As described in the attached engineering report, over the last two winters, the roadway has started to visibly fail and slip into the river. The proposed construction package, prepared by CSW Stuber-Stroeb Engineering Group, Inc., will replace the existing retaining walls with one sheetpile wall similar to the floodwalls installed by Army Corps of Engineers further upstream. This project is partof the River Trail Enhancement project that was approved by SPARC on May 12, 2005. Four (4) Bids were opened on August 18, 2005, ranging from $633,100 to $749,550. Valentine Corporation was the lowest responsible bidder. Copies of the bid packages are available for review in the City Clerk's Office. The purpose of this item is to approve the project budget and award a construction contract to Valentine Corporation for the total sum of $633,100 and approve the total construction project budget. BACKGROUND: This project is part of implementing the Petaluma River Access and Enhancement Plan, adopted May, 1996 by constructing, in phases, a pedestrian/bicycle path along the River. CSW Stuber-Stroeh Engineering Group, Inc. has prepared all plans for implementing the River Trail Enhancement Project from Washington Creek to Washington Street of which this project is the second phase to be constructed Final SPARC approval for the whole project was obtained at their May 12, 2005, Committee meeting. The pathway at this location - a 10' minimum sidewalk parallel to and attached to the floodwall - was not included in these plans and will be included in the adjacent Water Street North project being designed, constructed and funded by the developer. The Notice of Inviting Bids was issued on July 28, 2005, and four (4) bids were opened on August 18, 2005. The Table 1 details the bid summary. The floodwall project must be closely scheduled with Water Resources' adjacent sewer line replacement project and with the Water Street North developer's street construction project. The main operation of the floodwall involves driving sheet piles for the retaining wall into the River. Per our Fish and Game Permit, work in the River can only occur in the dry summer months, between June 15th and October 15th. Since the contractor cannot effectively begin construction immediately, the contract will be suspended until spring. Retaining this contractor allows the City to take advantage of the low bid, received from Valentine Corporation, at atime when construction costs are rising significantly and gives the staff opportunity to manage the schedule coordination with the sewer line and street projects. 2 Table 1 Total Project - . ALTERNATIVES: A. Award the construction contract to Valentine Corporation and approve the project budget. B. Reject all bids and re -bid project. C. Take no action and allow the Contractors bid to expire. 4. FINANCIAL IMPACTS: Table 2 identifies the FY 05-06 PCDC budget appropriated by the PCDC and the current budget for actual expenses on the River Trail Enhancement Project Number C200503. The total FY 05-06 budget of $2,648,000, currently authorized, is all from the PCDC fund. The remaining River Trail portions are funded in part, with SCTA Measure M funds for which the Cooperative Agreement is currently being prepared. CONCLUSION: Following the award, the contractor will enter into a contract with the PCDC and submit the required contract documents, bonds and insurance. The Water Street North Floodwall Project will begin spring 2006 as coordinated with Water Resources' sewer project and the developer's Water Street North construction. 6. OUTCOMES OR PERFORMANCE MEASUREMENTS THAT WILL IDENTIFY SUCCESS OR COMPLETION: North Water Street Floodwall will be completed within budget and accepted in summer 2006. 7. RECOMMENDATION: Adopt the resolution, as described, awarding a construction contract and approving the total construction project budget of $888,731. 0 ATTACHMENT 1 RESOLUTION # 2005- PETALUMA COMMUNITY DEVELOPMENT COMMISSION DISCUSSION AND ACTION APPROVING A RESOLUTION AUTHORIZING THE PROJECT BUDGET, AND AWARDING THE CONTRACT FOR THE NORTH WATER STREET FLOODWALL, PROJECT #C200503 WHEREAS, the Commission finds that the transactions authorized in this resolution are consistent with and effectuate the purposes of California Community Redevelopment Law (Health and Safety Code Section 33000 et seq.); and WHEREAS, of the amount appropriated to the 2005-06 PCDC budget, $888,731 is currently budgeted for the North Water Street Floodwall portion of the River Trail Enhancement Project No. C200503 ("Project"); and WHEREAS, Public Works staff have worked diligently with CSW Stuber-Stroeh Engineering Group, Inc., to design and prepare construction bid documents and advertise for construction of this Project; and WHEREAS, in accordance with California Public Contract Code Section 20688.2 and other applicable law, staff solicited bids for the Project; and WHEREAS, the project was bid on August 18, 2005, and four (4) bids were received and opened in accordance with applicable law; and WHEREAS, the lowest bid for construction of the Project was the bid from Valentine Corporation for $633,100; and WHEREAS, staff has determined that Valentine Corporation's bid satisfies the bidding requirements for the Project; and WHEREAS, staff has verified that Valentine Corporation possesses a valid California Contractor's License, Class A, number 229225, that qualifies Valentine Corporation to perform the Project; and WHEREAS, permits have been obtained from the US Army Corps of Engineers, US Coast Guard, & California Department of Fish and Game; and WHEREAS, the Project is exempt from the California Environmental Quality Act ("CEQA") pursuant to Article 19, Section 15301, of Title 14 of the California Code of Regulations ("CEQA Guidelines"), because the project consists of repair, maintenance, and minor alteration of existing public structures and/or facilities involving negligible or no expansion of use beyond that existing at the time of the determination of exemption, including, but not limited to, restoration or rehabilitation of deteriorated or damaged structures, facilities, or mechanical equipment to meet current standards of public health and safety. NOW, THEREFORE, BE IT RESOLVED that the Petaluma Community Development Commission hereby: 1. Determines the above recitals are true and correct and hereby declared to be findings of the Petaluma Community Development Commission. 