HomeMy WebLinkAboutPCDC Resolution 2002-10 09/09/2002 i RES®LUTION N®. 2002-10 PETAI,LIMA C®MMUNITY DEVEL®PMENT C®MMISSI®N ADOPTION OF A MITIGATED NEGATIVE DECLARATION AND APPROVAL OF CIRCULATION AND PARKING ALTERNATIVE "B" FOR THE WATER STREET PORTION OF THE PETALUMA RIVER ACCESS AND ENHANCEMENT PLAN WHEREAS, an Initial Study was prepared and the results of the study indicated that the proposed project will not cause any significant adverse environmental impacts; and, WHEREAS, the Petaluma Community Development Commission (PCDC) considered two Circulation and Parking Alternatives (Alternatives B & E), for the Water Street Portion of the Petaluma River Access and Enhancement Plan, on September 9, 2002, and considered all written and verbal communications concerning potential environmental impacts resulting from the project and the merits of the project before rendering a decision; NOW, THEREFORE BE IT RESOLVED that the PCDC approves a Mitigated Negative Declaration and Project Alternative "B" based on the findings below. FINDINGS FOR APPROVAL OF THE MITIGATED NEGATIVE DECLARATION AND THE PROJECT: 1. An Initial Study has been prepared and proper notice provided in accordance with CEQA and local Guidelines. 2. Based upon the Initial Study and comments received, potential impacts could be avoided or reduced to a level of insignificance by mitigation measures attached as conditions of approval. There is no substantial evidence that the project, as conditioned, would have a significant effect on the environment and the Mitigated Negative Declaration reflects the lead agency's independent judgment and analysis. 3. A monitoring program has been included to ensure compliance with the adopted mitigation measures. 4. The project does not have the potential to affect wildlife resources as defined in the Fish and Game code, either individually or cumulatively and is exempt from Fish and Game filing fees. 5. The project is not located on a site listed on any Hazardous Waste Site List compiled by the State pursuant to Section 65962.5 of the Government Code. PCDC Reso. No. 2002-10 Page 1 6. The PCDC reviewed the Initial Study/Mitigated Negative Declaration and considered the comments before making a decision on the project. 7. The record of proceedings of the decision on the project is available for public review at the City of Petaluma, City Hall, ll English Street, Petaluma, California.
