation ponds, including Oxidation Pond No. 1, were originally constructed in
1972 without any erosion protection (rip/rap). The Department of Water Resources and
Conservation began a systematic program to repair and protect the dikes in 1997. Since that
time, dikes surrounding Oxidation Pond Nos. 2, 3, 4, 5, 6, 8, and 9 have been repaired or
partially protected. Oxidation Pond No. 1 required repair to the dike due to excessive plant
growth on the levy and dike erosion. The project involved removing plant material, and placing
3,400 tons ofriprap for erosion protection from wind and aeration equipment. The location of
the project is shown on Exhibit A. Exhibits B and C are before and after photographs of the
project site, respectively.
The Department of Water Resources and Conservation prepared the plans and specifications for
this project. The Notice Inviting Bids was issued on August 29, 2005. Bids were received and
opened on September 29, 2005. The contract was awarded by the City Council on November 7,
2005. The contractor completed the work on December 16, 2005.
The 10% retention is due and payable 60 days after the acceptance of the project.
3. ALTERNATIVES:
Accept the completion of the project.
4. FINANCIAL IMPACTS:
CONSTRUCTION CONTRACT $290,000

The final contract cost is $305,000, which is funded by the Wastewater Funds. The construction
budget was $373,000.

Following the acceptance of the project, the City Clerk will file a Notice of Completion with
Sonoma County Recorder and Administrative Services Department will release the retention
money to the Contractor 60 days after the acceptance of the project.
6. OUTCOMES OR PERFORMANCE MEASUREMENTS THAT WILL IDENTIFY SUCCESS OR
COMPLETION:
Completion of the construction.
RECOMMENDATION:
City Management recommends that the City Council adopt the resolution accepting completion
of the 2005 Oxidation Pond 1 Dike Repair Project.
ACCEPTING COMPLETION OF THE
2005 OXIDATION POND DIKE REPAIR PROJECT
PROJECT NO. C500405
WHEREAS, the City Council awarded the contract for the 20045 Oxidation Pond 1 Dike Repair
Project to Ghilotti Construction Company, 246 Ghilotti Avenue, Santa Rosa, CA 95401 , on
November 7, 2005;
WHEREAS, Ghilotti Construction Company has completed all the work to the satisfaction of
the Director of Water Resources & Conservation;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Petaluma, that
the project is hereby accepted subject to the Contractor completing the punch list work within
thirty days after acceptance of the project;
NOW BE IT RESOLVED by the Petaluma City Council that:
1. The City Clerk is hereby authorized to sign the Notice of Completion and file the same
with Sonoma County Recorder.
2. The Administrative Services Department is hereby authorized to release the retention
money to the Ghilotti Construction Company sixty days after the acceptance of the
project provided that no liens or stop notices have been filed against the project.
3. This resolution shall become effective immediately.
4. All portions of this resolution are severable. Should any individual component of this
resolution be adjudged to be invalid and unenforceable by a body of competent
jurisdiction, then the remaining resolution portions shall be and continue in full force and
effect, except as to those resolution portions that have been adjudge invalid. The City
Council of the City of Petaluma hereby declares that it would have adopted this
resolution and each section, subsection, clause, sentence, phrase and other portion
thereof, irrespective of the fact that one or more section subsection, clause sentence,
phrase or other portion may be held invalid or unconstitutional.
