Summary Statement:
The owner of 418 51h Street is proposing to purchase a City owned parcel adjacent to and within the fenced
yard of their property. The City property contains a 72 -inch diameter storm drain that is part of the
Thompson Creels drainage system. Upon sale of the City parcel, an easement will be reserved over the
entire parcel to ensure access for maintenance and repair of the existing storm drain. The purchase offer is
$8,750.00 with an additional $1,350.00 for staff time.

Staff recommends that the City owned parcel identified in this report (APN 008-182-026) be sold for the
purchase price offer and that an easement be reserved over the parcel for access, maintenance and repair of
the existing storm drain.

AUTHORIZING THE SALE OF CITY OWNED PARCEL AT 418 5 T STREET
EXECUTIVE SUMMARY
The owner of 418 5°i Street is proposing to purchase a City owned parcel adjacent to and within the
fenced yard of their property. The City property contains a 72 -inch diameter storm drain that is part of
the Thompson Creels drainage system. Upon sale of the City parcel, an easement will be reserved over
the entire parcel to ensure access for maintenance and repair of the existing storm drain. The purchase
price offer is $8,750.00 with an additional $1,350.00 for staff time.
BACKGROUND:
In August of 2002 the then -owner of 418 5°i Street, while assisting his neighbor with tree branches in
danger of falling, found that the trees were on City property within his fenced yard. He then approached
the City to inquire about purchasing this parcel. After reviewing the request for purchase, instructions on
how to proceed were given to the property owner. The property was then sold and the present owner is
pursuing the purchase of the parcel from the City.
The situation is unique. The property at 418 5'h Street has a fenced yard that includes the City's parcel
(APN 008-182-026) and another parcel (APN 008-182-027) with unknown owner (see vicinity map).
A preliminary title report indicates that the City does in fact own the parcel in fee and that it was
originally acquired in 1897 for the improvement of Thompson Creels. A 72 -inch diameter storm drain
exists within the City parcel.
During discussions with the former owner of the property a list of steps and procedures were outlined in
order to pursue the purchase of the City parcel. The list included providing an appraisal, title report,
grant deed & purchase agreement. The City has received these documents and they have been reviewed
by the City Attorney's office.
Development potential for the existing parcel at 418 5'h Street yields one unit and will not change with
the addition of the City parcel and the unknown owner parcel because a storm drain easement is to be
reserved over the entire parcel. Structures are prohibited in public storm drain easements.
Probably the most compelling reason to sell the parcel is to eliminate the liability of the existing trees.
Typically the City would have an easement and not fee title for the installation and maintenance of
public water, sewer or stone drains. If the underlying fee title of this parcel is owned by another party,
then the responsibilities and liabilities of ownership would lie with that party.
The appraisal for the City parcel was provided by the former owner and was valued at $8,750.00. The
purchase agreement from the current owner offers $8,750.00 for the parcel and an additional $1,350.00
for compensation of staff time. The total cost equals $10,100.00.
Members of the City Council were able to review the details of the proposed purchase in closed session
on June 6, 2005. At that meeting a request was made by City Council to visit the site and determine if
any significant trees (requiring protection) were within the City owned parcel. Staff visited the site on
June 16, 2005 and observed no significant trees on the City owned parcel.
ALTERNATIVES:
If the property is not sold, it will remain under the ownership of the City of Petaluma.
4. FINANCIAL IMPACTS:
The City will receive compensation for the sale of the City parcel.
CONCLUSION:
The owners of 418 5`h'Street and City staff have worked together to arrive at a purchase agreement and
conditions that are acceptable to all parties involved.
6. OUTCOMES OR PERFORMANCE MEASUREMENTS THAT WILL IDENTIFY SUCCESS OR COMPLETION:

RECOMMENDATION:
Staff recommends that the City parcel identified in this report (APN 008-182-026) be sold for the total
purchase price offer and that an easement be reserved over the parcel for access, maintenance and repair
of the existing storm drain.

AN ORDINANCE AUTHORIZING THE SALE OF CITY OWNED PARCEL AT 418
5TH STREET (APN 008-182-026)
WHEREAS the property owner at 418 5th Street has requested to purchase the City
parcel (APN 008-182-026) that lies within his fenced yard; and
WHEREAS the property owner has had the City parcel appraised and is offering to
purchase the City parcel for the appraised amount ($8,750.00) and compensate the City
for staff time ($1,350.00); and
WHEREAS the City Council has heard this matter and agrees to the purchase price and
staff compensation.
THEREFORE, BE IT RESOLVED, that the City Council approves the sale of the City
owned property Imow as APN 008-182-026 accepting the appraised amount of $8,750.00
as compensation and accepting $1,350.00 as compensation for staff time. In addition as a
condition of sale, the City requires an easement to be reserved over the entire City parcel
for access, maintenance and repair of the existing storm drain. The City Manager is
hereby authorized to execute the purchase agreement and grant deed.