2. Approves the project budget in the amount of $888,731. 3. In accordance with California Public Contract Code Section 20688.2 and other applicable law waives any and all non -conformities in the bid of Valentine Corporation for the North Water Street Floodwall Project and finds the bid of Valentine Corporation to be the lowest, responsive bid. 4. Awards the contract for the North Water Street Floodwall Project to Valentine Corporation in the amount of $633,100, the amount of the lowest responsible bid, conditioned on Valentine Corporation timely executing the project contract and submitting all required documents, including, but not limited to, executed bonds, certificates of insurance, and endorsements, in accordance with the project bid documents. 5. Directs staff to issue anotice of award to Valentine Corporation. 6. Authorizes and directs the Petaluma Community Development Commission Executive Director to execute the project contract on behalf of the City of Petaluma, upon timely submission by Valentine Corporation of the signed project contract and all other required documents, including, but not limited to, executed bonds, certificates of insurance, and endorsements, in accordance with the project bid documents. 7. Further authorizes the Petaluma Community Development Commission Executive Director, or his designee, to execute, on behalf of the City of Petaluma, any and all change orders and other amendments to the project contract that are necessary to effectively complete the project and/or to realize project and/or cost benefits for the City of Petaluma and the public. 8. Based on the foregoing, finds that (i) the expenditure of tax increment funds to undertake the Project set forth in this Resolution will be of benefit to the Project Area, (ii) no other reasonable means of financing the Project is reasonably available, (iii) completion of the Project will eliminate blighting conditions in the Project Area; and (iv) completion of the Public Improvement is consistent with the Implementation Plan of the Project Area. Z ATTACHMENT 4 CITY OF PETALUMA, CALIFORNIA MEMORANDUM Public Works Department, 11 English Street, Petaluma, CA 94952 (707) 778-4303 Fax (707) 778-4437 DATE: November 21, 2005 TO: Joyce Clark, PE, Capital Improvements Manager FROM: John Hanson, PE, Public Works Project Manager SUBJECT: Existing Petaluma River Retaining Wall on Water Street North I asked CSW Struber Stroeh, designers of the new Floodwall project, if they reported on the condition of the existing retaining wall(s) on Water Street North near Washington. Greg Grobin, their structural engineer, said they visually inspected the existing wall(s) and did not report on the condition of the walls because it was very apparent that both walls were failing based on the missing portion of roadway directly behind the failed (missing) section of wall (Picture #1) and the evident condition both walls are in. There are actually two separate retaining walls in this area. The first wall that abuts the Washington Street Bridge concrete wing wall was built from railroad steel rails (used as posts) and what appears to be boxcar sides (used as lagging members). This wall is —90 feet long. The second wall continues from the first and was constructed from treated wood poles, used as posts, and treated wood lagging members (-4' x 12"). The second wall is —70 feet long. The Steel wall has several posts that are overturning (-2'-3' away from a vertical position) allowing the street and backfill behind them to settle (see picture #2). One section of boxcar lagging has failed at the bottom and backfill has been escaping into to the River causing roadway settlement (see picture #3). Sedimentation has been identified as a pollutant by the Regional Water Quality Control Board. And the Petaluma River is considered an impaired body of water. The City has the obligation to reduce or eliminate pollutant discharge into the River. The second, wood wall is in very poor condition. All of the wood posts are severely weathered and their cores decomposed (see picture #4). One section has backfill escaping between wood lagging members which has caused a void in the roadway —2'x4'x2'. Another section of wall, —25' long, is completely missing allowing the River direct eroding access to the roadway subgrade (see pictures #1 & 5). Portions of the roadway adjacent to the vacant wall section have collapsed into the river. Wide cracks in the asphalt and soil represent vertical layers of soil separating from each other with soil under the tracks being retained by the tracks and soil just outside of the tracks slowly collapsing into the river. This area of wall vacancy is the area that poses the greatest concerns. Separation of the roadway from the tracks will continue to occur over time. Current improvement plans entail the removal and replacement of the railroad tracks. These railroad tracks are currently acting to retain the soil beneath them and distribute the soil loads to stronger areas on the walls. Removal of said tracks could have a linchpin effect on the soil beneath them and cause f rther soil separation. The summation of the aforementioned factors will preclude the successful construction of the adjacent roadway as currently designed. If the current design changes and allows the railroad tracks to remain in place, there is not sufficient lateral support in the missing wall area. A wall will need to be built or additional embankment would need to be placed to give this support. Building additional embankment out into the river will change the hydraulic shape and flow characteristics of the River and has not yet been permitted by the Army Corps of Enginneers. This approval could take one year or more. In the event that the proposed roadway is built prior to the floodwall, the floodwall work (as currently plazmed) would require removal and replacement of portions of the new roadway.
