2. Resolution of the Petaluma Community Development Commission Confirming PCDC Adoption of Living Wage Policy.
Summary Statement:
On November 20, 2006, the City Council adopted Ordinance No. 2256 N.C.S. to establish a living wage policy
for certain City contracts and employees. On November 6, 2006, the Petaluma Community Development
Commission adopted a concomitant resolution. Because of a clerical error in Ordinance No. 2256, it is necessary
to correct the chapter number of the Petaluma Municipal Code at which the living wage ordinance will be
codified, and to reinstate the former text of Chapter 2. 70 ("Senior Citizens Advisory Committee"), which was
unintentionally superseded by Ordinance No. 2256. The living wage ordinance will now be codified as new
Chapter 8.36, with no modification in its terms other than different chapter and subsection numbers. The
corrective ordinance also provides that Ordinance No. 2256 will remain in effect until the effective date of the
proposed ordinance, so that there will be no gap in the applicability of the living wage policy.
Recommended Citv Council Action/Suggested Motion: If the proposed corrective action meets with the
Council and Commission's approval, proceed with first reading of the ordinance and adopt the resolution.

ORDINANCE NO. __ _
AN ORDINANCE OF THE CITY OF PETALUMA RECODIFYING AND
READOPTING ORDINANCE NO. 2256 N.C.S.
(ESTABLISHING A LIVING WAGE REQUIREMENT FOR SPECIFIED
CITY FUNDED CONTRACTS AND CITY EMPLOYEES) AND
REINSTATING FORMER CHAPTER 2.70 OF THE MUNICIPAL CODE
OF THE CITY OF PETALUMA AS PREVIOUSLY CODIFIED
The City Council of the City of Petaluma ordains as follows:
Section 1. Amendment of Title 8.
Title 8 of the Municipal Code of the City of Petaluma is hereby amended by
adding Chapter 8.36, which shall contain the entirety of Section 1 of Ordinance No 2256
N.C.S. adopted November 20, 2006, without modification, except that all chapter,
section and subsection numbers shall refer to Chapter 8.36 rather than to Chapter 2. 70.
Section 2. Reinstatement of Former Chapter 2.70.
Chapter 2.70 of the Municipal Code of the City of Petaluma, "Senior Citizens
Advisory Committee", is hereby readopted and reinstated to read as codified prior to the
adoption of Ordinance No. 2256 N.C.S., and as adopted by Ordinance 1987 NCS §1
(part), 1991, with no change in its provisions, application or meaning.
Section 3. Continued Validity of Living Wage Ordinance.
The provisions of Ordinance 2256 N .C.S. shall remain in full force and effect until
the effective date of this ordinance, at which time Ordinance 2256 N.C.S. is repealed in
its entirety.
Section 4. Severability.
If any section, subsection, subdivision, paragraph, sentence, clause or phrase of
this Ordinance is for any reason held to be unconstitutional or invalid, such a decision
shall not affect the validity of the remaining portions of this Ordinance. The City Council
hereby declares that it would have passed each section, subsection, subdivision,
paragraph, sentence, clause or phrase of this Ordinance irrespective of the
unconstitutionality or invalidity of any section, subsection, subdivision, paragraph,
sentence, clause or phrase.
Section 5. Effective Date.
This Ordinance shall become effective thirty (30) days from and after the date of
its passage.

posted as required by law.

PETALUMA COMMUNITY DEVELOPMENT COMMISSION
CONFIRMING ADOPTION OF A LIVING WAGE POLICY
WHEREAS, on November 6, 2006, the Petaluma Community Development Commission
("PCDC") heard and considered the evidence presented to the Petaluma City Council relating to
Ordinance No. 2256 N.C.S., an Ordinance of the City of Petaluma Adding Chapter 2.70 [sic] to
the Municipal Code of the City of Petaluma, Establishing a Living Wage Requirement for
Specified City Funded Contracts and City Employees, and adopted the provisions of said
Ordinance as its own policy for activities assisted by the Agency, by approving PCDC Resolution
No. 2006-21, effective upon the effective date of Ordinance No. 2256 N.C.S.; and
WHEREAS, the need to correct the codification of Ordinance No. 2256 N.C.S. has made it
necessary for the Petaluma City Council to adopt Ordinance No. N.C.S., which recodifies
and readopts the living wage provisions of Ordinance No. 2256 N.C.S.; and
WHEREAS, the PCDC wishes to reconfirm its adoption ofthe living wage policy and provisions
to the same extent and in the same manner as adopted by the City of Petaluma,
NOW THEREFORE, BE IT RESOLVED by the Petaluma Community Development
Commission that:
1. The Petaluma Community Development Commission ("Agency") hereby adopts the
provisions of Ordinance No. as its own policy for activities assisted
by the Agency.
2. This Resolution shall take effect upon the effective date of Ordinance No.
