Proclamation of Termination of Local Emergency Summary Statement: As a result of the extensive flooding experienced by the City of Petahuna beginning Friday, December 30, 2005, on December 31, 2005, the City Manager signed a Proclamation of Existence of a Local Emergency (attached). Pursuant to Petaluma Municipal Code section 2.32.060 and California Government Code section 8630, on Thursday, January 5, 2006, a special meeting was held at which the City Council ratified the Proclamation of Existence of a Local Emergency by adopting a Proclamation Confirming Existence of a Local Emergency (attached). In accordance with Government Code section 8630, the City Council is required to review at its regularly scheduled meetings until the emergency is terminated the need for continuing the local emergency. Review of the need for continuing the emergency must occur no less than 21 days after the prior review. If it is determined that the emergency is continuing, the proclamation shall remain in effect. Section 8630 requires terminating the local emergency at the earliest possible date conditions warrant. Recommended City Council Action/Suggested Motion: If the Council determines that a local emergency no longer exists, it is recommended that the Proclamation of Termination of Local Emergency be adopted. That conditions of extreme peril to the safety of persons and property have arisen within said City, caused by (fire, flood, storm, epidemic, riot, earthquake, or other cause); and B. That the City Council of the City of Petaluma is not in session and cannot immediately be called into session. NOW, THEREFORE, IT IS HEREBY PROCLAIMED: That a local emergency now exists within said City; and 2. OProclamations1 9/25/02 (fink) 2 PROCLAMATION CONFIRMING EXISTENCE OF A LOCAL EMERGENCY. {Confirms Director's Proclamation} WHEREAS, Section 2.32.060 of the Petaluma Municipal Code empowers the Director of Emergency Services to proclaim the existence or threatened existence of a local emergency when said City is affected or Iikely to be affected by public calamity and the City is not in session, subject to ratification by the City Council within seven days; and WHEREAS, conditions of extreme peril to the safety of persons and property have arisen within the City, caused by (fire, flood, storm, epidemic, riot, earthquake, or other cause), commencing on or about 9:00 PM on the 30`t' day of December, 2005, at which time the City Council of the City of Petalmna was not in session; and WHEREAS, said City Council does hereby find that the aforesaid conditions of extreme peril did warrant and necessitate the proclamation of the existence of a local emergency; and WHEREAS, the Director of Emergency Services of the City of Petaluma did proclaim the existence of a local emergency within said City on the 315L day of December, 2005. NOW, THEREFORE, IT IS HEREIN PROCLAIMED AND ORDERED: 1. That the Proclamation of Existence of a Local Emergency, as issued by said Director of Emergency Services is hereby ratified and confirmed by the City Council of the City of Petaluma; and 2. That said local emergency shall be deemed to continue to exist until its termination is proclaimed by the City Council of the City of Petaluma, State of California. Passed and adopted at a special meeting of the Petaluma City Council held on the day of January, 2006, by the following vote: AYES: NOES: ABSENT: ATTEST: City Clerk aw resp 1103106 (fork) F , Mayor PROCLAMATION OF TERMINATION OF LOCAL EMERGENCY WHEREAS, a local emergency presently exists in the City of Petaluma in accordance with the proclamation thereof by the City Council on the 5th day of January, 2006, as a result of conditions of extreme peril to the safety of persons and property caused by fire, flood, storm, epidemic, riot, earthquake, or other cause; and WHEREAS, the situation resulting from said conditions of extreme peril is now deemed to be within the control of the normal protective services, personnel, equipment, and facilities of and within said City of Petaluma. NOW, THEREFORE, the City Council of the City of Petaluma, State of California, does hereby proclaim the termination of said local emergency.
