The contract was awarded to C. Hardy General Engineering Contractor, Inc. of Petaluma, for the amount of $605,110.50, which included $25,500 for three -years of maintenance service. Change orders totaled $57,933.93 (9.99%) to address minor additional work, post and cable fencing for the PCDC site, clean-up of hazardous materials (vandalism), and storm damage. HARDY GENERAL ENGINEERING CONTRACTOR, INC. OF PETALUMA 1. Executive Summarv: The City Council awarded the contract for construction of the Denman Reach, Phase 3 Project at the meeting of July 18, 2005. The contract was awarded to C. Hardy General Engineering Contractor, Inc. of Petaluma, for the amount of $605,110.50, which included $25,500 for three -years of maintenance service. Change orders totaled $57,933.93 (9.99°/x) to address minor additional work, post and cable fencing for the PCDC site, clean-up of hazardous materials (vandalism), and storm damage cleanup. This project was funded with a State Department of Water Resources - Urban Streams Restoration Program Grant, Water Resources Surface Water Impact Fees and PCDC - CIP funds. 2 Backeround: The construction work consisted of clearing and excavating approximately 22,000 cubic yards of river terrace soil and placing the soil at the PCDC site as engineered fill and landscape fill. Work included abandoning a well, installing 18 and 36 -inch stone drains, day -lighting an existing storm drain, paths and trails, bollards, site furnishings, fencing, landscaping, irrigation, planting of sensitive plants, educational kiosks, and other incidental work. The Project was allocated $747,636 in grant and approved budget funds. DWR grants for this phase totaled $992,798 (including land acquisition, design, management/inspection and City admin costs; Water Resources funding was $288,000; PCDC share for the project on the east side of Industrial Avenue was $305,000. C. Hardy was extremely helpful in ensuring that the project was completed per plan and within budget. hi addition, they will remain under contract to provide 3 -years of maintenance service. 3 Alternatives: a. Approve the Resolution accepting the project as complete, and authorizing the City Clerk to file a Notice of Completion with the County Recorder. b. Not accept this project, provide specific direction to staff for project modification. This alternative is not recommended since the contractor has performed per and even beyond the approved plans and specifications. 4 FinancialImnacts: The project has been completed within budget with additional funds remaining in the project to cover the three-year service maintenance. The remaining funds (approximately $84,500) could be utilized for initial analysis of undertaking a similar project immediately up -stream of this project to increase the storm flow capacity of this Reach (anticipated as a 2006-07 CIP project). J_ 5. Conclusion: The Contractor has completed the project to construct the Denman Reach, Phase 3 CIP Project per the plans and specifications. Since the project has been completed as required, it is appropriate to accept the project and authorize the City Clerk to file a Notice of Completion and for the City to release the 10% retention funds. 6. Outcomes or Performance Measurements That Will Identifv Success or Comnletion: Once the City Council accepts the project as complete, the City Clerk can file a Notice of Completion with the County Recorder. The Administrative Services Department will release the 10% retention to the contractor sixty (60) days after the recordation of the Notice of Completion, provided there are no liens on the project. 7. Recommendations: Recommend adoption of the attached Resolution accepting the project, release the 10% retention, and authorize the City Clerk to file a Notice of Completion with the County Cleric. Attachments: Resolution Accepting Completion Photographs of completed project 3 DISCUSSION AND ACTION ADOPTING A RESOLUTION ACCEPTING COMPLETION OF THE C. HARDY GENERAL ENGINEERING CONTRACTOR, INC., CONTRACTFOR DENMAN REACH, PHASE 3, CIP PROJECT NO. C500303 WHEREAS, in accordance with Section 68 of Article X of the City of Petaluma Charter, Section 20162 of the California Public Contract Code and other applicable law, the City of Petaluma solicited bids for the Denman Reach, Phase 3, project ("Project"); and WHEREAS, bids for the Project were opened on June 30, 2005 in accordance with California public Contract Code Section 4105.5 and other applicable law; and WHEREAS, the apparent low bid for the Project was the bid of C. Hardy General Engineering Contractor, Inc. in the amount of $605,110.50; and WHEREAS, by Resolution No. 2005-114 adopted July 18, 2005 the City Council of the City of Petaluma found the bid of $605,110.50 ($579,610.50 construction plus $25,500 three-year maintenance service) for the Project to be the lowest responsive bid and authorized the allocation and expenditure of $747,636 in grant and approved budget funds; and awarded the Project to C. Hardy General Engineering Contractor, Inc., in the amount of $605,110.50 conditioned on C. Hardy General Engineering Contractor's timely executing the Project contract and submitting all required documents and authorized and directed the City Manager to sign the Project contract on behalf of the City upon such timely submission and to execute on behalf of the City any change orders and other amendments to the Project contract that are necessary to effectively complete the project and/or to realize the Project and/or cost benefits for the City so long as such change orders or amendments do not result in an excess of 15 percent of the total Project amount; and WHEREAS, the following change orders affecting the Project amount have been approved: #1 Added plants, additional post & cable fencing, etc. $ 8,429.08 #2 Post and cable fence for PCDC Auto Plaza property $16,168.00 #3 Clean up of hazardous materials spill (vandalism),compost $135886.85 #4 Clean up storm damage, add rip -rap at geocell trail/surface water overflow area 519.450.00 Total Change Orders: $57,933.93; and WHEREAS, the final contract amount was $663,044.43 [$579,610.50 construction contract, plus $57,933.93 (9.99%) of contingency funds; and $25,500 for three -years of maintenance (2006-2008)]; and WHEREAS, City staff have inspected the Project and determined that it has been completed in accordance with the contract requirements subject to the Contractor's continuing warranty and other obligations pursuant to the contract; and q WHEREAS, based on the foregoing, staff recommends acceptance of the Project on behalf of the City; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Petaluma as follows: The contract entitled C. Hardy General Engineering Contractor, Inc., CIP Project No. C500303 with a final amount of $663,044.43 is accepted as complete subject to the Contractor's continuing warranty and other obligations pursuant to the contract, including a three-year maintenance contract for $25,500. The City Clerk/Recording Secretary is hereby authorized and directed to file a Notice of Completion concerning the Project with the Sonoma County Clerk's Office within ten (10) days of the date of this Resolution. Staff are hereby authorized and directed to release all undisputed retention not subject to pending change orders within sixty (60) days of the date of this Resolution and in accordance with the terms of the Project contract, Califomia Public Contract Code Section 7107 and applicable law.
