HomeMy WebLinkAboutPCDC Resolution 2001-02 01/16/2001 s to t Resolution 1®To. 2001-02 ®f the Petaluma Community Development Commission APPROVE THE PRELIMINARY REPORT FOR THE CBD REDEVELOPMENT PLAN AMENDMENT, RECEIVE THE DRAFT ENVIRONMENT IMPACT REPORT, RECEIVE THE DRAFT AMENDED AND RESTATED REDEVELOPMENT PLAN FOR THE CENTRAL BUSINESS DISTRICT PROJECT, AND FORWARD SAME TO AFFECTED TAXING AGENCIES RECITALS A. The City Council of the City of Petaluma adopted a Redevelopment Survey Area pursuant to Health and Safety Code, Section 33310 on May 9, 1999. B. The Petaluma Planning Commission adopted the proposed Petaluma Redevelopment Project Area and the Petaluma Redevelopment Project Area Preliminary Plan on July 12, 1999. C. A Preliminary Report has been prepared for the Amended Project Area, in accordance with Health and Safety Code Section 33344.5 containing all of the following: 1) The reasons for the selection of the Added Project Area. 2) A description of the physical and economic conditions existing in the Amended Project Area. 3) A description of the Added Project Area which is sufficiently detailed for a determination as to whether the Project Area is predominantly urbanized, including at least the following information: (a) The total number of acres within the Added Project Area. (b) The total nm~~ber of acres that are characterized by conditions of blight as defined in Health .and Safety Code Section 33031. Reso.2001-02 Page 1 (c) The total number of acres that is in agricultural use. (d) The total number of acres that is an integral part of an area developed for urban use. (e) The percent of property within the Added Project Area that is predominantly urbanized. (f) A map of the Added Project Area that identifies the properties described in paragraphs (b), (c) and (d) and the property not developed for urban use. 4) A preliminary assessment of the proposed method of financing the redevelopment of the Amended Project Area, including an assessment of the economic feasibility of the amended project and the reasons for the proposed use of tax increment funding in the Added Area. a) A description of the specific projects proposed by the Agency. b) A description of how the projects will improve or alleviate conditions of blight. D. The Agency has identified the taxing entities that levied a property tax on all or any portion of the property located in the proposed Amended Project Area during the last fiscal year, as required by Health and Safety Code § 33353.2. E. The Preliminary Report does not identify any lands that are in agricultural use and notice as provided in Health and Safety Code Section 33344.5(g) is not required. F. A Draft Environmental Impact Report has been prepared for this Amended Project Area and is available for public review and comment effective January 12, 2001. Reso.2001-02 Page 2 . RESOLVED that the Petaluma Community Development Commission (Agency), pursuant to the above recitals, finds and determines: Section 1. The Preliminary Report for the Central Business District Redevelopment Plan Amendment required by Health and Safety Code §33344.5, attached hereto as Exhibit A, is hereby approved. Section 2: The Petaluma Community Development Commission hereby directs the transmittal of the Preliminary Report to each affected taxing entity. Section 3. The Petaluma Community Development Commission hereby directs the transmittal of the Draft Environmental Impact Report to each affected taxing entity for review and comment upon receipt by the Agency. Section 4. The Petaluma Community Development Commission hereby directs the transmittal of the draft Amended and Restated Redevelopment Plan for the Central Business District Redevelopment Project to each affected taxing entity.
