Summary Statement:
The City Council awarded the contract to construct the 7 -acre park located at the Gatti site (Leghorns Park)
to North Bay Construction, Inc. The project was value engineered to bring the project within budgeted
amounts. Eight change orders were issued during the project totaling $70,735.70 (2.5°l0). Total contracted
contract construction cost was $2,864,336.76.
The project has been completed per the plans and specifications.

10 1. EXECUTIVE SUMMARY:

12 The City Council Awarded the contract to construct the park located at the Gatti park site (Leghorns
13 Park) to North Bay Construction, Inc. The project has been completed per plans and specifications
14 for a total amount of $2,864,336.70.
15 2. BACKGROUND:

17 At their meeting of June 7, 2004, the City Council awarded the contract to construct the 7 -acre
18 community park to be located on the Gatti park site. The contract was awarded to the low bidder,
19 North Bay Construction, Inc. for an amount of $ 2,958,396. Staff values engineered the project with
20 the contractor to reduce the project budget. The ultimate contract amount being $2,804,331. During
21 the construction of the project 8 change orders were issued for a total amount of $ 70,735 (2.5%).
22 The project was designed by Gretchen Stranzi McCann Landscape Architects, who also acted as
23 project inspectors. The finished park was named Leghorn Park and was officially opened on
24 November 19, 2005.

26 3, ALTERNATIVES:

28 a. Approve the resolution accepting the project as complete, and authorize the City clerk to file a
29 Notice of Completion with the County Recorder.
30 b. Not accept the project. This alternative is not recommended since the contractor satisfactorily
31 completed the project per the plans and specifications.

34 4. FINANCIAL IMPACTS:

36 The original low bid (North Bay Construction, Inc) for the project was $ 2,958,396. The City
37 Council awarded the bid to North Bay Construction and authorized staff to values engineer the
38 project. The contracted amount was for $ 2,804,331 with a 5% contingency. Three sources of
39 funding were used for the project. Delco builders contributed $496,966.42 as part of the conditions
40 of approval regarding the Cross Creek Subdivision and the development of a future park. The Santa
41 Rosa Junior College District contributed $255,000 as part of a joint powers agreement regarding use
42 of the park for Junior College activities. Both entities have paid their contributions. The balance of
43 funds used for the project were from Park Development Fees.

45 5. CONCLUSION:

47 The contractor has completed the project to construct Leghorns Park on the Gatti park site, per the
48 plans and specifications. Since the park has been completed as required, it is appropriate to accept
49 the project and authorize the City Clerk to file a Notice of Completion with the County Clerk.

OUTCOMES OR PERFORMANCE MEASUREMENTS THAT WILL IDENTIFY SUCCESS OR,
COMPLETION:
Once the City Council accepts the project as complete, the City Clerk can file a Notice of
Completion with the County Recorder. The Finance Department will release the 10 % retention to
the contractor forty-five (45) days after the recordation of the Notice of Completion as provided in
the specifications, provided there are no liens filed against the project.
RECOMMENDATION:
Recommend adoption of the resolution accepting the completion of the project to construct a 7 -acre
park (Leghoms Park) at the Gatti park site, and authorize the City Clerk to file a notice of
Completion.

DISCUSSION AND ACTION ADOPTING A RESOLUTION
ACCEPTING COMPLETION OF THE NORTH BAY CONSTRUCTION, INC.
CONTRACT
FOR THE GATTI (LEGHORNS) PARK PROJECT, PROJECT NO. C400204
WTIE REAS, in accordance with Section 68 of Article X of the City of Petaluma Charter,
Section 20162 of the California Public Contract Code and other applicable law, the City of
Petaluma solicited bids for the Gatti Park Site Project ("Project"); and
WHEREAS, bids for the Project were opened on May 4, 2004 in accordance with California
Public Contract Code Section 4105.5 and other applicable law; and
WHEREAS, the apparent low bid for the Project was the bid of North Bay Construction, Inc. in
the amount of $2,958,396; and
WHEREAS, by Resolution No. 2004-088 N.C.S, adopted June 7, 2004, the City Council of the
City of Petaluma found the bid of $2,958,396 for the Project to be the lowest responsive bid and
awarded the Project to North Bay Construction, Inc. in the amount of
$ 2,958,396 conditioned on staff working with the successful Iow bidder and values engineer the
project to lower the project budget and North Bay Construction, Inc.'s timely executing the
Project contract and submitting all required documents and authorized and directed the City
Manager to sign the Project contract on behalf of the City upon such timely submission and to
execute on behalf of the City any change orders and other amendments to the Project contract
that are necessary to effectively complete the project and/or to realize the Project and/or cost
benefits for the City so long as such change orders or amendments do not result in an increase in
excess of Three (3%) percent of the total Project amount; and
WHEREAS, the following change orders affecting the Project amount have been approved:
1. Reroute and add to PG&E Service $19,880.00
2. Over excavation and moisture conditioning the site per the Soils Engineer's direction
25,140.00
3. Furnish and install stainless steel fixtures and hose bibs to modular restroom 7,146.00
4. Reroute new storm drains, expose and raise existing utilities 11,788.70
5. Due to inclement weather, provide contract extension N/C
6. Install precautionary warning tape on 5,000 LF of irrigation main 1,429.00
7. Install telephone / PG&E pull boxes for irrigation system telemetering station 4,540.00
8. Contract Quantity Adjustments including infield and playground surfaces 812.00
Total Change Orders: $70,735.70; and

WHEREAS, the final contract amount as amended including all change orders is $2,864,336.76;
and
WHEREAS, City staff have inspected the Project and determined that it has been completed in
accordance with the contract requirements subject to the Contractor's continuing warranty and
other obligations pursuant to the contract; and
WHEREAS, based on the foregoing, staff recommends acceptance of the Project on behalf of
the City;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Petaluma as
follows:
1. The contract entitled Gatti Park Site Project, Project No. 0400204 with a final
contract amount of $ 2,864,336.76 is accepted as complete subject to the Contractor's
continuing warranty and other obligations pursuant to the contract.
2. The City Clerk/Recording Secretary is hereby authorized and directed to file a Notice
of Completion concerning the Project with the Sonoma County Clerk's Office within
ten (10) days of the date of this Resolution.
3. Staff are hereby authorized and directed to release all undisputed retention not subject
to pending change orders within sixty (60) days of the date of this Resolution and in
accordance with the terms of the Project contract, California Public Contract Code
Section 7107 and applicable law.
WHEREAS, based on the foregoing, staff recommends acceptance of the Project on behalf of
the City;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Petaluma as
follows:
